Constance McKone, Vice Chairperson, called the meeting to order at 7:30 P.M. Duree Alexander, Recording Secretary called the roll. MEMBERS PRESENT: Constance McKone Vice Chairperson Paula Collins Catherine Barnes Robert Laws MEMBERS ABSENT Earl McMillin Chairperson OTHERS PRESENT: Duree Alexander Recording Secretary Todd Peetz City Planner Kate Latorre Assistant City Attorney Bea McNeely Ex-Officio Member Leo Nicholas Council Member NEW BUSINESS All persons giving testimony were sworn in by Kate Latorre, Assistant City Attorney. 1. Motion to Approve the Meeting Minutes of March 13, 2006. Motion by Paula Collins, seconded by Robert Laws, to approve the minutes with the attachment of the suggested changes to clarify the minutes submitted by Earl McMillin. Vote on the motion carried unanimously. 2. Motion Re: Special Exception Request No. 06-02 to Allow Residential Use in the C-1 Zoning District, Section 23, Township 24 South, Range 37 East, Lots 4-8, Block 1, Avon by the Sea Subdivision - (Washington Avenue) - Ken Wilson, Designated Agent for L. Joyce Carlton, Petitioner. Ken Wilson, Designated Agent for the Petitioner, stated his name and address for the record. Constance McKone, Vice Chairperson, asked Mr. Wilson if the special exception request was for 110-334, and if a copy of the deed showing ownership had been provided. Mr. Wilson confirmed that the special exception request was for 110-334 and a copy of the deed was provided to the City. Board of Adjustment Meeting Minutes April 24, 2006 Page 2 Mr. Wilson testified that he is asking for the special exception from C-1 zoning to multi- family zoning for townhomes on Washington Avenue. The subject is completely surrounded by residential homes, mainly townhomes, with no adjacent commercially developed uses. The original drawings submitted reflected eight townhomes; however, the number was reduced to seven in order to comply with the City Code which allows a 185-ft.maximum length of structure. He stated that the townhomes will be individually owned; each unit will have a yard; and that a home owners association will be established. Catherine Barnes, Board Member, mentioned a letter from a citizen at 8401 N Atlantic Avenue, Atlantic Gardens, however the board members agreed that this area would not be greatly impacted by this development. There was a brief discussion regarding traffic impact. Mr. Peetz, City Planner, stated the traffic study will be required as part of the site plan. However, these units will generate between four and five peak hour trips. There are still over 200 peak hour trips available on North Atlantic Ave. after the construction of these townhomes. Motion by Robert Laws to approve Special Exception 06-02, seconded by Paula Collins. Constance Mckone, Vice Chairperson, questioned whether the motion should state the number of units approved. Kate Latorre, Assistant City Attorney, informed the board that the ordinance automatically limits the development to 15 units per acre. However, if the board wants to limit the number of units it must support that it is a reasonable condition to impose on the applicant in order to protect and benefit the community. If the Board feels the applicant has met all the requirements of the Ordinance then the Board must show why limiting the density at this point is necessary. Mr. Laws, Board Member, stated that the applicant volunteered to limit the number of units to seven. Kate Latorre, Assistant City Attorney, advised that the applicant's voluntary limit may be included in the motion. Mr. Laws amended his motion to read, that based on the applicant volunteering to limit the number of units to seven that it be made part of the requirement. Paula Collins seconded the motion. Mr. Wilson, applicant, addressed the board regarding being restricted to only seven units. He indicated that, based on the size of the site, ten units could be constructed. He requested the Board not limit the construction to seven units. 2 Z Board of Adjustment Meeting Minutes April 24, 2006 Page 3 Mr. Laws stated that he wanted the motion to stand as stated. Kate Latorre, Assistant City Attorney, advised that when an applicant comes before the Board, he has the burden of meeting the ordinance requirements for a special exception. If the Board is in agreement that the applicant has met all the conditions of the Ordinance, the burden then shifts to the Board to show why the special exception should be granted with conditions. There is Florida Case Law, which authorizes reasonable terms and conditions to be placed on the approval of a special exception, but such terms and conditions must be based on competent and substantial evidence. Mr. Wilson asked the Board to please consider allowing eight units. Mr. Laws stated that the applicant had volunteered the number of units to be constructed to seven and his motion stands as stated. Mrs. Mckone stated that the board is concerned about the impact that ten units would have on the area Additionally, she stated that the special exception would run with the land; if the property was sold the special exception would continue to be limited to seven units. Vote on the motion carried unanimously. OPEN DISCUSSION Todd Peetz, City Planner, provided a brief overview of the Coastal High Hazard Study. ''.11721-.:t,•;... - • 'i_.: ;._:_6'' '..::*.-' -. f" t pr; I I_ _ v 'kiF ,_.. , n ir}M >eg CITY OF CAPE CANAVERAL SPECIAL EXCEPTION WORKSHEET Outdoor Storage 06-03 The purpose of this worksheet are two-fold: (1) to assist the Planning and Zoning Board and the Board of Adjustment in the evaluation of all criteria relevant to the application; and (2) to educate the applicant as to the criteria which must be addressed and satisfied prior to beginning the special exception consideration process. If the applicant can not satisfactorily address one or more of the following, this should serve as a preliminary indication that the request for special exception may be rejected or that the application may not be acceptable for processing. CRITERIA (Building Official or Designee to Verify) 1) Does the Special Exception create any adverse impact to adjacent property through the creation of noise, light, vibration, traffic, utility requirements, or stormwater runoff that would not have been created had the property been developed as a principle use in the applicable zoning district. The applicant's request for a Special Exception to allow outside storage parking of boats, RV's and Trailers in a Light Manufacturing and Research & Development District (M-1) zoning district is consistent and compatible with the adjacent properties. There are currently Single Family and Multifamily Residential homes to the east of the subject property. However, the proposed concept plan appears to be sufficiently buffer the residential uses from the subject site. Buffering will be further evaluated during site plan review. In addition, the proposed special exception of outdoor storage of RVs, Boats and trailers would not appear to create additional noise, light, vibration, traffic, utility requirements, or stormwater runoff that would significantly adversely impact the adjacent residential homes. 2) Will the Special Exception create any unusual police, fire or emergency services? No unusual emergency services are needed. 3) Will the Special Exception meet all the requirements of the zoning district in which the request is to be located, such as: lot requirements, building setbacks requirements, lot coverage, height, buffers, off-street parking, signs, storage, landscaping,etc.? Should the Special Exception request be granted, the property owner is subject to Special Exception criteria listed in the Cape Canaveral Land Development Regulations. The subject property has the potential to meet these requirements. 4) Is there adequate ingress and egress,with particular reference to auto and pedestrian safety and convenience, traffic flow and control, and emergency access in case of fire or medical emergency? This application requests outdoor storage of RV's, boats and trailers in a Light Manufacturing and Research & Development District (M-1)) zoning district. The subject site will gain access to Imperial Boulevard. �� 5) Is there adequate off-street parking and loading areas available without creating undue noise, glare, odor or other detrimental effects upon adjoining property owners? Off street parking is proposed in the conceptual site plan. The applicant is proposing outdoor storage of RV's, boats and trailers. Therefore a substantial portion of the concept plan is a parking lot. 6) Is there adequate and properly located utilities available or may be reasonably provided to serve the proposed development (if applicable)? Adequate utilities are available to the subject site. 7) Is there adequate screening and/or buffering provided to protect and provide compatibility to adjoining properties? Applicant must meet the screening and buffering requirements of Chapter 102, City of Cape Canaveral Code of Ordinances. In addition, the applicant has submitted a conceptual site plan. The plan proposes a 15,000±square foot retention pond on the eastern portion of the property. The intended retention pond would create a large buffer between the proposed development and the residential uses adjacent to and east of the subject site. This will be further evaluated at during site plan review. 8) Are signs and exterior lighting, if any, designed and arranged so as to promote traffic safety and to eliminate or minimize any undue glare, incompatibility, and disharmony with adjoining properties? All lighting and traffic safety requirements must be meet according to City of Cape Canaveral Code of Ordinances. 9) Is there adequate refuse and service areas? There is adequate refuse capacity. 10)Do the setbacks, landscaping, and open space meet the requirements of the zoning district? The subject site must meet the setbacks, landscaping and open space requirements of the Cape Canaveral Land Development Code. 11)Is the proposed use compatible with surrounding uses in its function, its hours of operation, the type amount of traffic generated, structure size and setbacks, its relationship to land values and any other facts that may be used to measure or determine compatibility? The proposed use has the potential to be consistent and compatible with the surrounding uses. This can be achieved through adequate screening and buffering 2 between the subject site and the residential uses to the east. The applicant has submitted a conceptual site plan. John Johanson informed the Board that he had submitted a form 8B, Memorandum of Voting Conflict with the City Clerk regarding agenda item #4, recommendation to :City Council regarding request for extension of Beachside Townhomes. 2. Recommendation to the Board of Ad'ustment Re: Special Exception Resuest No. 06-03 to Allow Outside Stora.e in the M-1 Zonin. District Boulevard Section 15 Township 24S, Ranee 37E, Parcel 814 -Arthur Beryl er Designated Agent Todd Peetz, City Planner, gave an overview of the request. He testified that the applicant was requesting a Special Exception to allow outside storage of boats, RV's and trailers in the (M-1), Light Manufacturing and Research & Development District and that the use was consistent and compatible with the adjacent properties. He pointed out to the board on the concept drawing where the outside storage would be located and explained that there would be eleven RV parking spaces with thirty-two vehicle parking spaces; there is a proposed office building; proposed mini storage facility and another building, the use of which is to be determine at a later date. He stated that the board was only considering the request for the Special Exception. He outlined the current existing surrounding uses, and noted that the proposed concept plan appears to sufficiently buffer the residential uses from the subject site and that the buffering will be 1 Planning & Zoning Board Meeting Minutes April 26, 2006 Page 2 further evaluated during site plan review. In addition, the proposed Special Exception would not appear to create additional noise, light, vibration, traffic, utility requirements, or storm water runoff that would adversely impact the adjacent residential homes. Brief discussion followed regarding the location of the property and access to the property. Arthur Berger, Designated Agent, stated that a larger site plan is available with a tree overlay and numerous photos of the property. Chairperson McNeely questioned which document showed the storage. Mr. Berger explained that the conceptual drawing and the new site plan displayed the two-story, 30,000 square-foot office facility; the long slender building was the two-story mini storage building and identified where the outside storage would be located. The board members informed the applicant that the official record must be accurately marked showing the outside storage. Todd Peetz, City Planner informed the board that with the inclusion of the future building facilities, the total number of vehicle parking spaces would be increased to fifty-two spaces arid eleven RV parking spaces. The board members agreed that this should be reflected on future plans. Chairperson McNeely expressed concerns regarding outside storage and requested a specific list of the items that would be stored on the property. She suggested the following conditions: 1. Parking spaces shall be clearly marked, 2. Outside storage shall be limited to licensed vehicles only, (i.e. RV's, boats, camper, trailers) 3. No maintenance of the vehicles shall be allowed on property, and 4. All requirements of the zoning district shall be met and shown on the site plan �-- Mr-. Berger stated that-the-building will have 24-hour security and storage will be restricted to licensed vehicles; there will be no storage of construction debris, miscellaneous items, or other materials. A discussion was held regarding screening of the outside storage. The applicant informed the board that there would be a chain link fence with a vegetative buffer. The board members stated concerns regarding the application, which seemed to address requests with existing structures located on the property and this particular request was for vacant property. The board reviewed each item on the application with the applicant. The board members stated concerns regarding item #2 on the application which referred to numerous small tanks of propane being stored on the property. Chairperson McNeely stated that the fire department had addressed this issue in a staff memo provided and indicated that there were no comments at this time. Vice Chairperson Russell stated that this issue should be re-directed back to the fire department with the board's concerns 2 �� manning & Zoning Board Meeting Minutes April 26, 2006 Page 2 regarding the storage of hazardous materials. Motion by John Fredrickson, seconded by Donald Dunn to recommend approval of the Special Exception request with the following conditions: 1. Parking spaces shall be clearly marked, 2. Recommendation to the City Council Re: Site Plan Approval for the City Maintenance Building, 601 Thurm Boulevard - Ed Gardulski, Public Works Director. Todd Peetz, City Planner, gave an overview of the request. He advised that this request was for two maintenance buildings, which will be replacing five storage sheds at the Public Works facility. The sheds being removed total ap The new buildings will total 11,000 square feet of storage area.teThe buly ildingsre wileetbe constructed in two phases. Phase I proposes to construct a 9,600 square foot maintenance building. Phase II proposes to construct a 1,500 square foot maintenance building. The purpose of the maintenance buildings is for storage. The proposed development will enhance the Public Works facility and will have no significant negative impact on public services. Ed Gardulski, Public Works Director, testified that this is a project they have been working on for a number of years. There are numerous items that are presently being stored outside, which need to be placed in an enclosed storage building. He stated that the structures would meet all City codes on placement and wind load requirements. _ He invited the board members to the Public-Works open house, which will be held the third week of May. Chairperson McNeely questioned whether the buildings would be located in the storm water drainage area. Mr. Gardulski responded that the water is routed through a storm water treatment device which cleans up the water before it reaches the pond. This is part of a pilot program which, with sufficient rain fall, some of the storm water is diverted through the treatment facility to generate more re-use water.
