The equipment utilized to measure light levels was an ExTECH Instruments, Mode1407026, heavy Duty Light Meter. There were 6 readings taken from each elevation-, N, S, L', and W, three locations with an average determination. Based on those readings; namely, greater than 0.2 footcandles, it has been determined that a violation exists at three locations, Northeast sector, Southeast sector, and rnid-East sector, see attached„ In addition, I met with Todd .(Morley, Community and Economic Development Director and Barry Brown; Planning and Zoning Director to discuss the flood light application of CCC, Chapter 94: Signs, Section 94.63. Although it raises concerns with glare lighting, the section of the cede will not apply. Staff is very concerned and is looking into modifying the :Environmental Code section relating to glare lighting conditions. I hope this information is helpful. "There were 4 readings taken; all readings were above the roof line of the building utilizing a bucket truck, on the north side of the property. The Building; Official took readings facing directly south, south cast and east. Based on those readings, it has been determined that there are violations at the following locations and readings: - South facing with readings of 1.8 Foot-candle (fc)and 1.9fc - South.East facing with readings of 3.0fc and 3.1 fe - East facing;with readings of 3.8fc and 3.0fc A measurement was also taken facing directly down the property line with readings of 2.8fc and 2.9fc,. In accordancewith the following City Ordinances: Section 34-2176. Definitions,- Spillover lighting means spillover lighting in excess of 0.2 foot-candles greater than the existing light(i.e., moonlight)that transmits beyond the property boundary line. Section 34-207. Policy established; It is declared to be the policy of the city to prohibit unnecessary, excessive and offensive spill-over lighting from all sources subject to its police powers. The need for spill-over lighting regulation is a matter of legislative determination and public policy and this article is adopted in pursuance of and for the purpose of securing and promoting the public health, comfort, convenience, safety and welfare of the city and the people residing therein. A site visit revealed more than 25 percent of the window glass area for each side of the building was covered. We also observed the sales transaction area was obstructed from view from the outside and the total square footage of the window signs located above ten feet from grade, when added to the total existing signage for the building or unit thereof, is causing the total. signage copy area for the building to exceed the maximum total signage copy area allowed. Spillover lighting standards established Area floodlighting fixtures or other materials installed or provided within the corporate limits of the city, unless excepted elsewhere, shall be installed in or equipped so that the light source does not transmit excessive spillover beyond the boundaries of the property on which the lighting source is located. On November 1, 2013, 7:30PM (19:30), the test for spill-over lighting commenced. The equipment utilized to measure light levels was an EXTECH Instruments, lvlodel407026, Heavy Duty Light Meter. There were 6 readings taken from each elevation; hi, S, E, and 'UG', three locations with an average determination, Based on those readings, namely, greater than 02 footcandles, it has been determined that a violation exists at three locations,. Northeast sector, Southeast sector, and mid-East sector, see attached. In addition, I met with Todd Morley; Community and Economic Development Director and Barry Brown; Planning and Zoning Director to discuss the flood light application of C!CO, Chapter 94: Signs, Section 94.63. Although it raises concerns with glare lighting, the section of the code will not apply. Staff is very concerned and is looking into modifying the Environmental Code section relating to glare lighting conditions. I hope this information is helpful.
