I am Bernie Lennon, 126 Oak Lane Cape Canaveral. I talked with Alicia
Spring (120 & 122) Oak Lane yesterday about the Sheropa development at
127, 131, 135, and 139 Oak Lane. Alicia said you informed her about 2
competing surveys for the Sheropa development. You may remember when I
talked to you before construction started on 127 and 131 Oak Lane that
135 and 139 Oak were located in the setbacks and I had told the Cape
Canaveral Building department and the developers about the error before
any construction began. Your response was you could do nothing because
135 and 139 had a certificate of occupancy before you started working at
Cape Canaveral building department but you would make sure 127 and 131
Oak Lane would be located correctly.
The Sheropa development survey is not in competition with any local
survey. Tim, at 123 Oak Lane who paid to resurvey the Sheropa
development, has determined that all local surveys are in agreement
except the Sheropa development. 120, 122, 123, 124, 126 Oak Lane, the
Sea Spray Townhomes and Ocean Gardens are all in agreement.
The Sheropa developer and the City of Cape Canaveral were informed
about the error before any construction began. They decided to start
construction without getting a second independent survey.
Once the construction started, Harrack Trucking and Clearing started
clearing for 135 & 139 Oak Lane. The next day I found 5 car tires on my
property. I threw them back onto the cleared lots expecting to never see
them again. Then about 200 loads of fill dirt arrived. One of the dump
trucks broke down in front of my property and was in various stages of
repairs for over a week, leaving behind broken parts and possible used
oil. The developer then placed a dumpster and porta toilet in front of
my property, and any wind would blow the trash in my yard. I could then
determine what tradesmen were at work by the debris in my yard;
wheelbarrows of sand, broken cement block, large rocks, insulation,
driveway pavers. One Friday evening I noticed a landscaper walk to the
Circle K and came back with an 18 pack of Corona beer. The next morning,
I had to pick up 18 Corona bottles. Harrack Trucking and Clearing
returned for final landscaping so did the 5 car tires. They also ripped
out two 35-foot-tall palm trees by the roots and hid then in my yard
along with two loads of yard debris. It took 2 weeks to get it removed.
At some point I started complaining to the developer about all the work
it was keeping things clean, but I was not met with cooperation. I then
started complaining to Duree Alexander in the code enforcement
department on a regular basis without much success. Harrack Trucking
loaded a bulldozer in front of 123 Oak Lane about 6 months ago and
crushed a cement water meter cover and put large gouges in the yard.
Duree asked me to email her pictures of the damage. After reviewing the
pictures, she assured me it would be fixed. Last week they picked up the
dumpster at 127 Oak Lane and gouged out 15 feet of asphalt 3 inches wide
by 3 inches deep.
All work at Sheropa development should conform to all building codes.
And any of the local neighbors who have spent money or performed work to
rectify the problems should be reimbursed or compensated for any work.
Thank You
Bernie Lennon
Bernie,
2/16/2016
I have contacted the City of Cocoa Water Department today, and they
will send a representative out within the week to inspect the damaged
water meter cover at 123 Oak Lane.
Duree Alexander
Mr. German,
2/18/2016
Last year when 135 and 139 Oak Lane were in this phase of construction
(installing the doors, windows, insulation, drywall, painting) the door
knobs don’t get installed until last. The doors banging all night make
it difficult to sleep so I suggested to the developers it may be in both
of our interest to put door knobs on because of possible damage to the
buildings. Nothing happened until I informed them 3 weeks later that a
homeless person had moved in. No homeless person this time. The wind
storm 3 weeks ago made 120 & 121 Oak Lane look like hurricane Andrew had
gone through because of fiberglass insulation covering the entire
property. I have to park my car in the back of the house to avoid it
getting paint spray when the painters open the water main shooting water
40 feet into the air to clean their paint rollers. The lowest area in
the city of cape Canaveral is the end of Oak Lane. The 2009 storm left
about 6 inches of standing in that area that’s approximately the level
of one of the homes.
Thank you

We have been discussing the surveying error for over a year now but
construction continues. Last week FPL placed a marker at the end of my
driveway to place a phone pole that I believe is also located with a
faulty survey. Can you explain how all of the problems will be fixed?

Hi Bernie. As we have discussed on numerous occasions, the City relied
on a signed/sealed survey from a licensed surveyor to issue the building
permit for the property in question on Oak Lane. When your concern came
to our attention we requested supporting documentation, which was
subsequently provided.
My understanding is that the two surveyors are working through the
discrepancy in the surveys and once they reach consensus will submit
their findings. Please note that a Certificate of Occupancy will not be
issued until this issue is resolved.
I don't want to conjecture what the findings will be or what may occur
thereafter. However, I will reiterate that this more than likely will
be a civil matter between private parties.
David Dickey
Mr. Dickey
2/26/2016
The property owners of 120, 122, 123 and 126 Oak Lane have been
complaining to the code enforcement and the building department about
the Sheropa development since before construction began. It started with
survey markers that were not in the correct location followed by a year
and a half of complaints of unsupervised construction. The complaints
included damage to city property, damage to the environment,
construction debris scattered through the entire area, entire days of
loud yelling and cursing, drunk landscapers, parking in the middle of
the street, disabled excavator dump truck and many more issues. It was
also brought to the attention of the building department early on about
the homes not meeting the minimum elevation requirement. 139 Oak Lane is
most likely not even 2 feet above sea level let alone the crown of the
road.
Most of the complaints were ignored the rest “there is nothing we can
do about it”. Then the retaliation by the city, using bulldozers they
pushed debris onto my property (126 Oak Lane) that was 15 feet tall 60
feet long and 20 feet wide. It took 6 tractor trailers to remove the
debris.
Your suggestion is for private parties to battle in court. This is
permanent damage that cannot be repaired. Construction continues so
future power poles, water meters, driveways, sidewalks and landscaping
will not be located correctly.
The City of Cape Canaveral was founded in 1963 to eliminate this type
of anarchy. We are now left in a situation where nobody can win except
the lawyers.

Can you direct me to the rules being used for this surveying dispute?
Since this dispute involves other property owners and myself, I would
like to know why we have been excluded? Also will this dispute be open
to the public to make sure no back room deals are being made? What are
the time frames? If any of the owners disagree with the results how
could they appeal before Certificate of Occupancy?
Thank you

Mayor Hoog,
3/3/2016
The City of Cape Canaveral has been remapping Oak Lane with Sheropa
LLC. My requests to be included in this remapping have been ignored.
Also, the City of Cape Canaveral used a bulldozer to push debris on to
my property at 126 Oak Lane. My attempts to find who ordered this and
why have been ignored. Could you please help me get to the bottom of
this?
Thank you
Bernie Lennon
126 Oak Lane
3/3/2016
Good afternoon Bernie. I can assure you that the City has/is not taking
any action that will “remap” Oak Lane. As this is a public right-of-way,
any closing/reconfiguration would require the passage (by the City
Council at a publically-noticed meeting) of a resolution.
As you and I have previously discussed, when the City issued a building
permit for the construction of a house at 128 Oak Lane, it relied upon a
survey from Walker Surveying, a licensed surveyor in the state of
Florida, which indicated property lines, setbacks, the location of
improvements, etc. Subsequent to this, there were suggestions by
adjacent property owners that the submitted survey was incorrect. The
City requested documentation in support of this claim. A second survey
was completed by Riehl Reliable Surveying and Mapping that showed a
conflict. The City asked that the two surveyors get together and
determine the nature and scope of the conflict. To date, we have not
seen anything in response to this request. In my email to you on
February 23rd, I explained the situation and assured you that a
Certificate of Occupancy would not be issued until this issue was
resolved.
To resolve this issue in a timely manner, the City will engage a
surveying company which is on our continuing contract list to review the
two surveys and determine what, if any, discrepancies exist. The cost
to perform this review will be equally shared between the City, the
developer and the two property owners. The City Attorney’s Office is
drafting an agreement that all of the parties will sign that stipulates
their financial participation as well as its commitment to abide by the
results of the review.
Regarding the debris, the City does not own a bulldozer and its
employees have not been involved in any debris removal in the recent
past on Oak Lane. I will inquire with the developer to determine if they
were involved with this activity.
I hope this answers all of your questions. Dave
Mr. Dickey
3/4/2016
I am surprised that neither Duree Alexander or Michael German filled
you in on the City of Cape Canaveral bulldozing 6 tractor trailer loads
of debris onto my property because they are the ones who told me the
city did it. It was moved after I complained, but I couldn’t believe the
city had done this after I had been talking to Duree about having this
same kind of issue with the developer.
One of the few times that Duree Alexander from code enforcement came to
investigate my complaint of 2 wheelbarrows of paver that were dumped
onto my property, she was displeased because I could not prove that the
Sheropa development had dumped the pavers (that matched those being used
across the road). I thought to myself it would not take the number one
CSI team in the country to prove they actually had dumped the pavers,
but my response to Duree was I am not trying to prove anything, just
trying to get them to stop it. So a few weeks later when Harrack
Trucking and clearing loaded a very large machine onto a tractor
trailer, I watched him crush the utilities and gouge out the vegetation.
I immediately took pictures and showed them to Duree. This time I had
proof, so surely things would get better, I thought. Now 6 months later
the soil washes down the street every time it rains and the utilities
have not been repaired.
Mr. Dickey all of these questions have gone unanswered. Sheropa
development seems exempt from all rules and this is impacting my own
property. I am unclear about the review you are suggesting will happen.
I hope you are not expecting that I or any of the neighboring property
owners be held financially or otherwise responsible for this mess.
Additionally, since this impacts my property—the entire acre opposite
these houses—I want to know the outcome and any recourse for appeal
BEFORE these homes receive a certificate of occupancy. I raised the
issue of the survey in the past when the first two homes were built and
the city’s response was, “It’s too late since we’ve already issued
certificates of occupancy, but we won’t let this happen with the next
two houses.” Of course, the city did nothing to follow up which is why
we’re having this problem now.
My specific questions are then:
Why has the city allowed this developer to go unchecked in causing
concerns to neighbors on Oak Lane, and even participated in the issue
(dumping truckloads of debris on my property)?
Why was the survey not reviewed earlier in the process when the city
was told there was a problem?
Will I be held financially responsible in any way for the review of the
survey (your e-mail was unclear about who those two property owners are
who are to bear part of the responsibility)?
Will I be informed of the outcome of this survey dispute and have a
chance to have input or appeal?
Thank you
Bernie Lennon

Mayor Hoog,
3/10/2016
For a year and a half now myself and most of my neighbors have been in
a constant struggle with the City of Cape Canaveral and the Sheropa
development on Oak Lane. So I have spent the last few days researching
what went wrong and this is what I have uncovered.
The owner of Sheropa LLC. Is a former Mayor of Cape Canaveral and you
were his Vice Mayor. During this time the Mayor was convicted of
conspiracy to defraud the U.S. Customs Service and making false
statements and was sentenced to 5 years, 11 months in federal prison.
I have been excluded from backroom deals between Sheropa LLC. and the
City of Cape Canaveral. The backroom deals have come up with some
bizarre results “The City Attorney’s Office is drafting an agreement
that all of the parties will sign that stipulates their financial
participation as well as its commitment to abide by the results of the
review.”.
Construction on Oak Lane has accelerated to around the clock 7 days a
week to rush Certificate of occupancy for the last two homes hoping we
would then have no recourse, the same as you did with the first two
homes.
3/16/2016
Hi Bernie. I didn’t see a specific question in your email of March
10th, but let me reiterate several points I have previously made.
* When the City issued a building permit on October 6, 2015 for
the construction of a house at 127 Oak Lane, it relied upon a survey
from Walker Surveying, a licensed surveyor in the state of Florida,
which indicated compliance with City Code requirements, including
property lines, setbacks, the location of improvements, etc. Subsequent
to this, there were suggestions by adjacent property owners that the
submitted survey was incorrect. The City requested documentation in
support of this claim. A second survey was submitted to the City by the
resident of 123 Oak Lane on or around January 15, 2016. This survey was
conducted by Riehl Reliable Surveying and Mapping and it did show a
conflict with the Walker survey. The City asked that the two surveyors
get together and determine the nature and scope of the conflict. To
date, we have not seen anything in response to this request. In my email
to you on February 23rd, I explained the situation and assured you that
a Certificate of Occupancy would not be issued until this issue was
resolved.
* I am not aware of any “backroom deals” with Sheropa, LLC or any
other party regarding this matter. The City’s records related to this
item are available for anyone to review, make copies, etc.
* To bring this issue to closure, the City is proposing to have a
third-party surveyor review the two surveys and determine what, if any,
conflicts exist. I have asked the City Attorney’s Office to prepare an
agreement that each of the affected parties will sign that stipulates
their financial participation as well as its commitment to abide by the
results of the review. The parties to the agreement will be the City,
the builder (Turnkey Construction) and the parties that own/reside 123 &
127 Oak Lane.
* In your March 4th email, you ask whether you will be informed of
the outcome of this survey dispute and have a chance to have input or
appeal. The affected parties will be notified of the results of the
review.
* I want to clarify a statement I made in my email of March 2,
2016 to you where I indicated the City was not involved with any debris
removal impacting your property. That is incorrect. I have been
informed that a debris pile was placed there as a result of a contractor
performing maintenance on a City drainage canal. Once City staff was
made aware of the oversight, the pile was immediately removed. Regarding
your assertion that the City has allowed the developer to go unchecked,
the record does not support that. When a complaint has been lodged,
Code Enforcement Staff has investigated and taken appropriate action.
For example when it was reported that a dumpster was improperly located
on your property, Staff contacted the developer and had it removed.
When you informed Code Enforcement Staff about a portable toilet
improperly placed on your property, it was removed.
To assist me in moving this issue forward, I need to fully understand
how the disputed survey impacts your property. Thank you.
Dave
Mayor Hoog
3/17/2016
Is it true that the City of Cape Canaveral knew many months ago that
Walker survey and Riehl Reliable Surveying have not been on talking
terms? Is it also true that the City of Cape Canaveral knew a long time
ago that Walker survey admitted his survey is incorrect and Riehl
Reliable Surveying is correct? Is it true that David Dickey knows this
and is pretending he doesn’t know so that Sheropa LLC can accelerate
construction and get a certificate of occupancy before anything can be
done? Is it true that the owner of Sheropa LLC is a former Mayor of the
City of Cape Canaveral and you were his Vice Mayor? Is it true that the
36 complaints I made to the City of Cape Canaveral involving Sheropa LLC
and numerous complaints from the other owners on Oak Lane the only
results were the City requested Sheropa LLC to remove the dumpster and
porta toilet they put on my property and to install door knobs so the
neighbors could sleep? It took over a year and 7 complaints to get the
door knobs installed and only after I told then how my developer built
my house without a single complaint from neighbors. David Dickey uses
this as proof that Sheropa LLC and the former Mayor is not receiving
special treatment.
When my house was built in 2009 I was required to build it 3.14 feet
above the crown of the road measured from the center of the home. My
surveyor insisted the law was only 2 feet but Dennis Clements demanded
higher because any future resurfacing would increase that number. Why
was Sheropa LLC exempt from that requirement? I was required to pay
$1789 For underground power. Why was Sheropa LLC exempt from that
requirement? David Dickey makes no mention of all the complaints made
against Sheropa LLC that were ignored, like dumping oil on my property
from 2 different lengthy repairs of heavy equipment.
Mayor Hoog, who ordered 6 tractor trailers loads of debris bulldozed
onto my property in the exact location that I had numerous complaints
against Sheropa LLC for dumping? This is also the location that Harrack
Trucking and Clearing was dumping oil from his heavy equipment. Most
important why was this ordered? I believe it was retaliation for my
complaints of dumping.
It is 12 noon Thursday 3/17/2016 Oak lane is currently blocked with
heavy equipment installing driveways at the Sheropa LLC development. WE
now all know the driveways will be located more than 10 feet
incorrectly. Will the taxpayers be responsible for relocating them
correctly? Will the taxpayers be responsible for relocating all of the
utilities (water, sewer, power)? Will the taxpayers be responsible for
repairing all the damage Sheropa LLC created?
Mayor Hoog, could you please answer these questions BEFORE issuing a
certificate of occupancy to 127 and 131 Oak Lane because that has been
used as an excuse for no recourse on 135 and 139 Oak Lane.

Mayor Hoog,
3/18/2016
I would like to recap your unannounced visit to my home today 3/18/2016
1:15 pm. Your aggressive stance was an obvious attempt to intimidate me
and my out of town guests. I was stunned by the story of your father
building some of the first mobile home parks in Cape Canaveral without a
survey and therefore, you said, you believe surveys are not worth a
damn. It appears you are in support of Sheropa LLC building these homes
on an incorrect survey, even if they stretch into the neighbor’s
easement by several feet and are also several feet too close to the
road. You also said the large tire ruts, scraped out vegetation and
construction debris in front of my home was a normal process of
construction and for me to get over it. At that point I determined you
to be irrational and terminated our discussion, then walked back to my
house.

Yesterday when you and I were in front of my house inspecting the
damage from Sheropa LLC, we could hardly talk because of the loud roar
of two gas powered saws cutting paver bricks that had us covered in a
thick fog of cement dust. That’s when I told you that my house was built
without a single complaint from the neighbors. You barked out an angry
response “that’s because there were no neighbors back then.”
After I spent the whole morning cleaning cement dust from inside my
house I researched Brevard County Property appraiser’s website. In 2009,
my home had 15 neighbors within 300 feet. In 2015, Sheropa LLC only had
9 neighbors within 300 feet.
So I thought to myself why were there no complaints when my house was
built and almost everyone is complaining about Sheropa LLC? Are we too
picky now as you suggest? NO. The answer is my contractor was very
courteous and careful in his work. For instance, he used wet saws that
are much quieter and make no dust. So the local neighbors did not
complain because they could hardly hear the saws and did not need to
clean their homes the next day.

After consultation with the City Attorney's office, we have determined
that the City has the obligation and the right to rely on the survey
submitted by the applicant as part of the building permit application
for 127 Oak Lane <x-apple-data-detectors://0> . The applicant submitted
an original signed and sealed survey from a registered surveyor. The
application also included a warranty deed with a legal description
consistent with the survey. At this time, the City considers this matter
closed. Thank you. Dave

I reviewed the plans submitted to the Cape Canaveral building
department by the Sheropa LLC. developer. The plans that I reviewed did
not include digging up Oak Lane and installing driveways in the middle

hearings. Mr Dickey you may want to consider reopening this issue.

The City of Cape Canaveral required 123 Oak Lane to pay for a survey.
Riehl Reliable Surveying and Mapping, a licensed surveyor in the state
of Florida submitted a signed/sealed survey to the City of Cape
Canaveral. You decided to ignore that survey. That has allowed Sheropa
LLC. to take 9 feet of property from 123 Oak Lane. This has made 123
useless because it no longer meets the minimum requirement for the City
of Cape Canaveral’s R1 zoning.
On Friday 3/18/2016 Sheropa LLC. removed several feet of asphalt in two
locations from Oak Lane and installed paver brick driveways extending
into the road.
On Monday morning 3/21/2016 I reminded you that Oak Lane is a public
right-of-way, any closing/reconfiguration would require the passage by
the City Council at a publically-noticed meeting.
By Monday night 3/21/2016 Sheropa LLC. removed the paver bricks from
the road and the asphalt they had removed had been replaced with
compacted dirt to make it look like they had not tampered with the road.
I have brought many issues about the Sheropa LLC. development to your
attention and you have decided to ignore most of them. This will not
make them go away in fact it will make it worse. The 4 homes that
Sheropa LLC. have built are being sold to family’s who are unaware of
the issues.
Mayor Hoog, Oak Lane needs to be repaired to its original condition,
123 Oak Lane needs to be returned to its proper owner and every single
issue that has been brought to your attention needs to be addressed to
the letter of the law.

On Monday March 21 2016 you gave Sheropa LLC developer more than 10
feet of Oak Lane for all 4 of its properties. Prior to that 127, 131,
135 Oak Lane had previously been mapped as 50 feet wide. 139 Oak Lane
was mapped as 66 feet wide.
This leaves you with only 3 choices:
1) You remap Oak Lane from 50 feet to 39 feet?
2) You take more than 10 feet from my property (126 Oak Lane) and
120, 122 Oak Lane?
3) Sheropa LLC returns that property to Oak Lane?
Mayor Hoog a timely answer to this question would be greatly
appreciated.

"Under Florida Law, email addresses are Public Records. If you do not

from 2 different lengthy repairs of heavy equipment.

In the last half hour the Sheropa LLC has put large tire tracks and
scraped out the vegetation in front of my house leaving behind more
trash. They also just dugout the asphalt on Oak Lane to place the drives
way into the middle of the road.

Mayor Hoog,

At this time, the City considers this matter
closed. Thank you. Dave

I reviewed the plans submitted to the Cape Canaveral building
department by the Sheropa LLC. developer. The plans that I reviewed did
not include digging up Oak Lane and installing driveways in the middle
of the road. You yourself informed me that would require public
hearings. Mr Dickey you may want to consider reopening this issue.

It’s just so sad that you would use your power to take away from a
family who has the least in our community and give it to your friend who
has more than all of us combined.

Thank you

Since Sheropa LLC has taken away more than 10 feet of Oak Lane last
Friday two-way traffic is impossible without driving on my property. Oak
Lane needs to be restored to its original condition as soon as possible.
Can You please give me a time frame when this will be completed?
Thank you

Since Sheropa LLC. has taken more than 10 feet away from Oak Lane, the
garbage truck had to drive off the road and come within inches of making
contact with the high voltage power lines. The next time they may not be
so lucky.

Good morning. Based on your report, the City’s Building Official and I
went to Oak Lane to inspect to conditions related to the power
poles/lines. We did not witness the conditions you describe. The
alignment of Oak Lane has not changed as a result of the construction
activity. Further, the new poles that have been erected due to the
construction do not pose any danger to vehicle traffic. Thank you. Dave
You need to look at the other side of the road.

Thank you

I have a video of a Sheropa LLC truck parked on my property that is
within 4 inches of contacting the power lines. This truck is much
smaller than the garbage truck or it would have made contact. Public
safety requires immediate action.
