HomeMy WebLinkAboutMosh ARTICLE VI. - SOLID WASTE FRANCHISE AGREEMENT 2.45 Vegetative Waste: Shall mean any vegetative matter resulting from routine and normal yard and landscaping maintenance generated on site and shall include materials such as tree and shrub materials, grass clippings, palm fronds, Christmas trees, tree branches and similar vegetative matter usually produced in the care of lawns, landscaping and yards. Hired Contractors and Landscapers must haul away any vegetation debris they produce. ARTICLE II. - TREE PROTECTION DIVISION 1. - GENERALLY Secs. 102-26—102-35. - Reserved. DIVISION 2. - LAND CLEARING\[2\] Sec. 102-36. - Definitions. Vegetation means any plant material, including but not limited to trees, shrubs, vines, herbs and grasses. Sec. 34-122. - Public nuisances prohibited. (a) All grass areas and yards on improved property shall be properly maintained in a neat and attractive manner and kept free of dead plants, refuse, debris and shall be maintained further in a manner such that grass, weeds and other rank vegetation shall not exceed six inches in height. Sec. 34-96. - Standards established. (d) Exterior property areas of all premises shall be kept free of all nuisances, litter, rubbish, debris, objects, material or conditions which may create a health or fire hazard. Exterior property areas shall be free of unsanitary conditions which constitute a blighting or deteriorating influence on the neighborhood. Lawns, landscaping, driveways and fences shall be maintained so as not to constitute a blighting or deteriorating effect in the neighborhood. Sec. 34-97. - Duties and responsibilities for maintenance. (a) The owner of every single-family or multiple-family dwelling, commercial or industrial property, his appointed agent and the occupant, operator, tenant or anyone otherwise using the property in any form or manner shall maintain the premises free of hazards which include but are not limited to: (1) Brush, weeds, broken glass, stumps, roots, obnoxious growths, accumulations of filth, garbage, trash, refuse, debris and inoperative machinery. Rubbish means nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery and similar materials. Chapter 62 - SOLID WASTE Sec. 62-11. - Unlawful acts. (d) Unlawful accumulation. It shall be unlawful for the owner, resident, occupant or manager or person responsible for any land or premises to permit, suffer or allow, either by commission or omission, any accumulation of solid waste upon premises or property within the city for a period longer than four days without having arranged for disposal of the accumulation by the collector to perform such services and it shall be unlawful and a violation of this chapter for any person, whether owner, resident, manager or occupant of any premises to fail to provide a sufficient number of solid waste containers per unit as provided in this chapter to amply provide for any four-day period of solid waste accumulation. Nothing contained in this section shall prevent the owner or occupant, resident, manager or person responsible for the premises to remove accumulations of solid waste on their own behalf, to a proper place of disposal. Solid waste means bulk trash, refuse, vegetative waste, and recyclable materials or any combination thereof.
