Just wanted to point out a few things we discussed last time we meet. · Each party shall be responsible for their portion of the driveway · No party shall have any conditions for the easement (besides standard legal language) · Racetrack will allow me to relocate the tree on the south east corner or plant a new tree instead. As we discussed, the City is very interested in a “frontage access easement” through your property to W. Central Blvd. Public Safety will be enhanced by encouraging/allowing vehicular traffic from Burger King, through the RaceTrac property and yours to connect to W. Central Blvd. We have had preliminary discussions with RaceTrac and they appear to be in agreement. Their approvals will soon go before the Board with a Staff recommendation that they record a similar easement. Assuming the RaceTrac easement becomes a reality, we would be in favor of negotiating with you toward a Development Agreement that would allow your mixed-use project to be developed along with the engineered parking evaluation you submitted last year. Naturally, it would be in our mutual interest to ensure the RaceTrac easement occurs prior to any commitments. We look forward to discussing this with you in the near future.
