HomeMy WebLinkAboutNullification of Citation WarningMosh, I have reviewed the City of Cape Canaveral Code Enforcement Citation Warning #701 written to Christopher R. Gumm on May 4, 2014 (attached) and have determined that the warning should be nullified. The facts used in making this determination: 1. The original complaint indicated a violation of our noise ordinance after 11:00PM, 2. The Code Enforcement Office requested the Brevard County Sherriff’s Office investigate for an alleged violation “after hours”, and 3. The Citation warning indicates the time of violation as 9:00PM. Although any noise disrupting the peace and comfort of the community could potentially be in violation of City code section 34-153 (attached), the intent, in this case, was to limit the scope of the investigation to alleged noise being made after 11:00PM, as referenced in City Code section 34-153(2).
