As a City Council Member you are well aware that the City’s goal is compliance. Code Enforcement is a significant concern in Cape Canaveral as expressed by the citizenry and City Council, as a body. No one is above the law: a violation is a violation. If there is a violation, the focus should be on its resolution, not who complained. There will be no further emails on this matter. The following is in response to several questions/assertions/statements in your latest email (see below) regarding the parking space issue for your residence at 7640 Ridgewood Avenue. It was my decision to copy the City Council. As we have discussed on numerous occasions, transparency is critical to maintain the public’s trust and to demonstrate that everyone is treated fairly and consistently. This transparency is particularly important with matters pertaining to the City Council. My practice has always been to over-communicate when an issue has the potential of further escalation. Actions by one member of the City Council can affect how the entire Council or Staff is viewed. You stated in your email from last night that: “I also find it very interesting that we use the community survey results to argue that our citizens prefer electronic communications, but we are continuing to ask for in-person meetings.” The record is very clear in this situation that Staff made attempts with you to handle this item via email (electronic communication). The request for a face-to-face meeting didn’t come until Staff’s fourth email with you regarding this item. The bottom line is thattrying to hold a conversation through email can cause misunderstandings and recipients can misread subtext.By their very nature, emails tend to generate more emails. This can result in creating more problems than they actually solve. In an email you sent to me yesterday regarding this item, you stated that having your questions answered in emails will “ensure personal accountability and leave less room for error on my part.” If you agree to meet, a written summary of the conversation will be prepared to avoid any confusion. This is Staff’s fifth email communication with you on this topic. This issue should be solved by now and we should be moving on to other Council priorities. My recommendation is that you contact Code Enforcement Officer Brian Palmer to address the question posed in his initial email to you,is it your intent to create an additional parking space? Should you decide not to respond, a Notice of Violation will be issued to the property owner. That is obviously not the preferred way to handle this item, particularly with a seated Council Member. Also, my invitation still stands to meet with you (at City Hall, your residence, or whatever is most conveinient). Staff is here to assist you with brigning this matter to closure. Thanks. In this capacity, I am a peaceful city resident, and I do not believe that the Council and the Mayor would be copied on an issue that is in this early of a stage. I believe I should be able to gather information in a lawful and respectful manner on what appears to be a confusing matter to want to meet in person. Instead of getting an answer, I am given a suggestion to "refocus" by the Department Director and answer his departments requestthat was never provided. Yes, I may ask questions, but I am not being unreasonable and certainly not focused. I hope you see that my questions are answered and this is handled in a professional manner for other residents. It would also help to leave out the "one option to meet" closing with the assumptive "pick a time" approach below. Dave If residents were offered some flexibility it would help. As an example, "We are happy to answer your questions, but I would prefer to meet face to face. Is this something you would consider? If so please give me a time and date, and if not, please let me know and I will be right back with you as soon as I can and we ask for your patience." I'm sure your communications guide covers this in full. I wanted to respond to your latest email on the parking issue for property located at 7640 Ridgewood Avenue. The complaint, which was anonymous, was initially provided to Josh Surprenant. Josh who was in the field at the time he received the complaint, was able to take a photo of the property and forward it to my attention. On April 11th, I emailed the photo, to Mike German and Brian Palmer in the City Building Division and asked them to investigate. Brian nor I am aware of additional complaints regarding this situation. As you know, our code enforcement effort is focused on working with property owners to gain compliance with City Code. If this was your intention, parking spaces must meet certain criteria in accordance with City Code. Sec. 110-494. - Dimensions. Off street parking spaces shall consist of a minimum paved area of 180 square feet for parking an automobile, exclusive of access drives or aisles thereto. The minimum width of each space shall be 10 feet and minimum length shall be 18 feet. Sec. 110-1. - Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Paving may consist of the following materials: macadam, asphalt, concrete, pervious concrete, permeable paving, bricks, tile, pavestone, tilestone, flags, flagstone, flagging, cobblestone, curb, kerb, curbstone, kerbstone, edgestone and curbing.
