MEETING MINUTES
August 30, 2018
A Meeting of the Board of Adjustment was held on August 30, 2018, at City Hall Council
Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Joseph Tichich called the meeting to order
at 6:00 p.m. The Secretary called the roll.

Discussion ensued to appoint a Chairperson for the meeting.
Motion by Mr. Wassell to appoint Mr. Tichich, seconded by Mr. Raymond. Vote on the motion
carried unanimously.
PUBLIC PARTICIPATION:
A question was presented regarding any new projects or redevelopment at Palms East Apartments.
Staff stated there has not been anything presented to the City at the present time.
NEW BUSINESS:
1. Approval of Meeting Minutes—March 2. 2017
Motion by Mr. Raymond, seconded by Mr. Wassell to approve the meeting minutes of March 2,
2017. Vote on the motion carried unanimously.
2. Per Section 2-171,Board of Adjustment shall elect a Chairperson and Vice Chairperson,
by majority vote, at the first meeting held in January, unless there is no January
1 meeting,then the next meeting held.

Motion by Mr. Wassell, seconded by Mr. Raymond to elect Joseph Tichich as Chairperson. Mr.
Tichich accepted the nomination. Vote on the motion carried unanimously.
Motion by Mr. Raymond to elect Joseph Elliott as Vice Chairperson. Mr. Elliott accepted the
nomination. Vote on the motion carried unanimously.
3. Quasi-Judicial and/or Public Hearing: Motion Re: Variance Request No. 18 - 01
Parcel ID#243723-CG-4-3 — Rick Parker — Applicant, has requested a Variance
approval to allow for a side yard setback in the R-2 zoning district from the
required 8 feet to 7 feet 3 inches as established in Section 110-297(a), City Code.
Mr. Dickey presented Staff's report/photos. Staff indicated the survey showed an encroachment
into the setback. The Code requires a setback of 8 feet from the property line,but this building is
7' 3" feet from the property line, causing a 9 inch encroachment into the setback. The existing
structure was built in 1960, prior to the incorporation of the City, so does not meet the required
side yard setback or minimum square footage.
City Attorney Garganese swore in members of the audience who wished to speak.
Rick Parker, Applicant, explained that he and his wife want to build a house to improve the
neighborhood most surrounding properties do not meet the setback requirements and they want to
make their home in Cape Canaveral.
Discussion ensued between Board Members and Applicant to include photos the Mr. Parker had
taken of his property as well as adjoining properties, demolition, plans to live in the home,
extending the house into the rear yard, maintaining the footprint of the home in front and side-
yard, plans to start the renovation process, possible issues with water runoff and getting the City
Engineer involved with drainage concerns.
Delores Ellis, resident at 405 Washington Avenue spoke in opposition to the project.
City Attorney Garganese spoke in regards to abstaining from voting.
Motion by Mr. Elliott to grant the request for Variance 2016-02, seconded by Mr. Raymond. Vote
on the motion carried unanimously.

Motion by Mr. Tichich, seconded by Mr. Raymond to adjourn the meeting at 6:47 p.m. Vote on
the motion carried unanimously.
