Please see the attached letter of non-violation as it relates to your
spillover lighting complaint. We tested it according to the City
ordinance requirements and at the stated location of your complaint.
From performing our site visit and reviewing your photos it appears to
be glare/direct glare from the building illumination lights.
Unfortunately our ordinance does not address the issue of glare or
direct glare at this time as that seems to be the problem. As to using
Section 94-63, I interpret that section to relate to sign lights only
and not building illumination lights. Hopefully we can make changes in
our ordinance to adopt a section for glare. Please feel free to contact
me if you would like any additional information.

Mr. Palmer,
Thank you for the invitation to observe the spillover lighting test on
Tuesday evening. I’m confident about the City’s ability to conduct the
test now that the equipment is properly calibrated, and will probably
not attend. Moreover, as previously noted, I believe that Sec. 94-63 of
the city ordinances more directly addresses our lighting issue, so our
concerns will likely not be resolved by this test. To aid in determining
compliance (or lack thereof) with that section, I invite you and anyone
else involved in the lighting issue, including any Beachwave
representative, to visit my condo after you complete the test so you can
observe firsthand how the floodlights are actually affecting us. Just
give me a heads up at (321) 783-3909. Our address is 8924 Puerto Del
Rio Drive, Unit 504; it’s the second building on the left after you
enter the complex. Our call box code is 010.
