1. Applicant interviews for Board Vacancy and recommendation to the City
Council — Currently there is one vacancy on the Planning & Zoning Board. At the
October 9, 2013 meeting, Jill Seale and Craig Kittleson were interviewed for the
vacancy. Mark Buddenhagen and Dianne Fellows will be interview at this meeting.
After the interviews, the Board will make a recommendation to the City Council for
appointment to the Board.
2. Site Plan for Dollar General Store — The Site Plan Set for a Dollar General Store at
6395 No. Atlantic Avenue (former Azteca Restaurant) has been reviewed by the
Development Review Committee and their comments are included. P&Z Board will
review the Plans and make recommendation to Staff.
3. Site Plan for Building #5 of Cape Caribe Resort — The Site Plan Set for Building
#5 of Cape Caribe Resort has been reviewed by the DRC and their comments are
included in the packet. P&Z Board will review the Plans and make recommendation to
Staff.
4. Amendment to Ordinance 03-2008- Request by Cape Caribe Resort to amend Ord.
No. 03-2008 to remove use restrictions from 1.2 acres of property zoned C-1
Commercial.
5. Special Exception Request No. 13-07 - For a Special Exception to allow for Outside
Display of merchandise at 8801 Astronaut Boulevard per Section 110-334(c)(8).

Subject: Request to revise Ord. No. 03-2008 to remove zoning restrictions to 1.2 acre
subject parcel.
Department: Community and Economic Development
Summary: In March of 2008, a 1.2 acre portion of the Cape Caribe Resort property was
rezoned from R-3 Residential to C-1 Commercial in order to accommodate expansion of
the pool and related amenities. Ordinance No. 03-2008 restricted the use of the 1.2
acre parcel to: 1) recreational amenities and 2) parking. Since that time, the economy
and market forces have caused Cape Caribe to reconsider product offerings and the
configuration of buildings on the property (the revised site plan for Building #5 is an
example). Accordingly, Cape Caribe is requesting that the restrictions on the use of this
parcel be removed so that the master plan can be revised and timeshare units located
in this area.
This ordinance revision is not necessary to accommodate construction of Building #5.
The requested ordinance revision will not result in additional density (more units), it
merely allows for a reallocation of units already approved per the Binding Developer's
Agreement adopted March 2010.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CAPE CANAVERAL, BREVARD COUNTY, FLORIDA;
AMENDING ORDINANCE NO. 03-2008 TO REPEAL THE
RESTRICTIONS OF THE REZONING IMPOSED THEREIN
ON CERTAIN REAL PROPERTY TOTALING 1.2 ACRES,
MORE OR LESS, GENERALLY LOCATED ALONG THE
NORTH SIDE OF SHOREWOOD DRIVE AT THE
SOUTHWEST CORNER OF JETTY PARK IN CAPE
CANAVERAL; PROVIDING FOR THE REPEAL OF PRIOR
INCONSISTENT ORDINANCES AND RESOLUTIONS;
SEVERABILITY; AND AN EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, Cape Caribe, Inc. is the current fee simple owner of record of certain real
property in Cape Canaveral, depicted and legally described in Exhibit "A," said Property being part
of the approved master site plan for the Ron Jon Cape Caribe Resort ("Property"); and
WHEREAS, the City Council adopted Ordinance No. 03-2008 on March 2, 2010, which
changed the zoning designation on the Property from "R-3 Medium Density Residential" to "C-1
Low Density Commercial," subject to certain restrictions limiting the use of the Property to
recreational amenities and parking; and
WHEREAS, Cape Caribe, Inc. desires have the rezoning restrictions on the Property
repealed so it may pursue revisions to the Ron Jon Cape Caribe Resort master site plan to address
changes in market demand that have occurred since the restrictions were implemented; and
WHEREAS, the City Council desires to repeal the rezoning restrictions applicable to the
Property pursuant to Ordinance No. 03-2008 as set forth herein; and
WHEREAS, the City Council of the City of Cape Canaveral, Florida, hereby finds this
Ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Cape
Canaveral.
NOW, THEREFORE, THE CITY OF CAPE CANAVERAL HEREBY ORDAINS AS
FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this
reference as legislative findings and the intent and purpose of the City Council of the City of Cape
Canaveral.

Section 2. Amendment to Ordinance No. 03-2008. The City Council of the City of
Cape Canaveral hereby amends Ordinance No. 03-2008 to repeal the rezoning restrictions set forth
in Section 3 applicable to the real property depicted and legally described in Exhibit "A," attached
hereto and fully incorporated herein by this reference ("Property"). The Property shall maintain its
"C-1 Low Density Commercial" zoning classification and shall be subject to all applicable
provisions of the City Code governing said classification. City staff shall promptly amend the City's
Official Zoning Map to remove any reference to the restrictions.
Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior
inconsistent ordinances and resolutions adopted by the City Council, or parts of prior ordinances and
resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 4. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section 5. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Council of the City of Cape Canaveral, Florida.

Summary
The owner has recently opened a retail establishment that sells beach wear and gear.
He desires to have 300sf of outside display area in front of the building (depicted on
drawing in attached application). Section 110-334(c)(8) of the Code allows for outside
display in accordance with certain criteria and pursuant to a Special Exception:
Section 110-334(c)(8).
Retail stores using outside display areas, provided the following are met:
a. The area of outside display shall not exceed in size one-third of the enclosed area of the
principal structure.
b. The outside display area shall be considered the same as the floor area for the purpose of
calculating offstreet parking, setbacks and lot coverage.

structure. Adequate off street parking has been provided to meet requirements of the

Nature of Special Exception
Describe what you are proposing to do and why. Describe in writing and prepare site plans,
architectural renderings, photos, etc. as necessary to fully describe the Special Exception
requested.
Xtreme Fun, LLC would like to have outdoor displays of merchandise in front of its retail store.
It is seeking 300 square feet of outdoor display area, as depicted on the attached renderings.
There will be 4 separate displays, two will be 5'x 20' and two will be 5' by 10'. The displays
will be on the 10' sidewalks adjacent to the building. The sidewalk would still be passable with
the remaining 5' of width.
Land Use and Zoning
Is the requested SE consistent with the intent of the Comprehensive Plan and the zoning
district in which it is sought? Yes.
Will the SE meet all the requirements of the zoning district in which the request is to be
located, such as: lot requirements, building setbacks, lot coverage, height, buffers, off-street
parking, signs, storage, landscaping, etc.? Yes. The outdoor displays will still meet all lot,
setbacks, lot coverage, landscaping and parking requirements.
Special Conditions for establishments serving alcoholic beverages
Is the establishment within 300 feet of any existing church, school ground, or playground?
N/A.
Is the establishment within 300 ft. of the mean high water line of the Atlantic Ocean or of the
Banana River? N/A.
Impact to surrounding properties
1. Is the proposed special exception compatible and harmonious with properties and uses in
the surrounding area? Explain why.
Yes it is compatible and harmonious. This is a commercial district and has all commercial
uses in the surrounding area. The Race Trac Gas Station next door has outdoor display of
merchandise as well. Additionally, the Ace Hardware nearby also has outdoor display of
merchandise.
2. Will the scale and intensity of the proposed special exception be compatible and
harmonious with adjacent land uses?
Yes, the scale and intensity is compatible and harmonious as it is only 300 square feet of
outdoor display adjacent to the 12, 000 square foot retail/stockroom space. Also, the
merchandise will be generally be two to four feet in height against a 25' tall wall with 17' tall
windows.
3. Will the traffic generated, volume and type, adversely impact land use activities in the
immediate vicinity?
This SE use will not increase traffic as it is still a retail use.
4. Will the proposed special exception create any adverse impacts to other properties in the
surrounding area? Address the creation of noise, light, vibration, odor, traffic, stormwater
runoff, or other offsite impacts.
This SE use will not create any adverse impacts to other properties as it is still a retail use and
it is all contained on Xtreme Fun's property.
5. Will there be adequate screening, buffers, landscaping, and open space, etc. to mitigate
any adverse impacts of the SE?
There will be adequate screening landscaping and open space to buffer any potential adverse
impacts of the outdoor display of merchandise.
6. Will the size and shape of the site, the proposed access, internal circulation, and design
enhancements be adequate to accommodate the proposed scale and intensity of the SE
requested?
The size, shape and design of the site are adequate to accommodate this SE use.
7. Are signs and exterior lighting designed and located so as to promote traffic safety and to
minimize any undue glare or incompatibility with adjoining properties?
There will be no additional signs, lighting or traffic concerns due to this SE use, nor are there
any compatibility issues with adjoining properties.
8. What are the hours of operation and how will they impact surrounding properties?
The hours of operation of the retail store are 9:00 a.m. to 11:00 p.m, and they will not impact
the surrounding properties as the hours of those commercial uses are comparable.
Traffic and Parking
9. Is there adequate off-street parking?
Yes, there are 99 parking spaces on site.
10. Is there adequate ingress and egress, with particular reference to auto and pedestrian
safety and convenience, traffic flow, and emergency access?
Yes, there is adequate ingress and egress for both autos, pedestrians and emergency needs.
11. What type and how much traffic will the SE generate?
This SE use will not increase traffic as it is still a retail use.
12. Are there adequate loading and unloading areas? Yes.

Yes, as this SE use does not increase the need for utilities.

emergency services?
No additional or unusual demands for police, fire or emergency services will be created by this
SE use.
15. Will the proposed Special Exception have an adverse impact on public services, including
water, sewer, surface water management, parks and recreation, streets, public transportation,
marina and waterways, and bicycle and pedestrian facilities?
This SE use will not have any adverse impacts on public services as it is fully contained within
the site and is simply a retail use.

screened?
Yes.
Miscellaneous Impacts
17. Will the proposed SE have an adverse impact on the natural environment, including air,
water, and noise pollution, vegetation, wildlife, open space, noxious and desirable vegetation,

There will be no adverse impacts on the natural environment as the outdoor merchandise will
be stationary and of a retail nature.
18. Will the proposed SE have an adverse impact on historic, scenic, and cultural resources,
including views and vistas, and loss or degradation of cultural and historic resources.
No. The outdoor display of merchandise will be adjacent to the existing retail use and will not
impact any views or vistas.
19. Will the proposed SE have an adverse impact on the local economy, including
governmental fiscal impact, employment and property values?
No. The outdoor display of merchandise will be adjacent to the existing retail use and adjacent
to other retail uses and it will not adversely impact the local economy or property values; it
should have a positive impact on the local economy.
20. Will the proposed special exception will have an adverse impact on housing and social
conditions, including a variety of housing unit types and prices, and neighborhood quality?
No. The outdoor display of merchandise will be adjacent to the existing retail use and adjacent
to other retail uses and it will not adversely impact housing and social conditions.

RE: SE Request for Outside Display of Merchandise— 8801 Astronaut Blvd.
Parldn : The application states the number of parking spaces available but does not state the
number of parking spaces required on site for all uses (retail + pizzeria + outside display, etc.).
Nature of Merchandise: The application needs to describe the nature of the merchandise intended
for outside display. This will enable Staff to independently verify whether the scale and intensity of
the use will be compatible and harmonious with adjacent land uses and that there will be no adverse
impacts.
