Request #2 — Size Variance for Ground Signs - To allow a size variance for two (2) ground signs located on comer lot to have a total of 205 square feet rather than the maximum 150 square feet per section 94-64(c). Applicant: Kim Rezanka Owner of property: Xtreme Fun, LLC Subject property: Beachwave Complex, 8801 Astronaut Blvd. (formerly the Traxx Fun Center). Future Land Use and Zoning designation: C-1, Commercial Surrounding zoning and uses: Zoning North C-1, Commercial East C-2, Commercial South C-1, Commercial West R-3, Residential Use RaosTrac Gas Station Sheldon Cove building Zachary's Restaurant Vacant parcel, future ALF site Summary: Request #1 - The owner is constructing a retail building that will have three (3) tenant spaces, to be occupied by a Beachwave beach wear & souvenir store, a games arcade, and a restaurant. See attached building floor plan for identification of tenant spaces. The code allows for two (2) wall signs per storefrontitenant space. The owner desires to have three (3) wall signs on the Beachwave storefront (tenant space #1) and is therefore requesting a variance to locate one of the wall signs for the arcade (tenant space #2) on the front of the Beachwave store (tenant space #1). See attached Variance Worksheet for applicant's response to criteria by which variance requests are evaluated. 1 Aj�� dem Request #2 — The Code allows for a typical commercial parcel to have a ground sign with a sign area of 150 square feet. Comer lots are allowed two ground signs, one on the primary road frontage and another on the secondary frontage. However, on comer lots, the total sign area of both signs together cannot exceed 150 square feet. The owner wants to have a sign on the primary frontage, SR AIA, of 150sf in size and another sign on Central Blvd. 55 sf in size. See attached Variance Worksheet. Staff' Recommendation to Board of Adjustment: Request #1 — Staff recommends approval as the amount of signage is in proportion with the size of the building and matches the particular architectural design of the building. Request #2 — Staff recommends approval. That special conditions and circumstances exist which are unique to the land, structure or building involved and are not applicable to other lands, buildings, or structures in the same district. The design of building allows for three tenant spaces, but only two have frontage along A1A. The Tenant Space #2 faces W. Central Blvd., and has limited visibility form A1A. The variance to allow the a wall sign available to Tenant Space #2 to be on the frontage of the building facing A1A provides that space with necessary visibility. In fact, the building facade along A1A is designed to allow uniform and symmetrical signage, to make the building fagade more visually appealing. Additionally, the code is overly restrictive and ambiguous, and other buildings in Cape Canaveral are allowed more wall signs than appear to be provided for in the City Code. 2. That literal interpretation of the provisions of the zoning ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district and would work unnecessary and undue hardship on the applicant. The City Code not drafted to address a multi -tenant building with this configuration and use of space. Most units in a multi -tenant building have storefronts that face the primary frontage; this building has one unit that does not face A1A and therefore does not have wall signage available to be seen from the primary frontage. 3. That the special conditions and circumstances referred to in item (1) above do not result from the action of the applicant The building was designed to meet conditions of the site and not criteria of the Sign Code. 4. That granting the Variance requested will not confer on the applicant any special privileges that are denied by the ordinance to other lands, structures, or buildings in the same district Other buildings are not configured like the Beachwave building and are not denied any special privileges. 5. That the reasons set forth in the application justify the granting of the Variance, and that the Variance, if granted, is the minimum that would make possible use of the land, building or structure. . 9 The Variance is the minimum necessary to accommodate the desired sign for Tenant Space #2. 6. That the granting of the Variance will be in harmony with the general intent and purpose of the zoning code will not be injurious to the neighborhood, or otherwise detrimental to the public welfare. The granting of this location Variance will be in harmony with the intent and purpose of the zoning code, will make the building more visually appealing, will allow proper signage for the tenant space that does not have frontage along AllA, and will not be injurious or detrimental to the neighborhood or public welfare. City of Cape Canaveral VARIANCE Application & Worksheet (2) Size Variance for Ground Sian: To allow for a corner lot to have two ground signs with a total of 205 square feet instead of 150 square feet, per Sec. 94-6(c), 94-99 and 94-100. 1. That special conditions and circumstances exist which are unique to the land, structure or building involved and are not applicable to other lands, buildings, or structures in the same district. There are multiple businesses on the property that are not all located in the same building. While the office for the "putt -putt" is in the Beachwave building, the "putt -putt" functions as a separate business from the Beachwave building. The City Code does not address this situation. 2. That literal interpretation of the provisions of the zoning ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district and would work unnecessary and undue hardship on the applicant. This is a comer lot and the code allows for less sign area on a corner lot than a lot with two street frontages. For example a comer lot can have two signs, one on each street front, but the total sign area for both signs cannot exceed 150 sf in area. However, a lot with two street frontages that is not a corner lot can potentially have up to twice the sign area. The Sign Code is ambiguous and leads to unequal application. If a comer lot chooses to have two signs it is denied the ability to have the maximum amount of signage on the primary frontage and therefore cannot have the same sign area that other lots enjoy. 3. That the special conditions and circumstances referred to in item (1) above do not result from the action of the applicant. The applicant could do a lot split and create a separate lot for the putt -putt. This would potentially allow for four (4) ground signs — two (2) on A1A and two(2) on W. Central Blvd. - rather than the two desired by the applicant. 4. That granting the Variance requested will not confer on the applicant any special privileges that are denied by the ordinance to other lands, structures, or buildings in the same district. This will not confer privileges that are denied to other similarly situated lots in the same district because applicant could split the lot. Additionally, if a corner lot has two signs, the code denies comer lots the same sign area on the primary street frontage that other lots enjoy. S. That the reasons set forth in the application justify the granting of the Variance, and that the Variance, if granted, is the minimum that would make possible use of the land, building or structure. The reasons justify the variance and the requested variance is the minimum to accommodate the desired sign on W. Central Blvd. 6. That the granting of the Variance will be in harmony with the general intent and purpose of the zoning code will not be injurious to the neighborhood, or otherwise detrimental to the public welfare.
