initiative and how it impacts Oak Lane properties. I appreciate your
interest in this matter; however, I feel it necessary to clarify several
assertions you make in your email.
Firstly, you state that “David Dickey decided to zone Oak Lane with an
incompatible mixture of R-1 and high density R-2 without discussing this
with the owners living on Oak Lane.” It is important to remember that as
a Staff person I have no decision making ability with respect to zoning
matters. My role is to provide a professional recommendation to the
decision makers, which in zoning matters is the City Council. In
addition, your statement regarding the “incompatible mixture of R-1 and
high density R-2” is not altogether tenable. Minor point, but an
important one, R-2 is considered the City’s medium density residential
zoning, not high density as you state (see Sec. 110-291). There are
examples in the City where R-1 and R-2 zoning is harmoniously located
adjacent to one another. In fact, there are situations throughout the
City where R-1 zoning is adjacent to R-3 and C-1 zoning. It is really a
matter of how the site is laid out/designed that is critical to ensuring
compatibility.
Secondly, your assertion that the owners of Oak Lane have not been part
of this discussion is completely false. There have been at least two
opportunities for public input on this matter. The first was a noticed
neighborhood meeting on January 8, 2019. The second was a noticed
workshop with the Planning & Zoning Board on May 9, 2019 (see attached
agenda). Note that a number of residents of Oak Lane were in attendance
at both of these meetings and spoke to the matter. As I recall, you were
in attendance at the first of these meetings. As was stated at the
afore-mentioned meetings, there remains a minimum of three (3) public
hearings before the rezoning will be finalized. This is significant
because of the additional opportunities that interested parties (to
include Oak Lane residents) will have to provide input on the matter
before a final decision is made.
Lastly, am I correct in understanding that you want your property at
126 Oak Lane to be rezoned to R-2, not R-1 as currently proposed?

The City of Cape Canaveral is trying to address the issue of more than
700 residential units in commercial zoning. I approve of this effort and
understand the complexities of such a task. The rezoning of Cape
Canaveral prompted a petition by the owners on Oak Lane to rezone the
entirety of Oak Lane as (R-1) single family because all of Oak Lane has
always been used as single family residential. The petition for R-1
zoning received 100% support from the owners living on Oak Lane. David
Dickey decided to zone Oak Lane with an incompatible mixture of R-1 and
high density R-2 without discussing this with the owners living on Oak
Lane. I request my property be zoned R-2 to be compatible with the
adjoining property to my west.
