Via Email and Certified Mail, Return Receipt Requested All In One Pools ___________________ Dear __________________: This letter advises you that corrective action is immediately required to closeout and receive final inspection of an outstanding building pool permit issued to All In One Pools (“Contractor”) by the City on May 26, 2016 at 131 Oak Lane. During construction, the Contractor engaged unauthorized alteration of the on-site stormwater drainage system that was approved by the City in conjunction with the construction of several homes on the south side of Oak Lane including the subject property. The unauthorized alteration was inspected and documented by the City Engineer in the attached June 22, 2018 memorandum. The City has previously demanded that this situation be remedied, however, the violation continues and the permit remains open and outstanding. You are hereby advised that until the stormwater system is repaired and made fully functional in accordance with the City Engineer’s comments, the pool will not receive final inspection approval by the City. In addition, unless corrective action is immediately taken to repair the stormwater system, the City may take legal action lawful against the Contractor and the Property Owner, Sheropa LLC, to remedy the violation including, but not limited, filing a code enforcement action against the Contractor and Property Owner. Please immediately contact _____________________ at 321-868-_____ for more information and instructions required to remedy the violation and eventually receive final closeout of the pool permit. Garganese <agarganese@orlandolaw.net <mailto:agarganese@orlandolaw.net> > Subject: [EXTERNAL] 131 Oak Lane Anthony – per our conversation. On May 26, 2016, the City of Cape Canaveral issued a building permit to All In One Pools for the construction of a pool at 131 Oak Lane. To date, this permit has not received final approval. This is in large part because the pool contractor, as part of the pool construction, altered the approved on-site stormwater drainage system for the property. This has been confirmed by the City Engineer as part of a site inspection conducted on June 22, 2018 (see attached). The City has demanded that this situation be remedied, however, the violation continues. Be advised that until the stormwater system is repaired in accordance with the City Engineer’s comments, the building permit associated with the pool will not be finalized. Please let me know if you have any questions.
