A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA; APPOINTING
MEMBERS TO THE COMMUNITY APPEARANCE BOARD AND
PLANNING AND ZONING BOARD OF THE CITY OF CAPE
CANAVERAL; PROVIDING FOR THE REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Cape Canaveral, Florida, has by City Code
Section 22-37 established a Board known as the Community Appearance Board and by City Code
Sections 58-56 and 110-3 established a Board known as the Planning and Zoning Board; and
WHEREAS, it is now incumbent upon the City Council of the City of Cape Canaveral to
appoint members to said Boards.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby
incorporated herein by this reference as a material part of this Resolution.
Section 2. Staggering the Terms of the Board. Pursuant to Section 2-171(f) of the Cape
Canaveral City Code, in order to stagger terms of the Community Appearance Board, an existing
vacant term, originally scheduled to end May 1, 2020, has been adjusted to end May 1, 2022 and
in order to stagger terms of the Planning and Zoning Board, an existing vacant term, originally
scheduled to end September 15, 2020, has been adjusted to end September 15, 2022.
Section 3. Appointment. Pursuant to Section 2-171(e) of the Cape Canaveral City Code, the
City Council of the City of Cape Canaveral hereby appoints the following individuals to the
following boards:
Marlene Woodside shall be appointed to the Community Appearance Board for an adjusted, •
existing 3-year term, to serve until May 1, 2022.
Geoffrey Zuercher shall be appointed to the Community Appearance Board for an existing
3-year term, to serve until May 1, 2022.
Dr. Michael Miller shall be appointed to the Planning & Zoning Board for an adjusted, existing
3-year term, to serve until September 15, 2022.
Following completion of their first terms, appointees shall be eligible for reappointment to their
respective board for one additional term consistent with the limitations set forth in Section 2-171(0,
City Code.

Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, word, or portion
of this Resolution is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion hereto.
Section 6. Effective Date. This Resolution shall become effective immediately upon
adoption by the City Council of the City of Cape Canaveral, Florida.
ADOPTED at a Regular Meeting of the City Council of the City of Cape Canaveral,
Florida, assembled this 20th day of August, 2019.
