Included in this packet is the site plan set for the Beachwave Complex dated June 12,
2012. This is the third submittal of the plans. The Beachwave Complex will be
constructed on the Jungle Village/Traxx property located at the northwest corner of SR
AlA and W. Central Blvd. Included in the packet is the applicant's response to staff
comments for the second submittal. Also, comments regarding the third submittal from
the City Engineer, Public Works, and the Building Official are included. My comment for
the third submittal is the same as for the second submittal. Please review the plans and
be prepared to make a recommendation to Staff.
The Special Exception Request by Yogi Patel for commercial storage or parking of
recreational vehicles, trailers, and trailerable items that was originally scheduled for
June 13, 2012 is on the agenda for this meeting.

A Special Meeting of the Planning & Zoning Board was held on Monday, June
City Public Library, 201 Polk Avenue, Cape Canaveral, Florida. The meeting

OLD BUSINESS
1. Recommendation to City Council Re: Proposed Ordinance No. 11-2012 - Adoption of the
Al Economic Opportunity Overlay District.
Barry Brown advised that Staff made all the revisions, as recommended by the Board at the last
meeting, to the AIA Economic Opportunity Overlay District (EOOD) draft.
The Board reviewed each page of the revised EOOD draft. Comments and/or recommendations
for additional changes were as follows:
Line 307 - Shared Parking - Discussion was held regarding parking for residential being
separate and distinct from commercial parking by having gated and secured parking. Donald
Dunn and Ron Friedman agreed that the wording should be changed to allow for shared
commercial parking, not commercial and residential shared parking. Barry Brown advised that
when the City is working with a developer and negotiating a Development Agreement that is
when parking for that development will be addressed. By consensus, Harry Pearson, Lamar
Russell and John Fredrickson were against changing the wording.
Line 340 - Section 110-605 - Discussion was held regarding which City Official has the authority
to render interpretations of the Code. By unanimous consensus, delete the first sentence.

Line 369 - Land Use Matrix - Barry Brown requested an addition to the Land Use Matrix. He
advised that he met with a potential new tenant of the former United Space Alliance building
located at 8550 Astronaut Boulevard. He stated that the business would entail similar uses of
the previous tenant, with additional uses which included contracts that would support the
commercial space operations as well as other commercial activities; maintenance, repair and
overhaul of vehicle spacecraft, aircraft parts, etc. They also plan on introducing environmental
testing and life critical system environmental testing including space, aviation, and
transportation. Chairperson Russell pointed out that those types of uses were already included
in the matrix category of High tech/light manufacturing. The Board members agreed that no
addition to the matrix was necessary.
Section 110-624 - Building Height:
• Line 425 - Donald Dunn questioned what the standard was for "certified wood".
Following discussion the Board agreed not to change the wording.
• Line 445 - Motion by Harry Pearson to delete Section 110-624 - Building height in its
entirety. Motion failed for lack of a second.
• Line 449 - Motion by Ron Friedman, seconded by Donald Dunn to remove the words "or
45 feet". Motion carried by a (4) to (1) vote with members voting as follows: Donald
Dunn, for; John Fredrickson, for; Ronald Friedman, for; Harry Pearson, against; Lamar
Russell, for.
• Line 450 - Motion by Donald Dunn, seconded by Ron Friedman to remove the words "or
45 feet'. Motion carried by a (3) to (2) vote with members voting as follows: Donald
Dunn, for; John Fredrickson, for; Ronald Friedman, for; Harry Pearson, against; and
Lamar Russell, against.
• Line 451 - Motion by Donald Dunn, seconded by Ronald Friedman to remove the words
"or 65 feet'. Motion carried unanimously.
Line 510 - Section 110-629 b. - Discussion was held regarding screening of roof -top mechanical
equipment from both street -level view and residential view looking down onto the roof -top.
Contractors spoke to the Board about different ways of screening roof -top mechanical
equipment.
Line 652 - Section 110-651 h. - Donald Dunn did not agree that tinted glass reduces glare. He
made a motion to remove the words "unnecessary reflection". Motion failed for lack of a
second.
Line 659 - Section 110-652 b. - Donald Dunn questioned the wording of this sentence.
Discussion followed regarding commercial businesses not being allowed to store inventory in
display windows. Motion by Lamar Russell, seconded by John Fredrickson to leave the wording
of the sentence as written. Motion carried by a (3) to (2) vote with members voting as follows:
Donald Dunn, against; John Fredrickson, for; Ronald Friedman, for; Harry Pearson, against; and
Lamar Russell, for.

Line 725 - Section 110-670 - Shared Parking - Donald Dunn commented that residents should
not need to drive around looking for a parking space.
Section 110-687 - Project Perimeter:
• Line 852 - Ron Friedman questioned why Staff changed the landscape area requirement
from 8 feet to 5 feet? He commented that the more landscape provided the better.
Motion by Ron Friedman, seconded by John Fredrickson to change the landscape
requirement back to 8 feet. Vote on the motion carried unanimously.
• Line 886 - By unanimous consensus, the Board agreed to change 5 feet back to 8 feet.
• Barry Brown explained that Staff changed the landscape buffer from 8 feet to 5 feet to
keep the requirement consistent with landscape buffering around the perimeter of
parking lots.
• Motion by Lamar Russell, seconded by Harry Pearson to return the minimum landscape
depth described in lines 852 and 886 back to 5 feet. Motion carried by a (3) to (2) vote
with members voting as follows: Donald Dunn, against; John Fredrickson, for; Ronald
Friedman, against; Harry Pearson, for; and Lamar Russell, for.
Line 903 - Section 110-701 - Intent - Donald Dunn commented that it is important for signage to
be integrated. Following brief discussion, by unanimous consensus, the Board agreed that
signage shall be integrated with overall building design.
Lines 938 & 939 - Section 110-702 n. - Signs - Ron Friedman suggested that rather than striking
the sentence, the words "cruise ship parking" should be changed to "stationary parking."
Assistant City Attorney, Kate Latorre responded that signage is already addressed in Chapter
94 of the Code.
The Board concluded its review, discussion and recommendation for additional changes.
Barry Brown stated that Staff created a process for Planned Developments. He explained the
process and reviewed the Planned Development Zoning Review Process Flowcharts which
describes the text in Article XI - Planned Developments. During discussion, some of the Board
members made minor suggestions to modify the Flowchart.
Tom Hermanssen, Hotelier spoke about a 1.7 acre parcel located at the northwest end of the
City limits. He asked if the City considered including the property in the EOOD. Barry Brown
answered that the property is depicted on the City's Future Land Use Map as Conservation
Area, the City did not anticipate on changing that designation or currently in the position to do a
Comprehensive Plan Amendment for that 1.7 acre parcel.
Donald Haynes, Property Owner stated that he was not notified of the EOOD. He described his
property as three acres, undeveloped, located in the C-1 zoning district, surrounded by
residential use, located on the West end of Oak Lane and East of the Canaveral River. For the
purpose of flexibility to develop his property in the future, he respectfully requested that the
Board consider that his property be located within the EOOD. Discussion followed.

Motion by Ron Friedman, seconded by Donald Dunn to change the EOOD map to include Mr.
Haynes' property located on West end of Oak Lane. Motion carried by a (4) to (1) vote with
members voting as follows: Donald Dunn, for; John Fredrickson, for; Ronald Friedman, for;
Harry Pearson, against; and Lamar Russell, for.
Motion by Donald Dunn, seconded by John Fredrickson to recommend that Council approve
Proposed Ordinance No. 11-2012, Adoption of the Al Economic Opportunity Overlay District,
as amended tonight. Motion carried by a (4) to (1) vote with members voting as follows: Donald
Dunn, for; John Fredrickson, for; Ronald Friedman, for; Harry Pearson, against; and Lamar
Russell, for.
Harry Pearson announced that he was no longer a member on the Transportation Planning
Organization's (TPO) Citizen Advisory Committee for the North beaches. He advised that the
City's Public Works Director, Jeff Ratliff is a member of the TPO Technical Advisory Committee.
Barry Brown announced that last Friday was supposed to be the kick-off meeting for the SR
A1A Multi -Modal Feasibility Study/Action Plan. However, due to the fact that FDOT and the
selected consultant had not finalized a contract the meeting was postponed to Wednesday,
June 13, 2012. He will email the meeting notice to the P & Z Board members.
John Fredrickson thanked Barry and his Staff for providing a very comprehensive strikethrough
and highlighted version of the EOOD. He recognized that the property owners, developers, and
hotelers in the audience seemed acceptant of the EOOD document.
There being no further business the meeting adjourned at 9:10 p.m.

STAFF REPORT
Request: For a Special Exception to allow for the storage or parking of recreational
vehicles, trailers, and trailerable items at 6850 No. Atlantic Av. per Section 110-
334(c)(11).
Applicant and Owner of property: Yogi Patel
Subject property: 6850 No. Atlantic Avenue; the property and buildings house Yogi's
Liquor Shop, Yogi's Food and Discount Beverage, and Tip -a -Few Tavern and Bistro.
Future Land Use and Zoning designation: C-1, Commercial
Surrounding zoning:
North —C-1, Commercial
East — Residential structures in C-1, Commercial
South — County Commercial Zoning

Summary
The applicant owns and operates Yogi's Liquor Shop and Yogi's Food and Discount
Beverage, and owns the building that houses Tip -A -Few Tavern and Bistro. The
subject property fronts SR Al A and runs from Johnson Ave. in the north to Grant Ave.
on the south. The applicant is requesting a Special Exception to operate a storage
facility on the vacant portion of his property which is to the rear of the buildings. The
code citation for this request is:
Section 110-334(c)(11).
Commercial establishments for the storage or parking of recreational vehicles, trailers and trailerable
items, provided it meets the following, as a minimum:
a. Minimum lot size of 10, 000 square feet.
b. Vehicle storage area must be obscured from view by either walls, fences or hedges.
c. Walls, fences and hedges must comply with all city rules and regulations and must be kept in
good condition so as to ensure obstruction from view.
The two most important issues to be considered are screening of the storage area from
view and access to the storage area:
Screening - the area proposed for the storage of vehicles is enclosed by a wooden
fence, most of which is six feet in height, with the exception of the portion along Grant
Avenue which is 4 ft. in height (see aerial depicting existing fence location). A variance
request to allow for a 6 ft. high fence within 25ft. of the right-of-way accompanies the
Special Exception request. The variance will allow for the fence to be 6ft in height along
the street frontage without having to be setback 25 ft. from the right-of-way.
Access- it is important that vehicles do not stop in the street while opening and closing
the locked gate. Therefore the gate should be setback far enough on the property to
allow a tow vehicle and trailer to park on the property while the gate is being opened or
closed. It appears the best opportunity to accommodate an on-site driveway is to
access the storage area from Johnson Ave. on the north. This will entail reducing the
width of the dumpster enclosure or relocating the dumpster entirely to provide a
driveway wide and long enough to accommodate a tow vehicle and trailer on the
property.
The Building Official's review comments are attached and they address provision of
protective barriers for mechanical equipment and verification that the overhead
electrical service -drop conductors are a least 18 ft. above grade.
Special Exception Worksheet and Staff Analysis
All special exceptionrecommendations and final decisions shall be based on the following
criteria to the extent applicable:
Land Use and Zoninq
Is the requested SE consistent with the intent of the Comprehensive Plan?
Yes, C-1 Commercial land use classification allows for all C-1 Commercial Zoning District uses.
Is the requested SE consistent with the intent of the zoning district in which it is sought?
Yes, commercial establishment for the storage or parking of recreational vehicles, trailers, and
traderable items is a Special Exception use in C-1 Commercial.
Will the SE meet all the requirements of the zoning district in which the request is to be
located, such as: lot requirements, building setbacks, lot coverage, height, buffers, off-
street parking, signs, storage, landscaping, etc.? Yes.
Impact to surrounding properties
Is the proposed special exception compatible and harmonious with properties and uses
in the surrounding area? Explain why. Yes, if the storage area is properly screened from
view. This is a commercial area along A1A.
Will the scale and intensity of the proposed special exception be compatible and
harmonious with adjacent land uses? Yes, if properly screened.
Will the traffic generated, volume and type, adversely impact land use activities in the
immediate vicinity? No.
Will the proposed special exception create any adverse impacts to other properties in the
surrounding area? Address the creation of noise, light, vibration, odor, stormwater
runoff, or other offsite impacts that would not have been created had the property been
developed as a principle use? No.
Will there be adequate screening, buffers, landscaping, open space, off-street parking,
other similar site improvements to mitigate any adverse impacts of the SE? There will be
some visual impacts, fences and landscaping can mitigate these impacts.
Will the size and shape of the site, the proposed access, internal circulation, and design
enhancements be adequate to accommodate the proposed scale and intensity of the SE
requested? Yes.
Are signs and exterior lighting designed and located so as to promote traffic safety and
to minimize any undue glare or incompatibility with adjoining properties? Yes.
What are the hours of operation and how will they impact surrounding properties? The
applicant will discuss this with the P&Z Board.
Traffic and Parking
Is there adequate off-street parking?Yes.
Is there adequate ingress and egress, with particular reference to auto and pedestrian
safety and convenience, traffic flow, and emergency access?
Yes.
What type and how much traffic will the SE generate? Nominal amount, just patrons of the
storage facility.
Are there adequate loading and unloading areas? The project can be designed to provide
adequate areas to park while opening and closing the gate.
Public Services
Are adequate utilities available? Location and capacity.Yes.
Will the proposed special exception create any unusual demand for police, fire, or
emergency services? No.
Will the proposed Special Exception have an adverse impact on public services,
including water, sewer, surface water management, parks and recreation, streets, public
transportation, marina and waterways, and bicycle and pedestrian facilities?No.
Is there adequate refuse facility for the use and is the dumpster properly located and
screened? Yes.
Miscellaneous Impacts
Will the proposed SE have an adverse impact on the natural environment, including air,
water, and noise pollution, vegetation, wildlife, open space, noxious and desirable
vegetation, and flood hazards? No.
Will the proposed SE have an adverse impact on historic, scenic, and cultural resources,
including views and vistas, and loss or degradation of cultural and historic resources.
No.
Will the proposed SE have an adverse impact on the local economy, including
governmental fiscal impact, employment and property values? No.
Will the proposed special exception will have an adverse impact on housing and social
conditions, including a variety of housing unit types and prices, and neighborhood
quality. No.
Staff Recommendation to the Planning and Zoning Board
Staff recommends approval of the requested Special Exception with the following
conditions: 1) provide a fence a minimum of 6 ft. in height around the entire perimeter of
the storage area, 2) locate the fence along Grant Ave. 6 ft. back from the sidewalk so
that the existing palm trees will be on the outside of the fence, and 3) access to the site
shall be from Johnson Ave. and a driveway shall be constructed on the property a
minimum of 45 ft. in length. See attached aerial that depicts the location of the fence,
location of the gate, and driveway.

Building Code and have the following comments:
1. FL Bldg. Code — Mechanical See. 303.4. Provide approved protective barriers for Mechanical appliances

• Public Works Services has reviewed the Beachwave Complex Site Plan 2nd
submittal and has the following comments:
RESPONSE: Below.are responses to the comments issued.
1. A traffic study has not yet been submitted — the traffic study is required to meet
concurrency requirements.
RESPONSE: Traffic study was included in the last submittal.
2. Drainage calculations did not include analysis for storms larger than the 25 -year
storm event. Results of modeling for the 25 -year storm event indicate that the
retention basin would be near capacity. Any storm event more severe that the
25 -year storm event would most likely cause flooding of property and adjacent
properties.
RESPONSE: Drainage calculations are based on criteria from SJWRMD. Pond
discharges into Central Boulevard Drainage System.
3. Further review of the project will be conducted during the permitting process and
construction for compliance of all local and state codes. The Engineer — of —
Record is responsible for any requirements not identified by the City.

spaces, comprised of 96 regular parking spaces and four ADA Accessible parking spaces.
However, the site plan count indicates there will be a total of 102 parking spaces. T208.2
FBC — Accessiblity, below, derives the total number of accessible spaces as a function of
the total spaces provided.
RESPONSE: Two parking spaces have been removed in the Southwest corner of the site.

RESPONSE: Acknowledged. See the responses to comments below:
1. Drainage calculations have used a unit hydrograph of 484. Typically SJRWMD requires
unit hydrograph. City will accept SJRWMD permit if calculations sealed by engineer.
RESPONSE: Acknowledged.
5. On Sheet C-4 the storm discharges for DS -1 may be impacted by control elevation 6.0
(especially for multiple summer storms). The "bubble up" design can impact hydraulic
gradients on upstream inlets. If this system is to be constructed please provide hydraulic
gradient calculations.
RESPONSE: DS -1 has been removed and pipe has been extended directly to pond.
11. It appears the swale between Beachwave and the golf course will be wet with higher
stages in the retention pond. (Phase 2 will culvert this system.
RESPONSE: Acknowledged.
14. No hydraulic grade calculations provided (See comment 5 above).
RESPONSE: Additional drainage calculations are attached.
15. See comment 11, above.

16. Need to show 100 year storm elevation in retention basin to confirm no overtopping of
western berm (at elevation 7) will occur. (May require higher H. W. berms to protect
offsite properties.

20. The 100 year storm elevation as not provided.

21. The western driveway grading appears to show trapped storm water. Please check

22. Please note the truncated domes do not adhere well to asphalt. Check with City Public

23. Please confirm existing gas line will not be impacted by proposed connection swale in
FDOT right of way at northeast. corner. Also, please show proposed erosion protection
for this connection swale. Finally, check drop off from sidewalk as rail may be required

Remaining responses to SSA review:
14. Still no hydraulic grade calculations. One item of concern for this is the retention pond has a 25 -year
peak elevation of 6.8 with a northern and western grade area of'7.0. The 216 I.f. of outfall pipe has
inverts of 3.75 to 3.60, a .15 drop or 0.07% slope. The peak discharges of 11.7 cfs (25 -yr) cannot
flow thru this pipe and grade, causing a higher upstream elevation. Also, the 14 x 23 outfall culvert
ties into a 15" existing pipe. These conditions can also result in a higher stage in the pond and
discharges flowing over elevation 7.0 on the western offsite properties which show on your drawings
below 6.0.
Suggestion: It may be necessary to have at least a ten foot gradual area (or berm) of elevation 8.0
around the north and western retention pond.
16. The additional calculations attached show adequate storm volumes can be retained on site. They do
not show peak stone stages of' 100 year storms that could pond on neighborhood properties. See
suggestion in comment 14, above.
Clarification Comment: Is the 60 Lf. of 12" ADS coming east out of DS 10 being removed? Note: City's
minimum culvert size is 15".

The Beachwave Complex Site Plan Set dated August 20, 2012 is granted approval with the
following conditions:
1. Obtain FDOT State Highway Access Connection permit and stormwater drainage permit.
2. Submission of 5 copies of revised site plan set to include revisions to drainage as agreed to by
City Engineer John Pekar and Public Works Director Jeff Ratliff. Plans shall also depict solution
to stormwater drainage issue to be resolved with FDOT.
3. Provide executed At-Risk Acknowledgement Affidavit prior to any site work or construction.
Per section 110-223(i), the applicant shall have 90 days from the date of conditional site plan
approval to satisfy any such conditions and/or contingencies.
