Andrew Smith was “Due to several serious allegations by Mr. Lennon against City Officials and Staff”. This was clearly spelled out in the revised agenda on Sep. 6, 2016 item #3. The certified letter you sent to me on Sep. 21, 2018 clearly prohibited any discussion on this matter (see attachment). Since some of the allegations are against you, Mr. Garganese, it is inappropriate for you to intervene on this matter, the same as it was inappropriate for you to intervene in the police investigation. The City of Cape Canaveral should be advised to seek independent council for this issue. The matter of the independent hearing officer is separate from the appeals hearing on the variance. On the variance, you remark that, “This matter in all respects is closed.” This is incorrect. The City Council’s requirement that Sheropa demolish part of the structure at 127 Oak Lane has not been completed. I have been nothing but truthful and want nothing more than to have the City of Cape Canaveral follow the rules. Florida has a very broad public records law. As a result, any written communication created or received by the City of Cape Canaveral officials and employees will be made available to the public and/or media upon request, unless otherwise exempt. Under Florida Law, email addresses are public records. If you do not want your email address released in response to a public-records request, do not send electronic email to this entity.
