CALL TO ORDER: ROLL CALL: PUBLIC PARTICIPATION: The Planning & Zoning Board will allow public comment on any item on the agenda at the time each agenda item is considered by the Board,with the exception of ministerial items(e.g.,approval of agenda,minutes,informational items,or ceremonial proclamations),emergency items and other items for which there is no opportunity to be heard as provided in section 286.0114(3), Florida Statutes. Quasi-judicial items shall require a public hearing,and public comments will be accepted at the time the hearing is opened. The Planning&Zoning Board ordinarily will not take any official action under the "Reports and Open Discussion" section of the agenda and, accordingly, public comment on these items will not ordinarily be accepted. Should any official action be deemed necessary on an item under"Reports and Open Discussion"or an item added to the agenda during the meeting,public comment will either be accepted prior to official action being taken or will be accepted when the item is placed on a future agenda for further consideration. PLANNING&ZONING BOARD MEETING MINUTES April 24, 2019 A Meeting of the Planning & Zoning Board was held on April 24, 2019, at City Hall Council Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Chairperson John Price called the meeting to order at 6:00 p.m. The Secretary called the roll. ROLL CALL: MEMBERS PRESENT John Price Chairperson Lamar Russell Vice Chairperson Harry Pearson Melissa Bass Pennie Zuercher (Voted in as Chairperson at 6:10 pm) OTHERS PRESENT Kristin Eick Assistant City Attorney David Dickey Community Development Director Patsy Huffman Board Secretary PUBLIC PARTICIPATION None NEW BUSINESS: 1. Approval of Meeting Minutes: December 13, 2018. Motion by Mr. Russell, seconded by Mrs. Zuercher to approve the Meeting Minutes of December 13, 2018. Vote on the motion carried unanimously. 2. Per Section 2-171 of the Code of Ordinances,the Planning & Zoning Board shall elect a Chairperson and Vice-Chairperson, by majority vote, at the first meeting held in January, unless there is no January meeting,then the next meeting held. Motion by Mr. Pearson and seconded by Mr. Russell to nominate Mrs. Zuercher as Chairperson. Motion by Mr. Russell and seconded by Mr. Price to nominate Mr. Price as Chairperson. Vote on the motion carried 3-2 in favor of Mrs. Zuercher as the new Chairperson. Motion by Mr.Russell and seconded by Mrs. Zuercher to nominate Mr. Price as Vice Chairperson. Motion by Mr. Pearson and seconded by Mr. Price to nominate Mr. Russell as Vice Chairperson. Vote on the motion carried 3-2 in favor of Mr. Price as the new Vice Chairperson. Planning &Zoning Board Meeting Minutes April 24, 2019 Mr. Price asked if he should turn the gavel over to the new Chairperson; Assistant Attorney Eick indicated he should do so. 3. Consideration and Recommendation to City Council Re: Ordinance No. 09-2019,to amend Section 110-28 of the City Code related to Due Process and Special Local Notice Requirements, City of Cape Canaveral,Applicant. Pat Campbell of 307 Surf Drive spoke in opposition to the proposed ordinance. He felt the current method of certified mail outs should be kept in place. When asked if he had any suggestions on an alternative approach,he replied no. Mr. Dickey addressed the tracking and logging system the Community Development Department maintained. Mrs. Zuercher explained the cost saving aspect of mailing first class vs certified. Mr. Dickey explained that Community Development Staff conducted a survey of seven Brevard County municipalities and determined that those surveyed do not use certified mail as a method for notification to surrounding property owners for purposes of zoning actions. Wes Morrison of 7640 Ridgewood Avenue spoke in opposition to the proposed ordinance. Staff presented report to include the City welcoming Public participation, specific standards of notification, courtesy notices vs required notifications, State standards (the City exceeds the requirements) and if amended, will still exceed the recommended standards. Assistant Attorney Eick further explained types of rezoning advertisement requirements when it pertains to rezoning processes (166.041 defines the standards). Mr. Dickey pointed out the last paragraph (page 1) of the Staff Report and the time and cost involved in the process of preparing certified/return receipt letters. Discussion ensued to include cost, delivery methods, rezoning applications within the last 5 years, costs/responsibility, ways to keep informed, i.e., City Website, calendar, Facebook, Instagram, etc., additional workload to staff and email notifications. Staff recommended the Planning & Zoning Board recommend approval of the proposed ordinance. Motion by Mrs. Bass, seconded by Mr. Pearson to recommend approval of Ordinance No. 09-2019 contingent on additional notification verbiage regarding social media. Department: Community Development(CD) Applicant/Owner: City of Cape Canaveral Summary: This application is for site plan approval for the development of a two-story,23,837 square-foot MGF and associated improvements to include entrance features, a new restroom facility, associated parking, utilities and concrete promenade located at 7920 Orange Avenue. The subject parcel is owned by the City of Cape Canaveral, is 5.0 acres in size and is zoned R- 2. The proposed use is consistent and permitted in the R-2 zoning district. The Comprehensive Plan Future Land Use designation for the parcel is Public/Recreation. Zoning surrounding the parcel is R-2. Land use surrounding the parcel consists of single and multi-family structures, to include two-story structures to the north and east. Adequate public utilities to meet the demands of the proposed improvements are located on/adjacent to the parcel. The project will be constructed over several phases. The initial phase, includes the demolition/removal of an existing clay ball field and concrete pads and construction of the MGF and associated improvements, to include entrance features, a new restroom facility, utilities, a concrete promenade and landscaping.Future phases,which may include a splash pad,skate park and playground expansion(s), are indicated on the site plan as well. The proposed improvements, shown on plan sheets C-101 and 102, are consistent with minimum setbacks and dimensional requirements associated with the R-2 zoning district. The application shows a total of 112 parking spaces. The proposed structure has a median height of 32 feet, which is under the allowed 35 feet. The parcel is located in Flood Zone X, which indicates that the parcel is outside the 100-year flood zone. There are no jurisdictional wetlands on-site.The project, as designed, denotes a 6.52 percent impervious surface, under the allowed 35 percent. As required by Section 110-221(1) of the City Code, any new commercial development must submit an application for Site Plan Approval and be approved prior to its construction. Section 110-223 establishes the process that must be followed. In general, the application is first reviewed by the various City review departments to determine its consistency with applicable rules and regulations. The application is then considered by the Planning and Zoning Board and a written recommendation is forwarded to the CD Director for a final decision. Section 110-222 of the City Code establishes criteria that must be addressed by the Site Plan Application package. Attached is a Site Plan Checklist (Attachment 2) that inventories the submittal's consistency with these criteria. Planning and Zoning Board Meeting Date: 6/13/2019 Site Plan Approval—Multi-Generational Facility Page 2 of 3 Sections 110-567 and 110-686 and 687 of the City Code establishes landscaping requirements that the project will be required to meet. Notably, standards for tree planting throughout the parking area and around the perimeter of the project. The landscaping plan, which is consistent with or exceeds minimum standards, is shown in the site plan set on pages L-104 and 105. Water is provided by the City of Cocoa and the City of Cape Canaveral is the wastewater provider as indicated on page C-105 of the site plan set. Stormwater will be treated via a series of swales and retention facilities as indicated on pages C-103 and 104. As the property is not located within the AlA Economic Opportunity Overlay District, architectural/site design guidelines applicable to development within that area are not applicable. However, many of the Overlay design standards were incorporated into the overall project. See below: Sec. 110-643. -Articulation. 1. Reduce the monotony of large buildings by breaking architectural elements into smaller pedestrian scale components or through use of varied materials, textures or colors,trim,roof lines,canopies and awnings in order to provide variation and visual interest. Facades shall be organized into three major components, the base (ground level),body (upper architecture) and cap (parapet, entablature or roofline). Sec. 110-647. -Rhythm. 1. Solid blank walls shall be avoided through the use of facade modulation or other repetitive architectural detailing to maintain visual organization on the building's facade. Sec. 110-650. -Exterior surface materials. 1. Select high quality, human-scale building materials to reduce building mass, create visual interest, and complement the community vision for architectural style of the AlA EOOD. a. The base of a building (the first two to five feet above the sidewalks) shall be differentiated from the rest of the building facade with treatments such as change in material and/or color. b. The exterior facade of buildings shall incorporate no less than two building materials including but not limited to tile, brick, stucco,cast stone, stone,formed concrete or other high quality, long-lasting masonry material over a minimum 75 percent of the surface area (excluding windows, doors and curtain walls.) The remainder of the wall area may incorporate other materials. Sec. 110-669. - Surface parking. 1. Locate surface parking in the rear or side of buildings and provide pedestrian access from the parking to the building and street. However, due to the nature of certain uses, the director of community development or designee may approve up to one row of parking between the front of a building and street. a. A surface parking lot adjacent to a public street shall conform to the landscape requirements detailed in division 6 of this article. Sec. 110-689. - Surface parking lots. 1. Buffer off-street parking adjacent to a public right-of-way or residential buildings or residential zoned property with a landscaped barrier. Interior landscaping for off-street parking shall conform to the requirements of section 110-567 of this Code. b. Minimum landscape buffer width between the right-of-way and the parking or vehicular access area along AlA, Central Boulevard, and N. Atlantic Avenue shall be ten feet and five feet along all other streets. c. A knee wall which is at least 30 inches in height is required when an off-street parking area is located within 25 feet of the public right-of-way. d. A continuous landscape berm at an average height of 30 inches from grade may be permitted in lieu of a required knee wall. e. A knee wall or berm may be, staggered, meandering or continuous. f. A knee wall or berm shall not obstruct any safe sight distance triangle. g. A knee wall shall be compatible with the architectural design, material, and color of the principal building of the project. h. Lighting shall not be used to create an attraction, distraction, or commercial signage intent to the wall or berm. i. For the purpose of this standard, a mixed-use building which includes residential units shall not be defined or categorized as a residential building. As required by Section 110-606, the Community Appearance Board, on May 29, 2019, unanimously approved a Level 1 review for the proposed project. The City Engineer has reviewed the plans (see Attachment 4) and his comments will be addressed prior to final approval. Remaining approvals needed include an administrative Site Development Permit and Concurrency review. In general, these site plans look good with minor items considered. 1. The east side building swale system on Sheet C-104 is not in agreement with Sheet C-103. On Sheet C-103 will bio-swale plantings be considered within low(6.5 elev.) areas? Also, Sheet C-104, and L-107 do not agree with C-103, as they have different shapes. 2. Sheet C-103: Will garbage bin drain out the side, or back with weep holes (currently sloped to back)? 3. Sheet C-103: The 3 stairs along east side of building; is there pavement proposed on top of stairs? 4. Do we know how long new sod in splash area will be before splash area constructed? Also, will any hardening of discharge edge of splash pad to swale be considered? 5. Will the eastern swale along the building have any overflow for major storm runoff, other than the northern Type E structure? Also,the permeabilities (although tested at 4'-5') appear very slow (i.e., 3"-5"per hour). 6. Minor cadd items: Harrison avenue misspelled on C-102, C-104, L-102. Also, what is symbol LO—solar lights? On Page 101 "ARK" missing P. 7. Is restroom finish floor at 8.15 high enough? History of coaching at this field showed slow drainage. Also, can 6" sewer line slope to existing line? Note dugout finished floor. 8. Sheet C-103; other than promenade walk, are any other sidewalks going to have vehicles, and if so, would 6"thick segments be considered for them? Thinking mostly about C-104. 9. The proposed temporary grade across the future splash pad is about 0.4%. With grass, this will not drain well an may be a damp area until splash pad is constructed. 10. Sheet C-704: What is the Lease Parcel (4.04+/- acres). Also, Harrison Avenue misspelled in site plan (minor cadd). 11. Sheet L-101: Might check proposed trees against book titled Stormscaping (Florida Gardening series,Vol. 3). This ties to your current Hurricane programs.
