A few technical amendments were made to the definition of sign and right of way. Also, section 110-651 was amended to provide a more detailed definition of window display area and clarifies that window signs are also permitted within that area subject to the 25% maximum glass contact rule. First, the existing “window display areas” are three feet deep, but only extend up approximately 8 – 9 feet. Does that allow Mosh to use the entire 15 feet? The towels are intended to be in the display area, but they are closer than 3 feet. In other words, what defines the display area? As to the display area, so long as the towels are not “affixed to” the window, please confirm that they are not considered “window signs”. The general definition of “window sign” appears to be in conflict with the more specific explanation of window sign in Sec. 110-651(1)(d) If a towel is displayed in a window that is not in a “window display area”, is it considered a “sign” a “window sign”, neither or both? Please respond by email or telephone tomorrow before 2:00, if possible, as I will be in court after that time.
