A HEARING will be conducted before the City of Cape Canaveral Code Enforcement Board on July 21,
2016 at 6:00 p.m. or as soon thereafter as possible. The hearing will be held at the City of Cape Canaveral
Library, 201 Polk Avenue, Cape Canaveral, FL 32920.
The Code Enforcement Board will receive testimony and evidence at said hearing regarding the
violation(s) occurring upon the property of the Respondent(s) as set forth in the Notice of Violation.
attached as EXHIBIT "A" and shall make a determination as to whether such violation(s) is/are corrected
pursuant to Section 162.07, Florida Statutes, and Chapter 2, Article VI, of the City of Cape Canaveral
Code of Ordinances.
You are entitled to testify and present evidence and witnesses in defense at the hearing. Since the
proceedings of the Code Enforcement Board are legal in nature, you may wish to have legal counsel
attend the above referenced hearing.
The Code Enforcement Board may enter an Order requiring the owner of the Property to correct any
violation(s). This penalty, if not paid, will become a lien on the Property and any other personal or real
property owned by the Respondent(s) which can be satisfied by foreclosure and sale of said Property
and/or other personal or real property.
AN AGGRIEVED PARTY, INCLUDING THE CITY OF CAPE CANAVERAL, MAY APPEAL A
FINAL ADMINISTRATIVE ORDER OF THE CODE ENFORCEMENT BOARD TO THE CIRCUIT
COURT AS PROVIDED BY THE GENERAL LAW OF THE STATE OF EXECUTION OF THE
ORDER TO BE APPEALED. FURTHER, IF AN APPEAL IS FILED, THE AGGRIEVED PARTY
MAY MEED TO ENSURE THAT A VERBATIM RECORD OF THE BOARD'S HEARING IS MADE,

PURSUANT to Section 162.06, Florida Statutes, and Chapter 2 Article VI, of the City of Cape
Canaveral Code of Ordinances, the undersigned Code Enforcement Officer hereby gives notice
of violation(s) of the City of Cape Canaveral Code of Ordinances, as more specifically described
below. Respondent(s) is/are hereby notified that a corrective action(s) to cure the violation(s)
described below is/are to be voluntarily performed within ten (10) days.
In the event that the violations(s) is/are not corrected within the time period set forth above or
the violations(s) recur(s) even if the violations(s) is/are corrected at the time of hearing
Respondent(s) may be required to attend a hearing before the Code Enforcement Board for the
City of Cape Canaveral, and a penalty as provided below may be imposed.
The Code Enforcement Board may enter an order requiring the Respondent(s) to correct the
violation(s) and penalties may be assessed up to $250 per day for each first violation or up to
$500 per day for each repeat violation described in this notice until the violations(s) has/ have
been corrected. IF THE VIOLATION(S) IS/ARE CORRECTED WITHIN THE TIME PERIOD
REQUIRED, THE RESPONDENT(S) MUST IMMEDIATELY NOTIFY THE CODE
ENFORCMENT OFFICER AND REQUEST AN INSPECTION.

Staff received a complaint regarding a pile of vegetation located in the Xtreme Fun Mini Golf
parking lot and several dead trees located on the Xtreme Fun Mini Golf area. Staff attempted to
resolve the issue by sending email requests and leaving telephone messages. To date no action
has been taken to remove the vegetation, or the dead trees.
3. Description of Violation(s) at property: Section 34-96, (d), Standards established.
(d) Exterior property areas of all premises shall be kept free of all nuisances, litter, rubbish,
debris, objects, material or conditions, which may create a health, or fire hazard. Exterior
property areas shall be free of unsanitary conditions, which constitute a blighting or deteriorating
influence on the neighborhood.
Section 34-97, (a), 22 Duties and responsibilities for maintenance.
(a) The owner of every single-family or multiple -family dwelling, commercial or industrial
property, his appointed agent and the occupant, operator, tenant or anyone otherwise using the
property in any form or manner shall maintain the premises free of hazards, which include but
are not limited to:
(2) Dead or dying trees and limbs or other natural growth, which because of rotting, deterioration
or storm damage, constitute a hazard to persons in the vicinity thereof.
4. Recommendation(s) to correct the violation(s) described above:
• Remove the vegetation from the parking lot area.
• Submit a tree removal application and obtain a permit to remove the dead trees.
Failure to comply within ten (10) days from receipt of this Notice shall result in further action,
as outlined in the previous page(s) of this Notice of Violation.

I have been calling leaving messages and sending emails regarding the vegetation left in the parking at Xtreme
Fun LLC with no response. As a Code Enforcement Officer for the City I always try to resolve citizen
complaints in a timely manner by contacting the property owner. I hope that you will either response to my
email, or have the debris removed as soon as possible.
I know you must have more important issues you are dealing with at this time, however, I am being questioned
on why this has not been resolved. Please let me know if you plan on having the debris removed.

Mosh,
The beginning of last week a resident of Cape Canaveral sent an email complaining about the vegetation that
was left in the Xtreme Fun Mini Golf parking lot. I did not contact you hoping that it would be removed, but
went by today and it is still there (photo). They also complained about the dead trees on the Xtreme Fun Mini
Golf property. I was out with the City Arborist dealing with some other trees so we drove by the property, It
appears that there are several dead palms on the property. Dead trees are fee exempt to remove, however, you
would need to apply for a permit.
I have attached an application for your convenience. Please do not hesitate to contact me should you have any
questions.

Private premises means any dwelling, house, building or other structure designed or used either
wholly or in part for private residential purposes, whether inhabited or temporarily or continuously
uninhabited or vacant, and includes any yard, grounds, walk, driveway, porch, steps, vestibule or
mailbox belonging or appurtenant to such dwelling, house, building or other structure.
Public place means all streets, sidewalks, boulevards, alleys or other public ways and all public
parks, squares, spaces, grounds and buildings..
Rubbish means nonp,utrescible solid wastes consisting of both combustible and noncombustible
wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, wood, glass, bedding,
crockery and similar materials.
Rubble means broken fragments of concrete, brick, stone or asphalt, when such fragments are
scattered in disarray.

Sec. 34-26. - Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Commercial handbill means any printed or written matter, any sample or device, dodger, circular,
leaflet, pamphlet, paper, booklet or any other printed or otherwise reproduced original or copies of
any matter or literature which:
(1) Advertises for sale any merchandise, produce, commodity or thing;
(2) Directs attention to any business or mercantile or commercial establishment or other activity
for the purpose of either directly or indirectly promoting the interest thereof by sales;
(3) Directs attention to or advertises any meeting, theatrical performance, exhibition or event of
any kind for which an admission fee is charged for the purpose of private gain or profit; but
this subsection shall not apply where an admission fee is charged or a collection is taken up
for the purpose of defraying the expense incident to such meeting, theatrical performance,
exhibition or event of any kind; provided that nothing in this subsection shall be deemed to
authorize the holding, giving or taking place of any meeting, theatrical performance, exhibition
or event of any kind without a license, where such license is or may be required by any law of
this state or under any ordinance of this city; or
(4) While containing reading matter other than advertising matter, is predominantly and
essentially an advertisement and is distributed or circulated for advertising purposes or for
the private benefit and gain of any person engaged as an advertiser or distributor.
Garbage means putrescible animal and' vegetable wastes resulting from the handling, preparation,
cooking a n d consumption of food.
Litter means garbage, rubbish, rubble and handbills.
Newspaper means any newspaper of general circulation as defined by general law, any newspaper
fully entered with the post office department of the United' States, in accordance with federal statute or
regulation, and any newspaper filed and recorded with any recording officer as provided by general
law and, in addition, means and includes any periodical or current magazine regularly published with
not less than four issues per year and sold to the public.
Noncommercial handbill means any printed or written matter, any sample or device, dodger,
circular, leaflet, pamphlet, newspaper, magazine, paper, booklet or any other printed or otherwise
reproduced original or copies of any matter of literature not included in the definition of a commercial
handbill or newspaper.
Park means a park, reservation, playground, beach, recreation center or any other public area
owned or used by the city and devoted to active or passive recreation.

Mr. Gal received this Notice of Tearing today. He has asked me to represent hire at the hearing, but I have a conflict on
July 21st and ask that the matter be continued to an August date. Is there a specific process for a continuance request?
Additionally, the "pile of vegetation" was removed last night, by party or parties unknown to Mr, Gal. He was intending
to recycle and mulch the vegetation, and is distressed that someone entered his property without permission and
removed the vegetation. Do you have any knowledge of the removal) of the vegetation?
