HomeMy WebLinkAboutRE Report a Concern (form) has been filled out on your site (167)The City of Cape Canaveral gave me a 600 dollar estimate to provide information about Report a Concerns because of the extreme difficulty in extracting the information. In September the city posted the following: “Good afternoon, Cape Canaveral Community. It has been brought to Staff’s attention that members of our Community are disseminating misinformation about whether the City accepts anonymous code enforcement complaints. The short answer is “yes.” You are the eyes and ears of our City, and we value all the information you provide and respect your decision to make anonymous reports. Anonymous concerns and complaints are accepted via phone and mail, as they have always been. This information is stated on the Community Development Department’s frequently asked questions webpage. In addition, pages 20 and 21 of the Weekly Update of September 21, 2018 provide instructions for residents who would like to make an anonymous code enforcement complaint by phone or mail. The Weekly Update also explains that the Report-a-Concern webpage form requires certain fields to be completed in order to function properly and allow for Staff to follow up on concerns. In the two-and-a half years the City has been using the Report-a-Concern webpage form there have been approximately 138 submissions, only three of which have been anonymous. Additionally, it’s quite common that a submitted Report-a-Concern is not related to Cape Canaveral, and it’s important that Staff be able to contact the person submitting a concern, so we can follow up. For example, not being able to contact a resident about a concern they submitted regarding traffic signals in Port Canaveral would leave that resident to believe the City doesn’t hear their voice. By being able to follow up with the individuals submitting concerns, Staff is able to explain what is or isn’t under City control and let residents know that we have forwarded their concerns to the appropriate Port Canaveral Staff member for resolution” It is clear the city can get the information quickly when the city needs it. It is interesting that in September of 2018, after 2 and a half years there were 138 submissions and 7 months later there are 455, about 5 a month to September 2018, 31 a month from September 2018 to date. Hello Mr. Campbell, I thought I understood your request as “a list of all captured Report A Concern submits to the city”. That request can be fulfilled through the City Clerk’s Office as a Public Records Request. As stated in previous emails, “since 2016, the City has received (by our best estimation at this time) 455 emails from the Report a Concern web page web form…”. Reading my previous email to you, gather was an incorrect word to use. The City Clerk’s Office can gather the RAC submit emails as part of a Public Records Request, but there is no tool or list used to track or analyze the RAC submits to closure individually or as a whole. Please see the attached example of what the City receives when a Report a Concern is submitted. I don’t know what other synonyms for list can be used to make the point that the RAC submits are not tracked in a file, tool or project/task management system. I have no other way to explain through email other than what I have already said, and the attached example. Please contact the City Clerk’s Office if you want to continue the Public Records Request for a list of all captured Report A Concern submits to the city. I'm wondering if maybe something could be posted regarding where the best chance to see manatees is located, or maybe even to change the name. The City’s current website is not as advanced as you might think. The Report a Concern (RAC) web page contains a basic html web form that sends an email to the City with the inputted name, phone number, email address and concern. There is no possible way in the current system to gather, track, export, collect, store, analyze or subsequently manage to closure the RAC “submits” individually or as a whole. Attached is a screenshot from the backend of the website where you can see the RAC form is comprised of simple input fields. To the left of the image are the form properties, to the right are the form input fields, on the bottom is an audit log of changes made to the form and the Cancel/Preview/Save buttons. The RAC web form was created in July 2016 when it was brought to Staff’s attention that the existing concern/issue request system was malfunctioning, and could not be turned back on without a serious investment in time/money. The City needed a way for anyone to report their concern, and the creation of the RAC web form was the best option at the time – it is easy to use, it is part of the current website (it was free), has a captcha to reduce spam emails / crawlers (that web forms tend to attract) and sends an email to the City with all pertinent information (name, phone email, email, concern) so the concern can be addressed. The RAC form was first mentioned in the July 29, 2016 issue of The Weekly Update: A Report a Concern form has been added to the City website. It was brought to our attention by a resident that the current Report a Concern software was not working correctly. The form requires no login/account and is very easy to use. Because the range of concerns vary widely in topic, actions taken and the time to resolve them can vary. RAC resolutions can be informational such as a follow-up email/phone call or result in further action taken by the City or City Council. Since 2016, the City has received (by our best estimation at this time) 455 emails from the Report a Concern web page web form, that in turn have multiplied to (by our best estimation at this time) over 3000 related emails. To be clear, this is not a case of semantics, the City has no such list, spreadsheet, collection, digital archive, library or repository of all Report a Concern submits to supply a citizen. I (and other members of Staff) have already invited you to meet in an effort to improve the perception of reduced transparency, overt influential and manipulative public records tactics and restriction of citizen visibility. If you are interested in understanding the Report a Concern web page web form and Report a Concern process in more detail, Staff can be available to meet. I am aware that the city approach to this request is to use semantics “list” and the public record request and cost estimate tactic to restrict citizen visibility and I expect it to begin with a declaration that the city does not produce lists. To be clear I am not asking the city to do anything that you don’t already do, produce anything you don’t already have. I am asking the city to provide a citizen the information digitally gathered and managed by the Report a Concern tool and process. From what I see on the customer facing form, you use the post method and the data input in the form is stored and subsequently managed to closure. Joshua, Thank you for your response. My question “who updates the map and where does the data come from.” Your answer, City Planner and information provided by the Code Enforcement Officers. I appreciate your invitation to discuss my concerns face to face and understand you feel face to face would be more productive. My experience with city leadership is quite the opposite. I have met face to face on multiple occasions and have concluded that any city leadership desire to meet face to face is simply an overt tactic to influence or manipulate what public records are created and reduce citizen transparency to the activities and behaviors of city leadership. Your specific request to come to City Hall and discuss my concerns indicates a willingness to review my concerns. My concerns for the code enforcement, including the map, are simple and bounded by my desire as a citizen of Cape Canaveral for continuous, utilitarian ready access to the complete and accurate procedures, processes and data used in all aspects of the code enforcement function. The city actions I have experienced show a pattern of management contrary to open government and citizen visibility. It isn’t about the map, but using the map as a component of code enforcement, it is clear that it is not accurate “The user is responsible for verifying all information.” The map will eventually become nothing but a sea of dots, and meaningless. The map does not provide an ability to query or export the data such that any level of performance or tracking indices can be obtained. From a city response to me via a previous email on this subject: “Not all complaints are logged. Our procedures are; when a complaint is filed we investigate that complaint, if the complaint is valid it gets logged and if we do not get compliance in the field a case is created. If the complaint is anonymous and that complaint is either not valid or is brought into compliance in the field it is not logged and the complainant would need to contact the Code Officer to obtain the disposition of the complaint. If there are complaints that have been filed with us and they do not show up on the map, the complainant needs to contact the Code Officer the complaint was filed with to obtain the disposition of that complaint.” The lack of process and procedure discipline in code enforcement establishes an environment of selective, arbitrary, capricious and discriminatory application of code enforcement. The property remained in violation so a Notice of Violation for visible mechanical equipment was sent on December 19, 2018. On January 7, 2019 a site visit found the property to be in compliance and a compliance letter was sent. On March 19 during a patrol of the city staff found the fence around the mechanical equipment had fallen down and the property is back in violation. The city says the code enforcement case map is updated and should have been updated March 15 but I checked just one item, 250 E Central and it has been under investigation since 10/17/2018. You were at 171 E Central to work with the owner for the same kind of violation. What kind of investigation for exposed equipment takes 6 months? If the complaint is anonymous and that complaint is either not valid or is brought into compliance in the field it is not logged and the complainant would need to contact the Code Officer to obtain the disposition of the complaint.
