I’m trying to narrow down the perceived areas of uncertainty in the
proposed sign code.
I hope this helps.
1. The sign ordinance exempts window signs affixed to the glass as
long as they are compliant with the 25% or less caveat.
2. Window display items are signs. I.e. a visible
towel/surfboard/etc. is a sign.
3. Window displays and window signs cannot exceed 15 ft. in height.
They must be placed in an area wich is at least 3 ft. deep.
4. In the EOOD, if a window display item is touching the glass it
is included in the calculation of the 25% regulation. If it is not
touching the glass, the window display item is unregulated.
Potential area of uncertainty:
We provide a revised definition of window sign:
“any sign affixed to, in contact with or placed in the interior or
exterior windows of a structure, and which can be viewed from the
outside of the structure.”
This appears to include window display items. Which begs the question:
In areas of the City which are not in the EOOD, how are window display
items regulated?
Perhaps it would be helpful to provide separate definitions for “window
sign’ and “window display”.
In that case, we could include a regulation for non-EOOD locations
which equated window displays with window signs. This would follow the
general intent that the EOOD encourages displays, and they are not
generally encouraged in non-EOOD areas. Since no one favors the idea of
staff measuring the outline of each mannequin on display, we could
include a measuring technique in the definition of window display:
“The calculation for window display items, if permitted hereunder,
shall be comprised of one grouping of all window display items, and
shall be calculated within the smallest regular geometric figure needed
to encompass the grouping of the window display items.”

Yes, that is the spirit and intent of our discussion. I believe
the number we derived was 13 ft 6 inches.
The intent is to get you up to the second bar (or muntin) but
not higher.
I’ll move ahead with this understanding and keep you posted.

This is a response to our discussion yesterday.
I agree to compromise on the window signs. You said that you are
willing to change the code from 10 ft to 13 ft and some (don’t remember
the inches) I will be willing to agree to 14ft even, reason being is I
don’t want a few inches difference on the side walk elevation to put me
in violation, I feel much more comfortable to have a few inches for a
buffer.
Like you stated yesterday the proposed code will have NO
RISTRICTIONS on what I could display in the 13ft for example mannequins,
towels, floats, lettering ect, and there will be no game of words and no
other code that will contradicts this code. You also said that Kim could
be involved in the draft of the new proposed ordinance.
Please confirm that this is what you are agreeing to.
