installation has commenced prior to the issuance of a permit and that all work will be performed to meet the standards of all
laws regulating construction in this jurisdiction. The Building Code in effect at the time of this application is the Florida
Building Code 5th Edition. I understand that all permits require inspections as indicated and that it is the responsibility of
the permit holder to notify the building department when ready for inspection(s). This permit application is valid for 180
days from date of submission. By signing, applicant affirms that all above is true and correct and that he/she is an

CYPRESS SHAREHOLDERS LLC
This Limited Liability Company Agreement is entered into as of the 8th day of July, 2013
by Terri L. Bowman, an adult individual (the "Member"), as the sole member of Cypress
Shareholders LLC (the "Company"). The Member desires to form a limited liability company
pursuant to the Act upon the following terms and conditions:
ARTICLE I
Name and Place of Business
The name of the Company is Cypress Shareholders LLC. Its registered office is located
at 16192 Coastal Highway, Lewes Delaware 19958 and its registered agent at such address is
Harvard Business Services, Inc. Its principal place of business is 304 Brockton Road,
Wilmington, Delaware 19803 or such other place or places as the Member may hereafter
determine.
ARTICLE II
$usiness, Purpose, and Term of Company
Section 2.1 Purposes. The purpose of the Company shall be to do all such things for
which limited liability companies may be formed under the Act.
Section 2.2 Term of Company. The term of the Company shall commence on the date
the Certificate of Formation is filed with the Delaware Secretary of State in accordance with the
provisions of the Act and shall continue on a perpetual basis unless dissolved pursuant to Article
VI of this Agreement. Terri L. Bowman is hereby designated as an "Authorized Person" for the
purpose of executing the Certificate of Formation and arranging for its filing.
Section 2.3. Powers of the Company
(i) In addition to the purpose set forth in Section 2.1 above, the Company
shall have the power
(a) to conduct its business, carry on its operations and have and exercise
the powers granted to a limited liability company by the Act in any state, territory, district or
possession of the United States, or in any foreign country that may be necessary, convenient or
incidental to the accomplishment of the purpose of the Company;
(b) to acquire, by purchase, mortgage, lease, contribution of property or
otherwise, and to own, hold, operate, maintain, finance, improve, lease, sell, convey, mortgage,

transfer or dispose of any real or personal property that may be necessary, convenient or
incidental to the accomplishment of the purpose of the Company;
(c) to enter into, perform and carry out contracts of any kind, including,
without limitation, contracts with the Member or any person or other entity that directly or
indirectly controls, is controlled by, or is under common control with the Member, or any agent
of the Company necessary to, in connection with, convenient to, or incidental to, the
accomplishment of the purpose of the Company.
(d) to lend or borrow money and to invest its funds;
(e) to sue and be sued;
(f) to appoint employees and fix their compensation;
(g) to indemnify any person; and
(h) to guarantee obligations of an affiliate or subsidiary.
ARTICLE III
capital Contributions
Section 3.1 Capital Contribution by Members. Upon the formation of the Company,
the Member shall not be required to make a Capital Contribution. Capital Contributions shall be
made from time to time as the Member shall determine.
Section 3.2 Capital Accounts. A Capital Account shall be maintained for the Member
to which shall be credited (i) the Member's Capital Contributions, if any and (ii) all Company
revenues. The Capital Account shall be debited with (i) all costs, expenses, and losses of the
Company and (ii) the amount of any distributions (including return of capital) made to the
Member. No interest shall be paid on the Member's Capital Account.
ARTICLE IV
Allocation of Profits and Distributions
Section 4.1 Allocation of Profits and Losses. All profits and losses of the Company
shall be allocated to the Member.
Section 4.2 Allocation of Distributions. All distributions of cash or other assets of the
Company shall be made to the Member when and as determined by the Member.

ARTICLE V
Management of the Company
Section 5.1 General. The Member shall be the Managing Member and shall be
responsible for the management of the Company. The Managing Member shall have the right,
power and authority to manage, direct and control all of the business and affairs of the Company,
to transact business on behalf of the Company, to sign for the Company or on behalf of the
Company or otherwise to bind the Company.
Section 5.2 Delegation of Powers of Managing Member. The Managing Member shall
have full, exclusive, and complete discretion, power, and authority, subject in all cases to the
other provisions of this Agreement and the requirements of applicable law, to delegate the
management, control, administration, and operation of the business and affairs of the Company
or the custody of the Company's assets for all purposes stated in this Agreement. Such
delegation shall be as provided in such documentation as the Managing Member shall determine.
Any such delegation shall not cause the Managing Member to cease to be the Managing
Member.
Section 5.3 Officers. The Managing Member may appoint individuals with or without
such titles as it may elect, including the titles of President, Vice President, Treasurer, and
Secretary, to act on behalf of the Company with such power and authority as the Managing
Member may delegate in writing to any such persons.
Section 5.4 Powers of Managing Member. The Managing Member shall have the
right, power and authority, in the management of the business and affairs of the Company, to do
or cause to be done any and all acts deemed by the Managing Member to be necessary or
appropriate to effectuate the business, purposes and objectives of the Company at the expense of
the Company, including but not limited to the execution of all documents or instruments in all
matters necessary, desirable, convenient or incidental to the purpose of the Company or the
making of investments of Company funds.
Section 5.5 Reliance by Third Parties. Any person or entity dealing with the Company
may rely on a certificate signed by the Managing Member as to:
(i) the identity of the Managing Member;
(ii) the existence or non-existence of any fact or facts which constitute a
condition precedent to acts by the Managing Member or are in any matter germane to the affairs
of the Company;
(iii) the persons who or entities which are authorized to execute and deliver
any instrument or document of or on behalf of the Company; or
(iv) any act or failure to act by the Company or as to any other matter
whatsoever involving the Company.

Section 5.6 Actions Requiring Member Approval. Not withstanding any other
provision of this Agreement, the written consent of the Member shall be required to approve the
following matters:
(i) the dissolution or winding up of the Company;
(ii) the merger or consolidation of the Company;
(iii) the sale, transfer, contribution, exchange, mortgage, pledge, encumbrance,
lease or other disposition or transfer of all or substantially all of the assets of the Company;
(iv) the declaration of any distributions by the Company; and
(v) amendments to this Agreement.
ARTICLE VI
Dissolution
The Company shall be dissolved, and shall terminate and wind up its affairs, upon the
first to occur of the following:
the Act,
(a) the determination by the Member to dissolve the Company; or
(b) the entry of a decree of judicial dissolution pursuant to Section 18-802 of
ARTICLE VII
Governiftg Law ancljurisdiction
This Agreement, including its existence, validity, construction and operating effect, and
the rights of each of the parties hereto, shallI be governed by and construed in accordance with
the Iaws of the State of Delaware (without regard to principles of conflicts of laws).
ARTICLE VIII
indemnification and Liiltg#on of Liability
Section 8.1 Liability Limitation. (a) To the maximum extent permitted by applicable
law, the Managing Member shall not be liable, responsible, or accountable, in damages or
otherwise, to any Member, to the Company, or any third party for any act performed within the
scope of authority conferred on the Managing Member by this Agreement, except for fraud,
gross negligence, willful misconduct or intentional breach of this Agreement for: (i) mistakes of
judgment, (ii) any act or omission suffered or taken by it, or (iii) losses due to any such mistakes,
action or inaction.

Section 8.2 Indemnification. Except as may be restricted by applicable law, the
Managing Member shall not be liable for and the Company shall indemnify the Managing
Member against, and agrees to hold the Managing Member harmless from, all liabilities and
claims (including reasonable attorney's fees and expenses in defending against such liabilities
and claims) against the Managing Member, arising from the Managing Member's performance
of its duties in conformance with the terms of this Agreement.
Section 8.3 Reliance on Professional Advice. The Managing Member may consult
with legal counsel or accountants selected by the Managing Member and, to the maximum extent
permitted by applicable law, any action or omission suffered or taken in good faith in reliance
and in accordance with the written opinion or advice of any such counsel or accountants
(provided such counsel or accountants have been selected with reasonable care) shall be fully
protected and justified with respect to the action or omission so suffered or taken.
ARTICLE IX
Assignment of Interests
The Member may Transfer all or part of his/her Membership Interest in the Company.
ARTICLE X

Section 10.1 Winding Up. If the Company is dissolved, the Member shall wind up the
affairs of the Company.
Section 10.2 Distribution of Assets. Upon the winding up of the Company, subject to
the provisions of the Act, the Member shall pay or make reasonable provision to pay all claims
and obligations of the Company, including all costs and expenses of the liquidation and all
contingent, conditional or unmatured claims and obligations that are known to the Member but
for which the identity of the claimant is unknown. If there are sufficient assets, such claims and
obligations shall be paid in full and any such provision shall be made in full. If there are
insufficient assets, such claims and obligations shall be paid or provided for according to their
priority and, among claims and obligations of equal priority, ratably to the extent of assets
available therefor. Any remaining assets shall be distributed to the Member,
ARTICLE XI
Definitions
As used herein, the following terms shall have the indicated definitions.
"Act" means the Delaware Limited Liability Company Act, 6 Del. C. § 18-101 et seq.,
as may be amended from time to time.

"Agreement" means this Limited Liability Company Agreement, as may be amended
from time to time.
"Capital Account" means a separate accounting maintained with respect to the Member
pursuant to section 3.2 of this Agreement.
"Capital Contribution" means the contribution by the Member to capital of the
Company.
"Certificate of Formation" means the Certificate of Formation of the Company as filed
with the Delaware Secretary of State on July 2, 2013, as the same may be amended from time to
time.
"Company" means Cypress Shareholders LLC, a Delaware limited liability company.
"Managing Member" means the Member.
"Member" means Terri L. Bowman.
"Membership Interest" means the ownership interest of the Member in the Company,
including any and all tights, powers, benefits, duties or obligations conferred or imposed on the
Member under the Act or this Agreement.
"Transfer" means a transfer, assignment, pledge or encumbrance relative to any
Membership Interest in the Company.
IN WITNESS WHEREOF, the Member has executed and delivered this Limited Liability
Company Agreement the day and year first above written.

We are writing regarding the above property and the infringement on our property by the
Contractor, Turn Key Construction. We are also writing because we do not want the new
property owners to assume that the portion of property (118 Ocean Garden Lane) behind
our fence is their property.
At the time the home was built in 1992, the new owner decided not to extend the fence to
the back property line. The issue is that the contractor placed sod and reclaimed water
lines on our property, AND, removed our survey stakes (a survey that we paid for). After
numerous discussions with the contractor (John), he informed us that the water lines had
been moved, but he was unwilling to remove the sod and replace the survey stakes.
We are asking that this letter be made part of the permanent documentation on file with
the City of Cape Canaveral Building Department in the event that the property line does
come in question.

The pool will be equipped with an approved safety pool cover that complies with
ASTM F1346-91 (Standard Performance Specifications for Safety Covers for Swimming Pools,
Spas and Hot Tubs);
All doors and windows providine direct access from the home to the pool will be equipped with
an exit alarm that has a minimum sound pressure rating of 85 decibels at 10 feet;
All doors providing direct access from the home to the pool will be equipped with self -closing,
self -latching devices with release mechanisms placed no lower than 54" above the floor or deck;
I understand that not having one of the above installed at the time of final inspection, or when
the pool is completed for contract purposes, will constitute a violation of Chapter 515, F.S. and
will be considered as committing a misdemeanor of the second degree, punishable by fines up
to $500 and/or up to 60 days in jail as established in Chapter 775, F.S.

DUAL SUBMERGED SUCTION OUTLET SET
[Commonly called main drains]

® WARNING - Suction Entrapment Hazard.
Suction in suction outlets and/or suction outlet covers which are damaged, broken, cracked, missing,
or unsecured can cause severe injury or death due to the following entrapment hazards:
Hair Entrapment- Hair becomes knotted or snagged in an outlet cover.
Limb Entrapment- A limb sucked or inserted into an opening of a circulation outlet with a broken or
missing cover in the pool resulting in a mechanical bind or swelling
Body Suction Entrapment- Suction applied to a large portion of the body or limbs resulting in an
entrapment.
Evisceration/ Disembowelment Entrapment- Suction applied directly to the intestines through an
unprotected sump or suction outlet with a missing or broken cover.
Mechanical Entrapment- Potential for jewelry, swimsuit, hair decorations, finger, toe or knuckle to
be caught in an opening of an outlet or cover.
To Reduce the risk of Entrapment Hazards:
o A minimum of two functioning suction outlets per pump must be installed.
Suction outlets in the same plane (i.e. floor or wall), must be installed a
minimum of three feet (3') [.91 meter] apart, as measured from suction pipe
center to suction pipe center. (See Diagram 1. If suction outlets are to be located
closer then three feet (3') [.91 meter] apart, they shall be located in different
planes (i.e., one on the bottom, and one on the vertical wall, or one on each of
two separate vertical walls.) (See Diagram 2)
o Dual suction fittings shall be placed in such locations and distances to avoid 'dual blockage" by a
user.
o Dual suction fittings shall not be located on seating areas or on the backrest for such seating areas.
o The maximum system flow rate shall not exceed the flow rating of any listed (per ASME/ANSI
Al 12.19.8M-1987, ASME A 112.19.8-2007, APSP-7) suction outlet cover installed.
o Keep suction outlet components clear of debris, such as leaves, dirt, hair, paper and other material.
o Never use a Pool or Spa if any suction outlet component is damaged, broken, cracked, missing, or not
securely attached.
o Prior to each use of the swimming pool and/or spa, observe and replace damaged, broken, cracked,
missing, or not securely attached suction outlet components immediately.
o Remove pressure test plugs and/or plugs used in winterization of the pool/spa from the suction outlets.
o Two or more suction outlets per pump should be installed in accordance with latest APSP Standards
and CPSC guidelines. Follow all National, State, and Local codes applicable.
o Multiple layers of protection are available including installation of a vent pipe system, a gravity flow
system, or a vacuum release system.
o Suction outlet components have a finite life, the cover/grate should be inspected frequently and
replaced at least every seven years or if found to be damaged, broken, cracked, missing, or not
securely attached.
o Do not exceed maximum flow rate stated on suction fitting.
o Only replace a pump with one with a similar flow curve, avoid a pump with a higher horsepower
rating.

In the event of one suction outlet being blocked, the remaining suction outlets serving that system shall have a
flow rating capable of the full flow of the pump(s) for the specific suction system.
Example: In the System shown in Diagram 1, two (2) "Floor Only" suction outlet covers are selected and mounted.
These covers are individually rated for 125 GPM. For a desired flow rate through the pump of 100 GPM, a minimum
pipe size from the Chart 1 is selected at 3". At the desired flow of 100 GPM one cover could be partially blocked
and the other suction outlet flow would be below the rated 125 GPM of the "Floor" mounted suction outlet cover.
Since there are two outlets flowing in normal operation, and the allowable velocity in the interconnecting piping is
only 3ft/sec, the same pipe size is required in the interconnecting piping.
Example: In the System shown in Diagram 2, one (1) "Floor Only" suction outlet cover, rated at 125 GPM, and one (1)
"Wall or Floor" suction outlet cover, rated at 72 GPM are selected and mounted. For a desired flow rate through the
pump of 50 GPM, a minimum pipe size from the Chart 1 is selected at 2". At the desired flow of 50 GPM either
cover could be totally blocked and the other suction outlet flow would be below the rated 72 GPM of the wall
mounted suction outlet cover. Note: Flow may be limited by entrapping force in dual suction systems.

INSTALLATION INSTRUCTIONS: - Use a #2 Philips head Screwdriver.
NOTICE: When installing WG1030AVPAK2 refer to ASME A 112.19.8-2007 for the proper instructions on
how to construct the field -fabricated sump. Figure 2 is an illustration of some of the requirements.
Suction outlets for a pool with a vinyl liner and for fiberglass pools are provided with a WG1048B mounting
ring and two (2) gaskets. The gaskets should be placed such that they sandwich the liner or fiberglass, that is,
one gasket on each side. The ring (WG 1048B) is attached to the suction outlet by eight (8) screws that pass
through both gaskets and the liner. See diagram below.
SELF
Suction outlets for a concrete or gunite pools are
designed to be plastered with the top surface flush
to the pool surface. An Adjustable Collar
WG1051X may be used to aid in obtaining the
desired configuration.
Two screws MUST be used to secure the cover to
the suction outlet. USE ONLY HAYWARD GENUINE
REPLACEMENT PARTS INCLUDING THE SCREWS.

RELIEF VALVE
For installations utilizing a hydrostatic relief valve
(SP 1056), using a collector tube (SP 1055) will maintain a clear path to the hydrostatic valve. At least one
hydrostatic relief valve in a set of suction outlets will allow hydrostatic uplift pressure caused by ground water
to be relieved into the pool or spa.

TERMS AND CONDITIONS OF CONTRACT
1. PERMITS.
All In One Pools, LLC shall apply on behalf of the customer for a building permit for construction of the pool. If permit cannot be obtained by All In One Pools, LLC, customer shall attempt
to secure permit at customer cost. If the permit cannot be obtained, contract will be cancelled and the remaining balance of the deposit will be refunded. Customer shall be responsible for obtaining
any certificates of occupancy, zoning variance changes, plot changes, surveys, test boring, percolation tests, or special items required for All In One Pools, LLC performance of the work and shall pay all
costs and fees in connection therewith. Customer furnish any necessary variances, surveys and associated permits or fees if such items are required. The customer is responsible for homeowner associ-
ation fees and any drawings that they may require.
2. POOL AREA PREPARATION
Customer is responsible for all site preparation including, but not limited to, removing trees, stumps, power lines, underground piping, any other underground obstructions and any extra
grading needed outside pool area, or additional fill material required. Customer to provide All In One Pools, LLC with adequate access. Pool area is defined as square footage of pool at its waterline plus
10' on each of its sides.
Customer shall be responsible for providing adequate drainage around the pool to protect the pool from damage due to drainage conditions, and draining the pool. In addition, drainage
beyond the pool area is to be provided by the Customer and shall meet county and local requirements. Customer is also responsible for providing All In One Pools, LLC with necessary electricity and
water during construction and filling of the pool. Filling of the pool with water shall commence immediately upon completion of plastering and be continuously filled to middle of the tile line within
tree days.
All In One Pools, LLC shall not be responsible for variations of elevations. or for damage to lawns, fences, shrubbery, trees, curbs, sidewalks, driveways, sprinklers, foundations, appurtenanc-
es, underground A/C lines, any septic or sewage systems, or to any real or personal property caused by moving equipment to and from the pool within access way or around the pool area. Relocation or
replacement of above is sole responsibility of the customer.
3. DESIGNATION OF THE POOL LOCATION
Customer represents that he/she has the tide to the land and that the pool location is within his property lines and dear of setbacks, underground installations and overhead power lines, and
that the pool equipment location complies with applicable zoning laws.
Customer represents that the pool location is on original ground and that it will not interfere with support of existing or proposed structures.
Customer has directed the location of the pool and other improvements and equipment, and shall not hold All In One Pools, LLC for alleged incorrect location of the pool.
Customer will indemnify and defend All In One Pools, LLC from any daim, loss or expense arising by reason of trespass and/or damage by All In One Pools, LLC resulting from customer's
designation of pool location and access routes by reason of any work performed by customer or others.
4. CONSTRUCTION
Construction shall commence after permits have been obtained and financing arrangements and documents have been completed. All In One Pools, LLC shall proceed expeditiously to com-
plete the pool, but shall not be responsible for delays caused by acts of God or nature, Customer or Customer's agents, weather, strikes, government action or inaction, vandalism, and Customer's failure
to make payments when due, or other reasons beyond All In One Pools. LLC's control.
Construction shall be deemed completed when the pool is plastered, notwithstanding the fact that customer has not connected water, electricity or fuel or that repairs or warranty work may
not have been completed, or that final inspection is still required.
Should certain materials or accessories become unavailable, All In One Pools, LLC shall have the right to make equivalent substitution at no extra cost to customer. If equivalent substitution
is not available, then the cost of the substitution is the responsibility of the customer. All pool dimensions and depths are approximate, having reasonable tolerances either way. Liquidation damages at
the rate of $7.00 per square foot are applicable when variations in size are less than contracted. Liquidation damages at the rate of $20.00 per inch for variations in measured depth of deep or shallow
end are applicable outside of a variance greater than 6" subject to the terms of 116 below. If All In One Pools, LLC has not started excavation within 120 days from the date of this contract for any reason
beyond All In One Pools, LLC's control, All In One Pools. LLC may at its option, cancel this contract by notice to the customer.
5. ELECTRICAL SERVICE
Electrical work contemplates no change to existing service panel other than the addition of circuit breakers or fuse blocks to distribute electric current to new outlets. Changes to existing
wiring and tunneling, if required are not included. These are the sole responsibility of the customer.
6. EXCAVATION
This contract is based upon normal excavation conditions. All In One Pools, LLC defines normal as any excavation that can be removed from its normal bed in one day using only the stan-
dard equipment used in pool excavation.
If during the excavation operation, hard pan, rock or other material, which requires drilling, blasting, additional or special excavating equipment, or earth caving are encountered, water seep-
age is uncovered and/or any other unusual situation is found to exist where additional excavation time and material is required, All In One Pools, LLC shall not be liable for the resulting delay and All
In One Pools, LLC shall have the right:
a. In case of rock, muck or hard pan, to remove the same upon customer's approval and at customer's expense.
b. In case of water seepage, the customer will be notified that additional measures will be needed to excavate the pool area and prevent hole collapse. The costs of all additional measures are
the sole responsibility of the homeowner. The steps necessary to excavate and build in conditions involving ground water including the raising of the pool elevation above the water table or lessening of
the pool depth, all costs of labor, stone, piping, trenching, dewatering pipe with pump and other materials to be paid for by customer at his expense and due immediately. Rock in excess of the amount
on the contract is the responsibility of the homeowner at current market price.
c. In case of poor soil bearing conditions and upon customer's approval and expense to take all necessary measures to prevent the same.
d. In case a drywell is required by law, or necessary for drainage of the filter or pool, it shall be constructed at customer's approval and expense.
e. If fill is required, it will be hauled to the site upon customer's approval and expense.
f. If blasting is required, it will be done at the customer's approval and expense. Customer shall have the right to remove rock or hard pan in accordance with All In One Pools, LLC excavation drawings.
If excavation is not done to specifications, there will be a charge for any work and materials needed to shape or re -excavate pool or control water. If contract is cancelled due to excavation conditions,
customer agrees to pay All In One Pools, LLC $5,000 as liquidated damages for the work to date of cancellation.
7. POST CONSTRUCTION
If the Customer install the pool decking, Customer must provide protection for the pool shell, coping and tile damage from damage by the decking by a standard expansion joint of _"
by 4" polysulfide or equal expansion joint material. All In One Pools, LW shall not be liable for damage to pool shell and coping caused by improper installation of decking by Customer. Customer is
responsible for landscaping, sod, utilities, fences and for having water, electricity, venting and fuel connected to pool and equipment.
Customer is responsible for contacting All In One Pools, LLC too have final inspection scheduled. The customer must attend final inspection and is responsible for any re -inspection fees and
appointments required because of missed appointments or inadequate alarms, fencing or other barriers. Any alarm, barrier, fence or screen required is the sole responsibility of the Customer.
In the event that the pool is drained for any reason whatsoever, none of the warranties or guarantees herinabove shall apply unless the customer (a) removes the relief plugs as soon as they are
above the level of the declining water, and (b) refills the pool within to days of the draining.
Where customer has work performed by others that is not provided for in this contract - such as, but not limited to, electrical work, decking, landscaping, fences and retaining walls, All In
One Pools. LLC shall not be held liable for such work or for loss or damages, if any, which may result therefrom. Customer shall indemnify and hold All In One Pools, LLC harmless from any and all
damages or injury to the pool and/or spa including all integral components, the shell and all accessories and equipment caused by others performing work not provided for in this contract, including
but not limited to electrical work, decking, screen enclosures, rock work, landscaping, fences and retaining walls. Customer understands and agrees that it is the Customer's sole responsiblilty to investi-
gate, contract with, supervise and pay any party who performs work additional to what is contained in this contract.
8 PAYMENT
Customer represents that he/she will not transfer or encumber this property until there has been full payment of all sums due and owing pursuant to the terms of the contract. Should any
payment due All In One Pool, LLC not be made as provided herein. All In One Pools, LLC may discontinue its performance hereunder until such payments have been made in full. Until the contract
price and all change orders are paid in full, all equipment and accessories shall continue to be the property of All In One Pools, LLC regardless of being affixed to real estate and tied thereto, and shall
not pass to customer until Ann One Polls, LW has been paid in full. All In One Pools, LLC shall have complete authority for removal and retention of equipment (pumps, filters, heaters, heat pumps,
valves, chlorination equipment, electrical equipment, cleaning equipment, control equipment or any other product provided by All In One Pools, LLC or its sub -contractors) Until contract agreement
and all change orders are paid in full. Customer agrees that the contractor does and shall continue to have permission for entry to or on any premises to remove these articles.
9. DEFAULT
In the event of default by the customer, either by cancellation or preventing All In One Pools, LLC's performance hereunder or failure to make payments or otherwise comply with the terms
and conditions of this contract. All In One Pools, LLC to the fullest extent allowed by law, at its option, may dedare the entire balance of this contract immediately due and payable, together with a
reasonable attorney's fee.
10. MISCELLANEOUS
If any provisions (or portion thereof) of this contract shall be deemed invalid, it is agreed that such invalidity shall affect only such provisions (or portionthereof). and that the remainder of
this contract shall remain in force and effect. IN NO EVENT SHALL ALL IN ONE POOLS, LW BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR ANY BREACH OF THIS
CONTRACT.
Contract is personal and may not be assigned by Customer. The terms "Customer" and "He" include the plural, masculine and feminine.
This contract contains the entire agreement between the parties and may not be altered except in writing, signed by duly authorized representative of All In One Pools, LW.
There are no representations, oral or written, except as set forth herein. YOU SHOULD NOT INSTALL OR USE A DIVING BOARD OR JUMP BOARD. DO NOT DIVE INTO THIS POOL.
Customer's duties to make payments hereunder are absolute and shall not be suspended or voided in any manner by virtue of the fact that All In One Pools. LLC may be obligated to make
repairs to the pool or spa shell and any integral component or any accessories or equipment at the time such payment is due under the contract.
Should any materials, supplies, sub -contractor or fuel costs increase by 5% or more, from the date that All In One Pools, LLC signs this project until the purchase of material for use on this
job, the entire cost increase is the burden of the customer. All In One Pools, LLC will document the increase and provide an invoice.
Any controversy, action, claim, dispute, breach or question of interpretation relating to or arising out of this contract shall be resolved by arbitration in accordance with Florida Statutes by
Florida Pool and Spa Association (Space Coast Chapter) and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction. The costs of arbitration shall be
borne by the losing party or shall be borne in such proportions as th arbitrators determine.
All In One Pools, LLC One Year Limited Warranty:
AR In One Pools, LLC shall warrant pool to be free from defects in material and workmanship for am period of one year from date the pool is plastered. All In On Pools, LLC further warrants the
concrete pool shell to be structurally sound for the period that the pool is owned by the original owners. Walks and decking are not warranted against normal cracking, raising, settling or discoloration.
Interior finish is not warranted against discoloration or staining, since such defects generally result from local water conditions, neglect, improper use of lack of chemicals. or improper cleaning of the
pool. Warranties are effective only if owners have complied with all the terms, conditions, payments and other provisions of this agreement.
THERE ARE NO WARRANTIES, WHETHER EXPRESSED OR IMPLIED THAT ARE THE RESPONSIBILITY OF ALL IN ONE POOLS, LLC.
