Mr. Gal agreed to repaint the fence red, green, and yellow. Discussion followed.
Motion by Ms. Moore, seconded by Ms. Troutman to approve Request No. OS-28 with the
modification that the fence be painted yellow, green, and red. Vote on the motion cazried
unanimously.
3. Request No OS-32 -Block Wall (Tip-A-Few) - 6890 N. Atlantic Ave. -Frank
Wisniski, Applicant.
Frank Wisniski, owner of Sunland General Contractors, presented the submittal and
photos for the proposed decorative block wall azound the front patio. Mr. Wisniski stated
that they would like to replace the railing with the decorative wall and paint it to match the
approved building colors; dessert breeze and robust vine. The Boazd reviewed the
submittal packet and photographs of the site. Brief discussion followed.
Motion by Ms. Moore, seconded by Ms. Trautman to approve Request No. 05-32 as
presented. Vote on the motion carried unanimously.
4. Request No. 05-33 -Fence - 374 Polk Ave. - Cazol Warner, Applicant.
Cazol Warner, property owner, presented the submittal and photos for the proposed fence.
Ms. Warner stated that two four-foot sections would be added, in the front, to the existing
fence in order to keep debris out of the yard. The Boazd reviewed the submittal packet
and photographs of the site. Brief discussion followed.
Motion by Ms. Moore, seconded by Ms. Troutman to approve Request No. OS-33 as
presented. Vote on the motion carried unanimously.
5. Election of Vice Chairperson.
Due to there being only three members present, Chairperson Hayes asked the Boazd; all in
favor of tabling the election item until the next meeting. All for.
There being no further business the meeting adjourned at 7:42 P.M.

20, 2005 at 7:00 p.m. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida.

1. Annroval of Meeting Minutes: June 6, 2005
Motion by Ms. Moore, seconded by Ms. Trautman to approve the meeting minutes of June
6, 2005, as written. Vote on the motion carried unanimously.
2. Request No. OS-28 -Fence/Go-Cart Disnlav- 8801 Astronaut Blvd. -David Gal,
Applicant.
Osha Gal, business owner, presented the submittal and photos for the existing fence colors
and the proposed go-cart display. Mr. Gal stated that the go-cart would be displayed on a
pole; 5'8" tall and would be located inside the fence. Mr. Gal further stated that the fence
was painted to improve the appeazance and the colors were chosen to attract the children.
Ms. Moore stated that the colors aze inappropriate for the entrance of the City. Ms. Moore
further stated that white or a single color would be more appropriate. Ms. Hayes stated
that the colors are in harmony with adjoining properties and with Mr. Gals property. Ms.
Hayes suggested that perhaps limiting the fence to three colors might be more agreeable.

Motion by Mr. Camomilli, seconded by Mr. Bruns to approve the meeting minutes of May

2. Request No. OS-27 - Townhomes (4-units) -Washington Ave. -All Shores
Construction. Annlicant.
Jim Morgan, owner of All Shores Construction, presented the submittal and photos for the
proposed townhomes. Mr. Morgan stated that the computer-generated picture was an
accurate depiction of the building, paint colors, and landscape. The Board reviewed the
submittal packet and photographs of the site. Discussion followed.
Motion by Mr. Camomilli, seconded by Mr. Bruns to approve Request No. OS-27 as
presented. Vote on the motion carried unanimously.

4. Request No OS-29 -Paint (Cape Car Washl - 104 Monroe Ave. -Dawn Heath,
Applicant.
Jerry Heath, property owner, presented photos and colors for the Board's review. Mr.
Heath stated that the building would be painted yellow with the trim in blue. Brief
discussion followed.
Motion by Mr. Camomilli, seconded by Mr. Wasserman to approve Request No. OS-29 as
presented. Vote on the motion carried unanimously.
5. Request No OS-30 -Sign (Titan) - 8660 Astronaut Blvd. -Arthur Ber er, Applicant.
Arthur Berger, property owner, presented submittal and photos for the proposed sign. Mr.
Berger stated that the submittal is accurate with the addition of the address numbers, 8660.
The Board reviewed the submittal packet and photographs of the site. Brief discussion
followed.
Motion by Mr. Bruns, seconded by Ms. Trautman to approve Request No. OS-30 with the
addition of the address numbers. Vote on the motion carried unanimously.
6. Request No. OS-31 -Sign (IAP Worldwide Services) - 7315 N. Atlantic Ave. -Judy
Mallette, Applicant.
Judy Mallette, representative for IAP Worldwide Services, presented submittal and photos
for the proposed sign. Ms. Mallette stated that the sign was existing, only the name and
the colors have changed. The Board reviewed the submittal packet and photographs of the
site. Brief discussion followed.
Motion by Mr. Bruns, seconded by Mr. Wasserman to approve Request No. OS-31 as
presented. Vote on the motion carried unanimously.

Sec. 94-31. Permit required.
(a) Except as otherwise provided in this chapter, it shall be unlawful for any person to
paint, erect, construct, enlazge, move or make structural alterations to any sign within the
city or cause such to be done without first obtaining a sign permit for each such sign From
the building official. This shall not be construed to require any permit for a change of
copy on a sign for the repainting, cleaning and other normal maintenance or repair of a
sign or structure for which a permit has been issued, so long as the sign or sign structure
is not modified in any way.
(b) A separate electrical permit shall be required for any sign containing electrical
components to be connected to an electrical energy source.
(c) No new permit is required for a sign which has a permit and which conforms with
this chapter on the date of its adoption. A new permit shall be required for any sign when
the structural configuration of electrical components is altered or when the sign is
relocated.
Sec. 34-96. Standards established.
(d) Exterior property areas of all premises shall be kept free of all nuisances, litter,
rubbish, debris, objects, material or conditions which may create a health or fire hazard.
Exterior property areas shall be free of unsanitary conditions which constitute a blighting
or deteriorating influence on the neighborhood. Lawns, landscaping, driveways and
® shall be maintained so as not to constitute a blighting or deteriorating effect in the
neighborhood.

musical instrum n ,television set, phonograph or other machine or device for the producing or
reproducing of ou din such a manner as to disturb the peace, quiet and comfort of the neighboring
residents at any ti a with louder volume than is necessary for the convenient hearing of the person who is
in the room, ve icl or immediate area in which such machine or device is being operated and who is a
voluntary listen r t ereto. The operation of any such radio receiving set, musical instrument, television set,
phonograph or th r machine or device for producing or reproducing sound between the hours of 11:00
p. m. and 7:00 a m. in such a manner as to be plainly audible at a distance of 100 feet from the building,
structure or veh cl in which it is located, shall be deemed prima facie evidence of a violation of this
section. ~

Bennett would like to see the City look at allowing "certain tasteful" murals within the City's sign code (the revisions are due
from the City Atty. soon).
The draft could be presented to the Council as early as June 7. If the Council likes it we will postpone the Traxx mural
issue until the dust settles.
As to the sign, I will call him and tell him that he inherited an unpermitted and sign and needs to get CAB approval and a
permit.
We will not double fee him. That wouldn't be fair.
The other issues will go the CAB.

Staff has received your correspondence dated March 21, 2005.
Staff's concerns aze as follows:
1. Mr. Gal was never cited under 34-96, "Standards Established". The Section
cited was Chapter 22, Section 40: which requires without exception any
appurtenances or alterations thereto, which have an exterior visual impact or
effect on the community must be approved by the Community Appearance
Board. The fence has a visual impact Astronaut Blvd. Mr. Gal must apply to
the Community Appearance Board for approval of the painting of his fence.
2. I have provided a copy of the submitted drawing of the sign face and permit
application for the permitted sign. If Mr. Gal has a copy of a permit and an
approved drawing for the existing sign, please provide for staff's review.

Dear Ms. Alexander:
I am in receipt of your letter to my client dated February 25, 2005.
My comments to your concerns are as follows:
1. Section 34-96 requires the property owner to maintain his fences in such a manner as not to constitute
a blighting or deteriorating effect in the neighborhood. I do not see any provision under the language cited by
you which requires my client to apply to the Community Appearance Board in order to paint the fence.
2. My client installed the same sign face and made no alterations or revisions thereto. As it is the same
sign face previously permitted, no permit should be required to reinstall same.
3. The temporary banner was removed.
4. The chazacters on my client's wall are not visible from the adjoining roadways. The buildings are
set back quite far from AlA and are not "intended to draw attention to a business, place, event, or attraction" as
they can only be seen after a customer enters the property. These works are therefore intended for the immediate
enjoyment of patrons who are already on the business premises.

REQUEST: Sec. 22-40 Approval prerequisite for permits
Chapter 22, Section 40; "Approval prerequisite for permits".
(a) Without exception, all plans, elevations, proposed signs for buildings or structures and exterior
building and roof colors within the C-1, C-2, and M-1 zoning districts, or alterations thereto, shall be
approved by the community appearance board, or by the city council under limited circumstances provided
in this article, before a permit is issued for any building, structure, sign or other development of property,
or appurtenances or alterations thereto, which have an exterior visual impactor effect on the community.
Chapter 93, Section 31; "Permit required".
(a) Except as otherwise provided in this chapter, it shall be unlawful for any person to paint, erect,
construct, enlarge, move or make structural alterations to any sign within the city or cause such to be done
without first obtaining a sign permit for each such sign from the building official.
Chapter 94, Section 1; Definition; Building art shall mean two and three dimensional murals, mosaics,
paintings and artistic applications, which are applied to buildings, structures and properties, intended to
draw attention to a business, place, event or attraction. Building art does not include the portion of a
building that is permitted to accommodate a wall sign. Chapter 94, Section 6; "Prohibited signs and
features".
k) Building art. Building art is strictly prohibited on the exterior of any building within the city.
1) You must apply to the Community Appearance Board for approval of the painting of your fence.
2) The replacement of sign faces requires a permit. All permits related to hurricane damage is at no
charge until April 8, 2005.
3) You must rem ve the temporary banner now that your ground sign has been repaired.
4) Building is prohibited on the exterior of any building per Chapter 94, Section 6, (k).
