Department of Labor Overtime Rule Revisited
During the Obama administration, the Department of

economic, labor and corporate partners. Prior to
issuance of the "Final Rule" in May of 2016 more than '41l1
270,000 comments were evaluated and the threshold OVI PAY
(salary test)was adjusted from $23,660 to $47,476 per
year. The Final Rule was declared invalid by the U.S.
District Court of Texas and the Fifth Circuit dismissed the DOL's appeal, at the Department's request
in September 2017. Upon taking office, President Trump directed the DOL to formally rescind the
2016 rule and is proposing a new rule.
• Raises the salary threshold from $455 per week($23,660 per year) to $679 per week($35,308
per year).
• Allows employers to include"certain non-discretionary bonuses and incentive payments"up to
10% of the new $679 per week salary threshold.
• Raises the total annual compensation requirement for highly compensated employees—which
are subject to a minimal duties test from $100,000 to $147,414.
• The Department also intends to propose updates to the salary levels every four years.
Patrick Pizzella, who has served as deputy secretary of Labor since April 2018, has been"tapped by
Trump"to take over following Labor Secretary Alexander Acosta's resignation amid controversy over
a plea deal that he brokered for wealthy sex offender Jeffrey Epstein as a prosecutor in Florida.
If this new Overtime Rule goes into effect, the new threshold will likely take effect in early 2020.

Community Appearance Board Meeting
At its July 17, 2019 meeting, the Community Appearance Board (CAB) approved the installation of
the City's first commissioned mural, which commemorates the 50th Anniversary of the Apollo 11
Moon landing. The mural, to be located on the exterior wall of the racquetball court on Taylor
Avenue, will serve as the capstone of the City's Summer of Space celebration and is part of the
continued effort to enhance the cultural landscape through the City's Civic Scenery Program.

New City Municipal Software—Training Begins!
During the week of July 22, 2019, the Community Development Department will begin training for
new software. As the City moves through the training and migration process some services may be
temporarily impacted. Be sure to contact City Hall at: (321) 868-1220 Ext 139 to learn how this may
affect day-to-day operations.

• The Building Division conducted 57 inspections and completed 15 plan reviews. The division
also processed 35 new building permit applications and 32 payments for permits that were
picked up.

• Issued three courtesy letters for property conditions.

Tree Permitting Requirements
The City of Cape Canaveral has been a tree City for 30 years, and Staff has made every attempt to
preserve healthy and native trees in the Community. Traditionally, City Code has required certain
actions from property owners prior to the removal of a tree. These requirements usually included an
application through permitting for all tree removal requests. Recently, House Bill 1159 was passed
(effective July 1, 2019) and states that:
"A local government may not require a notice, application, approval,permit,fee,
or mitigation for the pruning, trimming, or removal of a tree on residential
property if the property owner obtains documentation from an arborist certified
by the International Society of Arboriculture or a Florida licensed landscape

architect that the tree presents a danger to persons or property. A local
government may not require a property owner to replant a tree that was pruned,
trimmed, or removed in accordance with this section. "
What this means now is that property owners do not have to apply for or obtain a permit through the
City as long as they obtain documentation from a certified arborist or landscape architect stating the
tree they wish to remove is dangerous. In the past, the property owner was required to submit an
application for tree removal and the City's arborist would inspect the tree. If the tree was declared
dangerous (hazardous), Staff would allow the property owner to remove the tree and issue a no fee a
permit. This is not much different from how the City has typically managed trees, however,now
property owners do not need to apply for a permit through the City, but can obtain a specialist on their
own.
The City makes every attempt to work with property owners regarding tree removal and if a property
owner believes a tree is dangerous and would like the City to verify or has questions pertaining to the
new bill please contact Code Enforcement Officer, Brian Palmer at(321) 868-1220 Ext.115.
Code Enforcement Case Status
In conjunction with Code Enforcement and Community Engagement Staff, developed a more efficient
reporting process for residents/parties to find the status of City Code Enforcement cases. The new look
which will allow for easier tracking of cases, will be updated weekly and available on the City's

Space an annual tradition! At last week's
City Council meeting, the City's Poet
Laureate, Timothy Bass read the historic
Resolution 69-30,passed by the Cape
Canaveral City Council in August of
1969, commending the efforts of the three astronauts and everyone who helped to get them to the
Moon. In addition, two members and a volunteer for the Brevard County Historical Commission
attended the council meeting to accept the Summer of Space Proclamation. The Brevard County
Historical Commission is a 15-member board, wholly comprised of volunteers, that are dedicated to

preserving and promoting the rich history of Brevard County from the Ais to Armstrong and beyond.

Summer Campers to Help Dedicate Little Free Library#6
The Summer of Space continues with the dedication of the City's 6th Little Free Library. Decorated by
the amazing young artists enrolled in the City's Summer Camp program, this Summer of Space-
themed Little Free Library is located in the City Hall Plaza(100 Polk Avenue). In the last three years,
Cape Canaveral has become a Champion for the Little Free Library program which serves to promote
literacy and public accessibility to books and cultural enrichment. With more Little Free Libraries and
Little Free Pantries per square mile than any other Community in Brevard, the City of Cape Canaveral
continue to reinforce its commitment to supporting accessibility to arts for all.
Summer of Space Mural Design Approved by Community Appearance Board
On the 50th Anniversary of the Apollo 11 Moon landing, Staff announced the design that was selected
as the City's first commissioned mural project. The design "One Giant Leap for Mankind" created by
artist Jhonattan Arango of West Palm Beach was approved by the Community Appearance Board
(CAB) on July 17, 2019. Mr. Arango, who paints under the name of Anon, was a native of Cuba
before immigrating to the United States and served as a medic in the U.S. Navy. He earned a
Bachelor's of Fine Arts in Graphic Design from the Art Institute of Jacksonville and has completed 15
murals in Florida in addition to participating in numerous exhibitions.

Carnarvon share our unique
connection to the history of space exploration. With a 12-hour time difference, when the astronauts
launched from Cape Canaveral, the "Trackers" in Western Australia were on task to assist Houston in
monitoring the space flight once its distance exceeded the communication reach of the American
bases.
So this past weekend, our communities united from around the globe to celebrate this historic
milestone and remember all that is possible when our communities work together. As part of our
continued effort to build a meaningful relationship between our two communities, Staff is exploring
options to build on our shared interests in sustainability, education and cultural engagement.

Scams in the City
City Staff has been hearing of many reports of phone, email and text scams here in our fair City. Those
targeted were often urged to provide gift cards at short notice by someone identifying themselves as
someone they know. Before you comply with such a request, think twice and contact the requestor by
a different means or contact the Brevard County Sheriff's Office at(321) 633-7162 to report them.

Infrastructure Maintenance (IM)
SR AlA Mast Arm Construction Project
New traffic signal mast arms were installed at the following intersections with SR AlA:
• Holman Road
• Center Street
• North Atlantic Avenue
The new traffic and pedestrian crossing signals are now operational. Paving of intersections and re-
striping of cross walks/stop bars are also complete. Remaining activities include landscaping and
general cleanup. The project completion date has been extended to the end of July 2019.
International Drive
The paving project on International Drive continues with great progress! The new curbing will be
complete, weather permitting,by Monday, July 22, 2019.

Water Reclamation Facility (WRF) / Sanitary Sewer System

WRF/Collections System Improvement Projects
Staff continues to meet with selected firms to assist in the engineering design for several future
projects (some funded by the State Revolving Fund(SRF)Program) as follows:
• WRF SCADA System— Stantec, Inc.
o Consultant is investigating various supplier's systems that could meet the City's needs.
• Lift Station#3 Rebuild(West Central Boulevard)—Mead and Hunt
o Design of replacement lift station located adjacent to the Central Ditch along West
Central Blvd. is nearing completion.
• Lift Station#5 Rebuild(Treasure Island Condominium)—Jones Edmunds
o Staff is scheduling a meeting with the Board of Directors from Treasure Island
Condominium to obtain consensus for completion of this lift station replacement
project.
• WRF Intermediate Lift Station Rehab—Infrastructure Solution Services
o Design of a replacement lift station located within the WRF is nearing completion.
• WRF Disk/Drum Filters/Tertiary Filters Installation—Kimley-Horn
o Staff met with personnel from Fred Fox Enterprises, a firm that specializes in the
preparation of Community Development Block Grant(CDBG) applications. Staff will
further investigate if a CDBG funding request is appropriate.
• Force Main#7 Replacement (Thurm Boulevard)—Bowman Engineering
o City's consultant is investigating potential directional drilling firms to construct the
replacement force main. The use of directional drilling will eliminate the need for large
excavations at Manatee Sanctuary Park.
• Polk Avenue Drainage Improvements (300 Block)—John Pekar
o A survey of stormwater pipes in the area was completed. Staff is currently investigating
appropriate types of replacement piping.
• West Central/Thurm Blvd. Streetscape Project—John Pekar
o Staff is investigating possible solutions for stormwater management along the southern
side of Thurm Boulevard, which frequently floods.
• Exfiltration System Improvements at Canaveral City Park—Geosyntec
o Construction of underground structures is complete. Contractor is currently waiting on
specialty valves for installation in the underground vault—the system will then be
connected to the City's SCADA.

• WRF Consent Order Compliance—Tetra Tech
o A Third Quarterly Report was submitted to Florida Department of Environmental
Protection(FDEP). No WRF effluent permit exceedances were recorded during the
three-month reporting period.
Stormwater
Replacement of Stormwater Inlets
The City's contractor continues to replace 15 stormwater inlets throughout the City. Open-throat inlets
are being replaced with Type "C" inlets which trap more debris and are less susceptible to damage
from vehicles. This is part of a long-term maintenance project to replace all open-throat inlets in the
City, where practical. Twenty inlets are replaced each fiscal year.
Other Items of Local Interest
Estuary Property—Lone Point Road
Removal of Brazilian Pepper Trees and other invasives across the property is nearly complete. Future
project tasks at the site include:
• July 2019
o Inspect for Brazilian Pepper Tree regrowth.
o Treat with herbicide if necessary.
o Remove concrete/asphalt debris piles.
o Obtain approval for Planting Plan.
o Replant site with 381 native tree species (the type of tree planted at each location will
be determined by land elevation, presence of surface water, location of future
boardwalk, etc.).
• August 2019
o Install fence along northern property line.
o Monitor condition of newly-planted trees.
Staff continues to work with St. Johns River Water Management District(SJRWMD)to obtain the two
wetlands properties to the south of the City-owned site. The City would accept title to the properties
from SJRWMD and perform the same scope of work as on the City-owned site. All three properties
together would provide over 14 acres of protected wetlands along the Banana River. The mosquito
ditches will also be reopened to allow for the unimpeded flow of surface water. The majority of these
projects are funded by SJRWMD. Project updates are available in The Weekly Update, on the City
web page and on City social media platforms.
Local Mitigation Strategy (LMS) Meeting

Staff attended a meeting with the LMS Steering Committee to begin preparation for the 2020 LMS
Update Report prepared by Brevard County. As requested, Staff will collect updated data on potential
projects, critical facilities, vulnerability maps and land-use development trends to include in the
updated report. The LMS Update Report is required by the Federal government every five years to: (1)
identify hazard areas subject to damage from natural disasters and; (2) determine the distribution of
disaster relief funds.
Leisure Services
Athletic Leagues
Tennis
As Monday night tennis makes it well over the half way mark, Thorpe and John remain tied at 18
points. Thorpe has a slight lead however,because of John's one and only loss. The rest of the league is
nipping at their heels with Mike having an opportunity to advance once he makes up two matches.
With only two games played so far in Wednesday tennis, four players remain undefeated. Will any of
them step up and defeat long standing Champion Gary? Only time will tell, so stay tuned as the league
evolves. Eight-out-of-ten matches have been completed in Thursday night tennis and there is only a
two-point differential between the top four players. The last two matches will have a big impact on
placement so players will have to dig in deep if they want to make playoffs.
Racquetball
The second week of Wednesday night racquetball hosted very competitive matches. Greg has taken a
small lead with zero losses,but it is way too early for any predictions.
Kickball
Last week's games mirrored the previous weeks in the way of turnarounds. Graham's suffered their
second loss in a row, while Red's took their second consecutive victory. JT's lost to SOMB. And
although Graham's still leads the league on point differential, WS has only one loss to date. Point
standings are not only calculated by number of wins, but by number of runs scored during the game,
making the gap between first and second very close. At this point in the league, Graham's can't afford
to lose another game if they wish to remain first in the standings.
Youth Athletics
Space Coast Little League
It is that time of the year again! Registration is open for fall baseball with SCLL. Games are played at
Canaveral City Park and Cocoa Beach. Children as young as four years old can participate and the
memories made will last a lifetime. The league will start in August and run through December of
2019. Cost to register is $50 and includes the uniform. Special assistance is available for any parent
that can't afford to pay, so no excuses Cape Canaveral. Let them play ball! To register, visit:

charge of the Club, the future is bright for soccer in Cape Canaveral. Alberto was President of the
Indialantic Soccer Club and grew that Club to unprecedented numbers through selfless dedication to

Youth Leadership Program (BCSO PAL YLP)
Four lucky local teens spent Thursday through Sunday at Disney's Coronado Springs Resort attending
the annual State Florida PAL Conference. This event allows children involved in PAL the opportunity
to acquire leadership skills through workshops, team-building events and listening to motivational
speakers. The program is structured around working and playing; so mornings are spent working on

to conference by volunteering at City events, attending weekly meetings at the Youth Center and
participating at regional events with other local PAL programs.

Economic Development Department
Multi-Generational Facility status update.
• City Council approved the final design and approved the project to go out to bid.
• 100%plans are under Staff review. Once complete, review comments will be forwarded to
Architect, revisions will be made and the Bid Set will be published. A bid schedule will be
developed and the Formal Bid Announcement will be made.
• Met with Sustainability Manager and Leisure Services Director to scope potential rooftop solar
program. Looked at mockup design and overviewed the system(e.g. roof loading psf/no
penetrations/ballasted system/rain water flow underneath panels/panels easily
removable/panels withstand 160 mph wind loads). Forwarded all information to Architects
RZK for analysis with the goal to make the solar roof part of the initial construction.
• The Planning and Zoning Board approved the Canaveral City Park Phase 1 redevelopment
plans at their June meeting.

cart usage. Forwarded applicable Statutes to resident.
• Corresponded with Ocean Woods Homeowners Association President. The North Buffer Zone
Maintenance Program is scheduled to start during the last week of July. The contractor will be
removing Brazilian Pepper Trees from the area. Abutting property owners have been notified.
The Brazilian Pepper Tree removal work will take approximately 5 weeks. For more

Warning Signs of Domestic Violence
It's not always easy to tell at the beginning of a relationship if it will become abusive. In fact,
many abusive partners may seem absolutely perfect in the early stages of a relationship. Possessive
and controlling behaviors don't always appear overnight, but rather emerge and intensify as the
relationship grows.
Domestic violence doesn't look the same in every relationship because every relationship is different.
But one thing most abusive relationships have in common is that the abusive partner does many
different kinds of things to have more power and control over their partner.
Some of the signs of an abusive relationship include a partner who:
• Tells you that you can never do anything right.
• Shows extreme jealousy of your friends and time spent away.
• Keeps you or discourages you from seeing friends or family members.
• Insults, demeans or shames you with put-downs.
• Controls every penny spent in the household.
• Takes your money or refuses to give you money for necessary expenses.
• Looks at you or acts in ways that scare you.

• Controls who you see, where you go, or what you do.
• Prevents you from making your own decisions.
• Tells you that you are a bad parent or threatens to harm or take away your children.
• Prevents you from working or attending school.
• Destroys your property or threatens to hurt or kill your pets.
• Intimidates you with guns, knives or other weapons.
• Pressures you to have sex when you don't want to or do things sexually you're not comfortable
with.
• Pressures you to use drugs or alcohol.
Experiencing even one or two of these behaviors in a relationship is a red flag that abuse may be
present. Remember, each type of abuse is serious, and no one deserves to experience abuse of any

19-00253934 While responding to a call at The Straw Hat business, contact was made
Arrest with Hakima Jones-Foster, W/F, 12/18/1975, who was causing a verbal
disturbance.
Jones-Foster continued to refuse to pay her tab and was disorderly, at which
time she was placed under arrest. After a brief struggle, Jones-Foster was
placed into handcuffs. She was charged with Defrauding Inn-Keeper, Resisting
Without Violence and Disorderly Intoxication.
19-00254165 Elijah S. Vedder, W.M, 12/25/1993, was trespassed from the Ocean Oaks
Trespass Condominiums.

Retail Theft Nicholas, B/M, 05/10/1993, was arrested for Resisting Arrest without Violence
while fleeing from a
retail theft and after being given multiple loud verbal commands to stop
running.
19-00260627 A traffic stop was conducted after the driver almost caused a traffic crash at
Habitual Traffic Central and N. Atlantic. Contact was made with the driver,Nichole Hanna,
Offender W/F, 10/22/1982, who advised she did have a license. After a query, it was
confirmed Hanna did not have a valid license and was labeled as a habitual
traffic offender. Hanna was arrested.
19-00260688 Deputies responded to the Golf N Gator, in reference to a fight in progress
Arrests between several people. After an investigation, Kevin Nguyen, A/M,
07/17/1995, was arrested on Two (2) Counts of Disorderly Intoxication,
Resisting Arrest without Violence and Possession of a Controlled Substance.
19-00261392 Tyler A. Klusek, B/M, 08/06/1999 and Joyce R. Wright, W/F, 12/08/2000,

Guess who just got a FOURTH Mobi-mat?!?A more inclusive ADA accessible beach is an
important part of the City of Cape Canaveral Vision Statement and wanted by so many residents
and visitors. This new Mobi-mat is located on the Ridgewood Avenue beach crossover (north of
