Mr. Campbell,
Please understand that I simply enforce the codes, your question on the
special exception is not for me to interpret or try to explain. This is
the reason I referred you to the Clerk’s office so they can pass this
request to the appropriate individuals to provide the facts accurately.
There are no inconsistencies between the church and Dottie’s bar, they
are two separate and different properties. The church has never had
paved parking on the property, while Dottie’s Bar has always had paved
parking. Dottie’s also has to meet a minimum number of parking spaces
and to meet those requirements new parking was required. Since parking
at Dottie’s Bar has always been paved any new parking created would also
have to be paved.
Sincerely

I see they have exceptions but I don’t see how the exceptions as
documented void the requirement for paving. Please explain. Also as for
the church parking, Dottie’s bar has been here a LONG time also. I am
trying to understand the inconsistencies in code enforcement. It is not
a public record request, it is a request for a code enforcement
explanation of actions taken and the regulatory basis that ensures fair
and equal application.

Southern charm cited and Dottie’s bar cited for parking on
unpaved areas. 190 center street and 8711 n Atlantic has vehicles
parking on unpaved surfaces. Why are they not a violation?

Ok then. Different approach. People are parking in the
grass on c1 property. That is a code violation at 8711 n Atlantic and
190 center street. Thank you.

From the previous request or code violation, I
never got an answer to this:
“While we are discussing parking on grass, I
noticed the property at 8711 N Atlantic Ave Cape Canaveral FL 32920, the
Church is not paved and is in C1. Is there a special exemption or permit
for parking on the grass there? And the same question for 190 Center St
Cape Canaveral FL 32920, and 8550 Commerce St Cape Canaveral FL 32920.
Thank you for your assistance.”

Subject: RE: 100 E Central and 145 E Central
Mr. Campbell,
Before I respond to your specific questions, I
want to provide you with some general information about the Florida
Public Records Act (Act). The Act does not require a custodian of
records to give out information from public records maintained by the
City or to answer questions when requested by a person (in person or in
writing) except to the extent of allowing personal inspection or copying
of public records. Therefore, to the extent that any of your requests
request that the City give out information from public records or answer
questions, the City is not required to do so. Notwithstanding, the City
has attempted to answer many of your previous questions to the extent
possible and practical as a matter of courtesy in the spirit of
providing accurate public information related to your questions.
In addition, whenever the City responds to a
records request, the City is only responsible for allowing the
inspection and/or copying of "public records." In order for a record to
constitute a public record, the records must have been created in
connection with official City business. Accordingly, records which are
not made or received in connection with the transaction of official City
business do not constitute public records subject to disclosure.
Personal records of any City official are not public records subject to
disclosure and the City is not in a position of providing such personal
records assuming they even exist at all. Therefore, to the extent that
any portion of your requests are intended to request personal records,
these requests are not subject to the Florida Public Records Act because
they are unrelated to the transaction of official City business.
Now to answer your specific questions, the
pavers at 100 E. Central are not loosely thrown down and improperly
installed as you state. They are full size concrete blocks turned with
the open portion facing up making them permeable. I was informed by the
owner that the blocks were installed during the construction of this
phase of the facility and the concrete driveway is the permanent border.
Regarding your request for engineered drawings and number of spaces,
that can be handled through a public records request through the City
Clerk’s Office. Regarding the request for information about whether a
property has be granted a special exception, please schedule a time with
me so that you can review the appropriate files to see if the other
properties you mentioned have special exceptions.
Respectfully,

Define “All paving material shall have a
finished surface and must be contained by a permanent border and
properly maintained.” Loosely thrown down pavers are not compliant. A
permanent border would be a constraint manufactured and installed for
that specific purpose. Also, how far is it paved There are 3 cars there
now. Are there drawings showing the engineering and approval for this
parking area? While we are discussing parking on grass, I noticed the
property at 8711 N Atlantic Ave Cape Canaveral FL 32920, the Church is

Mr. Campbell,
A site inspection at 100 E Central
revealed the grass is actually growing up through permeable pavers. As
long as the grass growing through is properly maintained the property is
not in violation of Section 110-555.
The property at 145 E. Central is zoned
residential and Section 110-555 does not apply. However, there are
violations due to the grass not being properly maintained under and
around the vehicles parked in the grass. This will be addressed with the
property owner along with other violations observed during the site
visit.
If you have further complaints or
