April 18, 2019
A Regular Meeting of the Code Enforcement Board was held on April 18, 2019, at Cape Canaveral
City Hall Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Mr. Charles Hartley called
meeting to order at 6:00pm., Mary Russell, was absent. Charles Hartley was made Temporary
Chairperson, vote on motion was carried unanimously. The Board Secretary called the roll.

April 18, 2019
PUBLIC HEARINGS:
Case No. 2018-191 — (211Caroline Ave) Palms East of Cape Canaveral, LLC, Respondent and
Property Owner.
City Code Enforcement Officer Chris Robinson alleged violations of the following: Section 34-
38, Owner's maintenance of premises, City Code, Section 34-96, (a), (b), (d) Standards established,
City Code, Section 34-97, (a), (1), (2), (3), (7), (b), (2), (3) Duties and responsibilities for
maintenance, City Code, Section 34-98, (2), (3), (4), (5), (6) Building appearance and maintenance,
City Code, Section 34-99, (1), (2), (3), (4), (5), Landscape appearance and maintenance, City Code,
34-122, (a) Public nuisance prohibited, City Code.
Code Enforcement Officer Chris Robinson gave testimony, evidence and a presentation relating
to alleged code enforcement violations. Chris Robinson testified that the following code sections
were still in violation at the time of the hearing: Section 34-96 (b), (d), Standards Established,
City Code, Section 34-97 (b) (3), Duties and Responsibilities for Maintenance, City Code; Section
34-98 (2), (4), (6) Building appearance and maintenance, City Code.
Respondent's attorneys (Anne Marie Giri and Luis Carreja) were present and both spoke on
behalf of the Respondent.
Motion by Mr. Cloney to find Respondent in violation of Section 34-96 (b), (d), Standards
Established, City Code; Section 34-97 (b) (3), Duties and Responsibilities for Maintenance, City
Code; Section 34-98 (2), (4), (6) Building appearance and maintenance, City Code, and to give
Respondents until July 30, 2019 to come into compliance, or a fine be imposed in the amount of
$150.00 for the first day and $100.00 every day thereafter until compliance is confirmed by the
code enforcement officer and all costs associated with the enforcement of the violation be imposed.
Second by Mr. Hale. Vote on the motion carried unanimously.
2. Case No 2019-289 - (225 Adams Ave.) Eva Kennedy & Jeffrey R. Fletcher, Respondents and
Property Owners.
City Code Enforcement Officer Chris Robinson alleged violations of the following: Section 102-
38 (a),(b)(1)(3) Enforcement and Penalties, City Code, Section 102-39 (a), (b) (1)-(6), (7) (c) (d)
Permits, City Code; and Section 102-40 (a), (2) — (7) Permit criteria, exemptions, standards of
review, City Code.
Code Enforcement Officer Chris Robinson gave testimony, evidence and a presentation relating
to alleged code enforcement violations. Code Enforcement Officer Brian Palmer also gave
testimony regarding the case.
Respondent Jeffrey R. Fletcher was present and provided sworn testimony. Respondent submitted
one exhibit, a work order from FP&L, which was accepted by the Board.

April 18, 2019
Community Development Director, David Dickey spoke regarding moving the case to a later
date. It was requested by David Dickey that the April 18, 2019 Code Enforcement Board hearing
be continued to a later date such that additional evidence can be submitted to the Code
Enforcement Board at that time for further consideration by the Code Enforcement Board prior
to issuance of an order inclusive of findings of fact relating to the alleged violation(s).
Respondents made no objection to continuing the April 18, 2019 hearing to a future date.
Motion by Mr. Hale to continue the hearing for more testimony from additional individuals, and
more evidence. Second by Ms. Stone, Vote on the motion carried unanimously to continuing the
April 18, 2019 hearing to a future date.

On August 16, 2018 during a patrol of the city staff observed a fence falling over in dis-repair. Further inspection
revealed siding on the east side of the house is incomplete and the permit has expired, the drip edge along the
north west portion of the roof is missing, the air conditioning condenser and pool equipment are visible from
public view, there are no numbers posted to identify the address and no final inspection was performed on the
pool screen enclosure.
Description of Violation(s) at property: Section 34-96(d). - Standards established.
(d) Exterior property areas of all premises shall be kept free of all nuisances, litter, rubbish, debris, objects,
material or conditions which may create a health or fire hazard. Exterior property areas shall be free of
unsanitary conditions which constitute blighting or deteriorating influence on the neighborhood. Lawns,
landscaping, driveways and fences shall be maintained so as not to constitute a blighting or deteriorating
effect in the neighborhood.
Section 34-98. - Building appearance and maintenance.
(3) Mechanical equipment, including air conditioners or other utility hardware, on the roof, ground or
buildings shall be screened from public view when practicable with materials harmonious with the
building or they shall be located so as not to be visible from any public ways. This equipment shall
conform with normal noise standards and shall not emit excessive noise.
(4) Buildings and appurtenances, including signs, should be cleaned, painted, repaired and free of mildew
as required to present a neat appearance. Deteriorated, worn or damaged portions should be rebuilt or
replaced. All surfaces shall be maintained free of broken glass, loose shingles, crumbling stone or brick,
excessive peeling paint or other conditions reflective of deterioration or inadequate maintenance to the
end that the property itself may be preserved safe from fire hazards.
I.P.M.0 303.2 Protective treatment.
All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches and
trim, shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods,
shall be protected from the elements and decay by painting or other protective covering or treatment.
Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry
joints as well as those between the building envelope and the perimeter of windows, doors and skylights
shall be maintained weather resistant and water tight.
I.P.M.C. 303.3 Street numbers.
Each structure to which a street number has been assigned shall have such number displayed in a position
easily observed and readable from the public way. All numbers shall be in Arabic numerals at least 3
inches ( 76mm ) high and '/2 inch ( 13mm) stroke.

I.P.M.C. 303.6 Exterior walls.
All exterior walls shall be free from holes, breaks, loose or rotting materials: and maintained weatherproof
and properly surface coated where required to prevent deterioration.
F.L.B.C. Section 105 Permits. 105.1 Required.
Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish
or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove,
convert or replace any impact -resistant coverings, electrical, gas, mechanical or plumbing system, the
installation of which is regulated by this code, or to cause any such work to be performed, shall first make
application to the building official and obtain the required permit.
Section 110 Inspections. 110.1 General.
Construction or work for which a permit is required shall be subject to inspection by the building
official and such construction or work shall remain accessible and exposed for inspection purposes
until approved. Approval as a result of an inspection shall not be construed to be an approval of a
violation of the provisions of this code or of other ordinances of the jurisdiction. Inspections
presuming to give authority to violate or cancel the provisions of this code or of other ordinances of
the jurisdiction shall not be valid. It shall be the duty of the owner or the owner's authorized agent
to cause the work to remain accessible and exposed for inspection purposes. Neither the building
official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of any
material required to allow inspection.
Recommendation(s) to correct the violation(s) described above:
• Repair, replace or remove dilapidated fence.
• Complete installation of siding.
• Replace missing drip edge.
• Properly screen mechanical equipment from public view.
• Properly display address numbers on house.
• Apply for, obtain, reopen applicable permits and have final inspections.
Section 82-221. - International Property Maintenance Code adopted.
The International Property Maintenance Code, 1998 edition, as published by the International Code
Council, is hereby adopted by reference and incorporated herein as if fully set out.
The Construction Board of Adjustment and Appeals shall serve as the Property Maintenance Board of
Adjustment and Appeals for this article.

Sec. 82-31. - Florida Building Code adopted.
The Florida Building Code 2010 edition, as may be amended from time to time, as published by the Florida
Building Commission, shall be known as the City of Cape Canaveral Building Code and is hereby adopted
by reference and incorporated herein as if fully set out.
Failure to comply within thirty (30) days from receipt of this Notice shall result in further action, as
outlined in the previous page(s) of this Notice of Violation.

On October 3, 2018 while addressing a separate violation staff discovered construction taking
place in a unit. Further investigation revealed the entire subfloor of a second floor unit was being
removed without the required permit. A stop work order was posted and is in effect until
compliance is meet.
Description of Violation(s) at property: (F.L.B.C.) [A] 105.1 Required.
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish,
or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair,
remove, convert or replace any impact -resistant coverings, electrical, gas, mechanical or
plumbing system, the installation of which is regulated by this code, or to cause any such work
to be done, shall first make application to the building official and obtain the required permit.
(F.L.B.C.) [A] 110.1 General.
Construction or work for which a permit is required shall be subject to inspection by the building
official and such construction or work shall remain accessible and exposed for inspection
purposes until approved. Approval as a result of an inspection shall not be construed to be an
approval of a violation of the provisions of this code or of other ordinances of the jurisdiction.
Inspections presuming to give authority to violate or cancel the provisions of this code or of other
ordinances of the jurisdiction shall not be valid. It shall be the duty of the permit applicant to
cause the work to remain accessible and exposed for inspection purposes. Neither the building
official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of
any material required to allow inspection

The city council of the City of Cape Canaveral hereby finds:

without such building permit being in effect creates a grave threat to the public health, safety,

This Citation is issued pursuant to to § 82-375 et. seq., City of Cape Canaveral Code and Chapter 489, Fla. Stat.
Any person who is issued and receives this Citation shall immediately cease the act for which the Citation was
issued. Upon receipt of this Citation, the violator shall cease and desist from the act for which this Citation has
been issued and elect either to:
(1) Within ten (10) days of receipt of this Citation, not including weekends and legal holidays, pay to the City
of Cape Canaveral the civil penalty stated above. Payment must be made in U.S. Funds and may be made by cash

On September 16, 2014 the City Council revised the City's Sign Code Ordinance to address
Nonconforming signs within the City. Section 94-121 of the Ordinance states that all signs or
outdoor displays which were lawfully erected, but do not conform to the Ordinance, will be
considered nonconforming signs. The intent is to phase out nonconforming signs as expeditiously
and fairly as possible. On December 2, 2015 you were sent a letter outlining the types of
nonconformities which were to be corrected by September 16, 2016. As of the date of this letter
no permits have been applied for or issued regarding converting your pole sign into a pylon sign.
Pole signs are no longer authorized in the city, your sign needs to either be replaced or converted
into a pylon sign. For the definition of a pylon sign please refer to Sec. 94-1 of the City Code of
Ordinances, which has been attached. All sign replacements and conversions require a permit.
3. Description of Violation(s) at property: Section 94-121. (d) Nonconforming signs.
All signs or outdoor displays which are lawfully in existence or are lawfully erected and which
do not conform to the provisions of this chapter are declared nonconforming signs. It is the intent
of this chapter to recognize that the eventual elimination of nonconforming signs as
expeditiously and fairly as possible is as much a subject of health, safety, and welfare as is the
prohibition of new signs that would violate the provisions of this chapter. No nonconforming
sign shall be changed, expanded or altered in any manner which would increase the degree of its
nonconformity, or be structurally altered to prolong its useful life, or be moved in whole or in
part to any other location where it would remain nonconforming.
(d) Pole signs—Termination by amortization: Any nonconforming pole sign existing on
September 16, 2014 and not terminated pursuant to any other provision of this section shall be
permanently removed or modified into a pylon sign by September 16, 2016, by the installation of
a non -corrosive decorative cover applied over and attached to the supporting pole(s) in
accordance with industry standards of material and workmanship, except, however, pole signs
located within the visibility triangle shall be permanently removed or relocated from the
visibility triangle by said date in compliance with this chapter.
4. Recommendation(s) to correct the violation(s) described above:
Obtain a permit and convert the existing non -conforming sign into a conforming sign
per the code.
Failure to comply within ten (10) days from receipt of this Notice shall result in further action, as
outlined in the previous page(s) of this Notice of Violation.
