MEETING MINUTES
May 9, 2019
A Meeting of the Planning & Zoning Board was held on May 9, 2019, at City Hall Council
Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Chairperson Pennie Zuercher called the
meeting to order at 6:03 p.m. The Secretary called the roll.

PUBLIC PARTICIPATION
Mark James spoke in regards to rezoning Oak Lane, thanked staff for addressing the issue, he
expressed concern about zoning of an undeveloped parcel of land at the west end of Oak Lane and
traffic concerns.
Alicia Spring had the same concerns.
Staff is aware and indicated that the City is working to address these concerns.
NEW BUSINESS:
1. Discussion Item—Nonconforming Commercial Rezoning Project—No Action Required
Staff presented report/photos to include zoning maps, discussed a neighborhood meeting which
took place in January, 2019, approximately 700 notices were mailed to affected property owners,
several property owner's that attended had concerns, issues were addressed, per City Code;
residential is not allowed in commercial zoning districts, if a property were destroyed by a natural
disaster, fire, etc., it may not be rebuilt, the discrepancies regrading commercial and residential
zoned properties, the possible logic behind the intent of the initial zoning, locations of the
properties affected and the next steps involved to correct the problem.
Discussion ensued to include the history regarding the decision to create a commercial corridor,
Special Exceptions for residential development, investment potential, at the time, for developers

legislation by Council which removed the Special Exception option, issues regarding insuring
affected properties and the role of the Department of Economic Opportunity (DEO).
Discussion continued regarding keeping the developed commercial properties exempt from the
rule, commending Staff on working to correct the problem, how this problem developed by
natural expansion, concern for the citizens affected and protecting the coastline from hi-rise
development.
REPORTS AND OPEN DISCUSSION:
Food vending trucks will be discussed by the City Council at its June 18, 2019 meeting.
