The Public Hearing Officer was referred by City Attorney Anthony
Garganese. His name is D. Andrew Smith, III and his firm is Shepard,
Smith and Cassady, PA, you can get more info here: www.shepardfirm.com.
Attorney Garganese was asked to identify a highly educated, experienced
individual who would do a good job with no acquaintance or relation to
Mr. Greene, City Staff or Council. They are based out of Volusia County.
If you are available that day and time, please let us know and Staff
will move forward. If possible, please provide a contact phone number.

Good morning Mr. Lennon,
Would you be available for a Public Hearing before an independent
Hearing Officer to consider the appeal to Variance No. 2016-02 and make
recommendations to the City Council. We are targeting Monday, October
24th in the Library Meeting Room at 201 Polk Ave. (same venue as City
Council Meetings) from 9a – 3p. The action to authorize City Manager
David L. Greene to engage a Hearing Officer was voted for unanimously by
the City Council at the Special City Council Meeting of September 6th.
Once we have confirmation of all parties’ availability, I will contact
each party to confirm the date/time and any other pertinent information.
Then we will be able to send out the proper notices by per City Code
Sec. 110-28 - Due process; special notice requirements
