It has been 28 years total and 10 years of the owner’s complete disregard of community standards and citizenship. Hiding behind “not be at liberty to discuss” is a misuse of the public trust. In 2016 the property was dropped from Homestead and you weren’t paying attention enough to do anything. Now the Homestead is dropped again and the city’s sloth speed movement will provide the owner an opportunity to provide another block to resolving this issue. I want the CO pulled to ensure the city has to inspect the inside. I want the city to take action to clean up the yard. The roof has had holes in it for 10 years, there are raccoons in the attic, rats and mice in the yard. The smell is horrible and I suspect mold. The front and rear porch are not structurally sound and in danger of collapse land have visible mold. I have positive responses from two local news agencies that after reading my file are now interested in my story. Monday morning I will be contacting the Central District EPA Office, Brevard County Health Department and the Federal Housing and Urban Development. The following is in response to your email from September 25, 2018 (shown below) wherein you request the status of 305 Surf and 8497 Ridgewood. In correspondence dated September 16, 2018, an answer to the status of 305 Surf was provided to you by the City Attorney. Below is a portion of that correspondence that I think is important for all of us to keep in mind: “As you know, the City Manager has directed a comprehensive staff and legal review of this situation. We are fully engaged in a comprehensive review which will obviously take a little time. My office is assisting and will advise the City Manager accordingly about possible legal remedies including, but not limited to, bringing one or more actions in a court of competent jurisdiction. Going forward, I know you appreciate that my office and City officials will not be at liberty to discuss or disclose attorney-client privilege information regarding this pending review and possible future legal action. I also know you realize that we are devoting significant resources to this task. Because you are most affected by the conditions at 305 Surf Drive, we intend to generally keep you apprised of our progress and we appreciate your assistance when the opportunity for your assistance is needed like the inspection from your property this week.” Regarding 8497 Ridgewood, on May 17, 2018, the Code Enforcement Board imposed a $75 per day fine on the property until the violations are corrected. For your information, I have attached the Notice of Violation which lists the violations. Total fines to date are approximately $10,100.00. Regarding your question “Has the Certificate of Occupancy been revoked?” for these two properties; a CO is issued when a structure is built and it is determined that it meets applicable codes and can be occupied. Revoking a CO is not the mechanism used to designate a building that cannot be occupied. The City has posted 8497 Ridgewood as uninhabitable (which means that it cannot be occupied) and required that it be secured. Regarding 305 Surf, as indicated above, the City is evaluating its options to include possible legal remedies. Have a good weekend.
