John Campbell's survey of Oak Lane
September 17, 2019
Honorable Mayor Hoag and Council Members of the City of Cape
Canaveral.
John Campbell is currently under investigation by the State of Florida
board of professional surveyors and mappers. For this reason resolution
2019-13 and ordinance 17-2019 should be postponed until the completion
of case #1906-213112. This investigation involves the two maps included
in tonights agenda packet submitted by David Dickey and approved by
City Manager David Green. Both maps were created under the direction of
City Attorney Anthony Garganese.
1) I vehemently oppose ordinance 17-2019 that will authorize Patrick Lee's
Sheropa LLC housing development to protrude several feet into the right
of way of Oak Lane. This protrusion has created an emergency on Oak
Lane. On March 18, 2016, Mayor Hoag w9.tched Patrick Lee's contractors
remove several feet of asphalt from Oak Lane to install driveways for his
housing development. This altered traffic to drive off the paved portion and
towards my property. On March 28 I informed Mayor Hoag about a
garbage truck I witnessed that veered off the road and came within inches
of contacting the high voltage power lines. I later took a video of a truck
within inches of the power lines, Mayor Hoag declined to view that video.
A few weeks later while I was retrieving our roadside trash-can I found the
same live high voltage wire lying on the ground next to the trash-can. I was
very fortunate to avoid electrocution. The driveways have interfered with
the free flow of vehicular traffic and must be removed immediately.
2) I vehemently oppose the City's current plans for improvements to Oak
Lane that requires 10 feet of "free space" on the South side to allow the
driveways of Patrick Lee's housing development to remain in place. This

will unfairly shift the road up to my property line and move the traffic much
closer to my home. Any improvements made to Oak Lane in the future
must conform to standard road design and not favor the Sheropa housing
development by shifting the road off-center. Once again the driveways
need to be removed from the right-of-way immediately! Also the asphalt
that was removed needs to be repaired immediately.

3) City Council approved the hiring of independent advisory hearing officer
D. Andrew Smith to conduct an evidentiary hearing due to serious
allegations against City officials and Staff involving the Sheropa housing
development.
This requirement should be completed prior to altering City code for the
purpose of legalizing Patrick Lee's Sheropa housing development.
4) In an attempt to find out ~ho is disregarding City Councils requirement
for Sheropa to demolish the east side of 127 Oak Lane I made the
following public records request to the City Clerk. The request has been
ignored therefore the City is required by s.119.07(1)(d),F.S. to state in
writing the basis for the denial, including the exact statutory citation
authorizing the denial.

A final decision was made by the City Council on 10/2/2018 that
required the Sheropa housing developer Patrick Lee to remove the eastern
portion of 127 Oak Lane to fit within an arbitrary 4 foot variance. This
decision can only be over ruled b_lf the Brevard Circuit Court. Mr. Lee and
his contractor John Dinsmore agreed to this requirement. In April 2019
construction resumed at 127 Oak Lane without relocating the eastern wall
or providing special drainage solutions for problems identified by the City
engineer. To make matters worse the air conditioning compressor was
installed on the eastern side of the of the home in violation of SEC 110-538
(10) and making it impossible to deal with the drainage problems.
Mayor Hoag insisted an accurate survey was not required for the
Sheropa housing development allowing 127 Oak Lane to be built directly
on the property line with 123 Oak Lane. This has resulted in Patrick Lee
installing an air conditioning compressor on property deeded to 123 Oak
Lane and to be use to cool 127 Oak Lane.
At the 10/2/2018 hearing David Dickey recommended approval of the
variance because Patrick Lee would be deprived of rights enjoyed by
others.
Pursuant to Article 1, section 24 of the Florida Constitution, and
chapter 119, F.S., I am requesting the City Clerk give me an opportunity to
inspect the public records for the following:
1) Anyone else in the City of Cape Canaveral who enjoys the rights
afforded Patrick Lee (construction on a neighboring property).

2) Permit for installing the air Conditioning condenser at 127 Oak Lane.
This should include final inspection, variance for Sec. 110-538 (10) and
the mailing list.
3) All documents involving the drainage problem at 127 Oak Lane.
4) All documents authorizing FPL to install a permanent power meter at
127 Oak Lane. · -

Please provide this information to the independent hearing officer
whom is looking into my other complaints involving the Sheropa housing
development.
If resolution 2019-1'3 and ordinance 17-2019 were to be approved the
following property owners will lose ~a significant amount of property and or
a significant change to their deeds.
