COMMUNITY APPEARANCE BOARD MEETING MINUTES May 29, 2019 A Meeting of the Community Appearance Board was held on May 29, 2019, at City Hall Council Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Chairperson Randy Wasserman called the meeting to order at 6:03 p.m. The Secretary called the roll. ROLL CALL: MEMBERS PRESENT Randy Wasserman Chairperson Bob Nienstadt Vice Chairperson Jalinda Coudriet Elana Whitehead MEMBERS ABSENT None OTHERS PRESENT Jen Nix Assistant City Attorney David Dickey Community Development Director Patsy Huffman Board Secretary Assistant City Attorney Nix swore in audience members who wished to speak at the meeting. Mr. Wasserman asked to change the order of the items on the Agenda so that item #3 was heard before item #2. NEW BUSINESS: 1. Approval of Meeting Minutes — March 20, 2019 Motion by Mr. Nienstadt, seconded by Mr. Wasserman to approve the Meeting Minutes of March 20, 2019. The motion carried unanimously. 2. Interview/Recommendation to City Council Re: Potential Board Members — Geoffrey Zuercher & Marlene Woodside Mr. Zuercher gave some background history to include living in Cape Canaveral since 2016. He would like to be a part of the process moving forward. Mrs. Woodside has been on the Culture and Leisure Services Board as well as the Chairperson for the Beautification Board. Community Appearance Board Meeting Minutes May 29, 2019 2 Motion by Mr. Wasserman and seconded by Mr. Nienstadt to recommend approval for both applicants to City Council. Vote on the motion carried unanimously. 3. Review and action regarding a Level 1 Application consistent with Chapter 22, Article III of the Code of Ordinances — City of Cape Canaveral Multi-Generational Facility — 7920 Orange Avenue Mr. Dickey presented Staff's report/photos. Staff pointed out the location of the proposed project, explained what buildings/structures would be demolished, described the surrounding properties, type of materials, colored renderings, life wall and murals being considered. Discussion ensued to include: indoor basketball court, hours of operation, type of glass used for energy efficiency, meeting the new codes, location of HVAC, cooling/heating zones and dumpster location. Rocky Randels suggested enhancing the outdoor restroom facilities. Mr. Gustavo explained the practicality of using the type of design on the plans. Additional landscaping was suggested by Board Members as a compromise. Motion by Mr. Wasserman and seconded by Mrs. Whitehead to recommend approval with the understanding that staff will consider additional options to enhance the outside area of the restroom building. REPORTS AND OPEN DISCUSSION: Updates regarding Ask Safety withdrawing their application, new construction for a hotel near Zachary's Restaurant and Golf and Gator Electric Go-Carts almost ready for completion. Atlantic Avenue (Parcel ID# 24-37-23-CG-51-1). Owner/Applicant: City of Cape Canaveral Submitting Department: Community Development (CD) Summary: This item is an application for a Level 2 Approval for the use of a Wall Mural at the City recreational complex at 7300 N. Atlantic Avenue (Attachment 1). The property consists of an administrative building, tennis/shuffle board courts and outdoor racquetball courts, which is the location of the proposed mural (Attachment 2). The proposed mural is the City's first commissioned mural, which commemorates the 50th anniversary of the Apollo 11 Moon landing. The project will serve as the capstone of the City's "Summer of Space" celebration and is part of the continued effort to enhance the cultural landscape through the City's Civic Scenery Program. As established in City Code Sec. 94-6, a mural must receive approval from the City Community Appearance Board (CAB). A Wall Mural is defined as a painting or artistic work composed of an arrangement of color and that displays a commercial or noncommercial message, relies solely on the side of a building for rigid structural support and is painted on the building. The term excludes a painting or work placed on a structure erected for the primary purpose of signage. As indicated above, a Wall Mural is allowed if approved by the CAB under the community appearance review standards set forth in Section 22-36 of the City Code. Note that these criteria are to evaluate both Level 1 and Level 2 applications; so not all may apply to the subject request. Criteria include: 1. The plans and specifications of the proposed project indicate that the setting, landscaping, ground cover, proportions, materials, colors, texture, scale, unity, balance, rhythm, contrast and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. 2. The plans for the proposed building or structure are in harmony with any future development which has been formally approved by the city within the surrounding area. 3. The plans for the proposed building or structure are not excessively similar or dissimilar to any other building or structure which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within 500 feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: a. Front or side elevations; b. Size and arrangement of elevation facing the street, including reverse arrangement; or c. Other significant features of design such as, but not limited to: materials, roof line and height or design elements. Community Appearance Board Meeting Date: 7/17/2019 Item No. Page 2of2 4. The plans for the proposed building or structure are in harmony with the established character of other buildings or structures in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. 5. The proposed development of the building or structure is consistent and compatible with the intent and purpose of this article, the Comprehensive Plan for Cape Canaveral, and other applicable federal, state or local laws. 6. Within the C-1, C-2, and M-1 zoning districts, any exterior building or roof color used shall be well designed and integrated with the architectural style of the building and surrounding landscaping in order to create a subtle and harmonious effect and promote aesthetic uniformity within the district. Bright or brilliant colors shall not be permitted except for use as an accent color within the C-1, C-2, or M-1 zoning district. The Wall Mural is proposed to be located on the north wall of the existing racquetball court, fronting Taylor Avenue. As indicated in Attachment 3, the mural includes a depiction of the artist's expression of the Apollo 11 lunar mission. Over the past several years, the CAB has approved a number of wall murals. Several have been associated with fraternal organizations to include the VFW and the American Legion. As the proposed mural does not constitute signage and is being forwarded for municipal purposes, Staff supports the request. Applicant/Owner: Bayswater Development Corp. Summary: This application is for a Level 1 Approval consistent with Sec. 22-44 of City Code for the development of a four (4)-unit townhouse project to include associated parking, stormwater and utilities located at 333 Magnolia Avenue (Attachment 2). The subject parcel is owned by Bayswater Development Corp., is approximately .29 acres in size and is zoned R-2. The proposed use is consistent and permitted in the R-2 zoning district. The Comprehensive Plan Future Land Use designation for the parcel is R-2. Zoning surrounding the parcel is R-2. Land use surrounding the parcel consists of single and multi-family structures, to include two-story structures to the immediate south and east. Adequate public utilities to meet the demands of the proposed improvements are located on/adjacent to the parcel. The submitted materials indicate that the proposed structures will be consistent with the surrounding development pattern. Proposed colors include: 1 — main structure khaki; 2 — trim — white; 3 — shutters — blue; and, roof—white/grey tile (Attachment 3). The proposed structure has a median height of 24.57 feet, which is under the allowed 25 feet. Proposed landscaping meets minimum requirements. Level 1 Request Sec. 22-42 (c) of the Code establishes certain criteria the Community Appearance Board (CAB) must consider when evaluating an application. In general, the criteria are to gauge whether a project is in harmony and consistent with the surrounding natural and built environment. Sec. 22-42 of the Code includes the specific standards that must be considered (Staff response indicated in bold/italics). They include: 1. The plans and specifications of the proposed project indicate that the setting, landscaping, ground cover, proportions, materials, colors, texture, scale, unity, balance, rhythm, contrast and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. Sec. 110-292 of City Code establishes principal uses within the R-2 residential district, to include multi-family structures. Maximum building height in the R-2 district is 25 feet. The proposed building has a median height of 24.57 feet. Immediately to the south of the subject parcel exists a two-story structure as well as to the east. As indicated in Attachment 3 to this report, the building includes design elements that provide unity and balance while proposing materials and colors found throughout the immediate area.
