The job was issued a stop work order. Coastal Craftsmen submitted permit application. Plan review indicated two setback encroachments for the pool enclosure (to the west and to the south). Owner requested variance to allow: 1. Pool enclosure side setback (from western property line) of 10 ft. (instead of the required 15ft.) 2. Pool enclosure rear setback (from southern property line) of 4 ft. (instead of the required 5 ft. for pool enclosures) 3. Six ft. high privacy fence setback (from western property line) of 9 ft. (instead of the required 25 ft.). Note: fence was pre-existing. 4. Pool equipment setback (from western property line) of 4'-8" (instead of the required 5 ft. The job remained half -complete for several months while the variance process was pursued. P&Z and BOA approved the following: 1. Approved as requested (10 ft. from western property line) 2. Denied. The 5 ft. rear setback must be complied with. 3. Approved as requested. (Fence can be 9 ft. from western property line). 4. Approved as requested. Pool equipment can stay where it is. Note to Code Enforcement: The pool enclosure contractor is not responsible for relocating the 6 ft. wooden privacy fence. However, the owner is responsible for ensuring this is completed. It is reasonable to wait until the pool enclosure permit is completed before verifying that the fence has been relocated. A note is to be put in the permit on the IMS module to alert code enforcement to inspect that the fence has been relocated upon final inspection of the pool enclosure. A reasonable length of time can be given for the owner to relocate the fence. 60-90 days is reasonable. In order to allow reasonable use of the pool, the applicants were requesting a side setback of 10 ft. for the screen enclosure, rather the 15 ft.; the applicants were also requesting a rear setback of 4 ft. rather than 5 ft. in order to keep the screen enclosure as currently installed along the rear of the pool deck; the applicants were requesting a fence setback of 9 ft_ rather than 25 ft. to allow the 6 ft. high wooden stockade privacy fence. In addition, the applicants were requesting a variance for the pool equipment (accessories), a setback of 4 ft. 8 in_ rather than 15 ft.; and finally they were requesting a rear setback variance for the shed of 4 ft. rather than 5 ft_ Board of Adjustment Meeting Minutes December 7, 2009 Page 3 Discussion was held regarding a six foot high wooden privacy fence that ran along the rear property line of the building that had been installed by the original developer, Mr. Brown advised that he would research the code and get back to the board on whether or not that fence complied with the city code. Mr_ Brown gave staffs analysis and variance evaluation criteria, as per city code Section 110-37. He advised that special conditions and cir stances existed which were peculiar to the land, structure, or building inv hick were not applicable to other lands, buildings or structures in the e zoning district. He advised that the pool was 15 ft_ from the property Ii an hout a variance it was not possible to construct an enclosure that alto rson to walk around the pool. There was nothing peculiar pool a ck that would preclude the applicants from meeting the re etback. A side y etback of 25 ft. for a 6 ft. high fence was onerous. Mr. Brown advised that the special conditions and circumstances did not result from the actions of the applicants. He advised that the only circumstance requiring a variance that was of the applicants doing was the rear setback for the screen enclosure. All other circumstances existed when the applicants purchased the property. Mr. Brown advised that the approval of the variance requested would not confer on the applicants any special privileges that were denied by the city code to other lands, buildings, or structures in the same zoning district_ He explained that it was not a privilege to have a screen enclosure, and all the other circumstances existed when the applicants purchased the property. Board of Adjustment Meeting Minutes December 7, 2009 Page 4 Mr. Brown advised that the variances requested would not confer, on the applicants, any special privilege(s) that was denied by the city code to other lands, buildings, or structures in the same zoning district. He advised that it was not a special privilege to have a screen enclosure, privacy fence, and pool accessories in the R-2 residential zoning district, but it was a special privilege to have an accessory structure (shed) that did not meet the city code. Mr_ Brown advised that the requested variances were th m variances from the city code necessary to make possible the rea ble use of the land, building or structure. He clarified that all the reque v ces were the minimum variances from the city code to make r s able f the pool, enclosure, fence, shed, and accessories. Mr. Brown advised that the approval of t ances ould be in h y with the general intent and purpose of the city co d not be inj ous to the neighborhood or otherwise detrimental to the p elfare_ Mr. Brown gave city staffs recom on. He adv that staff did not support variances necessary to allo creep en re as constructed, but it was clear that without a screen clo qua mosquito control was not possible and mainte nce of the p I ul densome_ Staff supported necessary variance ably acc modate screen enclosure, privacy fence, and pool a sone t staff did of support rear setback variances the pool enclosure acc ories. He plained that the pool enclosure could easily be relocated to m e c' code, and the shed was in a state of disrepair and deteriorating an stable as a host structure for support of the pool enclosure. Staff al recommended that the shed should probably be demolished and replaced with a new shed that would meet the city code. Mr. Brown advised that the Planning & Zoning Board recommended approval of the side setback variance for the pool enclosure, the setback for the fence, and the setback for the pool accessories (pump), and recommended denial of the rear setback for the screen enclosure and the shed, which was the same recommendation given by city staff. Board of Adjustment Meeting Minutes December 7, 2009 Page 5 Dr. Heather Parker -Jones, Petitioner, testified that when they purchased the townhouse the pool was already there, so they decided to make the pool area safe for her children and husband who were all severely allergic to mosquitoes, so they installed the enclosure. The hired contractor made it clear that it would take them a certain amount of time to construct enclosure, because they had to apply for a permit, which they never did. She advised that did not find out about the permit until they were in the process of buildin closure. She further testified that the screen enclosure was only pa finished; the maintenance around the pool area was even worse use the panels were falling into the pool, bringing along debris fr e tre he advised that if the variance for the enclosure was approved uld sp o Coastal Craftsmen and have them work with the cit draw up the plan met the code and obtain the required permit.
