HomeMy WebLinkAboutcocc_ceb_minutes_20190221CITY OF CAPE CANAVERAL CODE ENFORCEMENT BOARD MEETING MINUTES February 21, 2019 A Regular Meeting of the Code Enforcement Board was held on February 21, 2019, at Cape Canaveral City Hall Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Chairperson Mary Russell called the meeting to order at 6:00 p.m. The Board Secretary called the roll. MEMBERS PRESENT Mary Russell Paula Collins Christopher Cloney James Hale Charles Hartley MEMBERS ABSENT Inez Stone Walter Godfrey OTHERS PRESENT Debra Nutcher Brian Palmer Chris Robinson Ginger Wright Michael German Dave Dickey Chairperson Vice Chairperson City Attorney Code Enforcement Officer Code Enforcement Officer Board Secretary Building Official Community Development Director City Attorney Nutcher swore in all persons giving testimony. NEW BUSINESS: 1. Approval of Meeting Minutes -September 20, 2018 & January 24, 2019 Motion by Mr. Cloney second by Mr. Hartley, to approve the meeting minutes of September 20, 2018, and January 24, 2019 as written. Vote on the motion carried unanimously. COMPLIANCE HEARINGS: 1 Case No. 2017-166 — Violation of Section 34-98, (2), (5) Building appearance and maintenance; Section 70-69 Receipt required; payment of tax prerequisite to issuance; Section 110-491, (11) number of spaces required, of the City of Cape Canaveral Code of Ordinances. Section 303.1 General; Section 303.7 Roofs and drainage; Section 303.14 Window, skylight and door frames; Section 303.14.2 Openable windows; Section 303.15 Insect screens; 304.3 Interior City of Cape Canaveral Code Enforcement Board Meeting Minutes February 21, 2019 surfaces; Section 605.1 Installation, of the International Property Maintenance Code, as adopted by Section 82-221 of the City of Cape Canaveral Code of Ordinances. (526 Jefferson Ave) Bogart Place Properties LLC/Jeffery Wells Property Owner. Code Enforcement Officer Brian Palmer provided an overview of the Case history. Officer Palmer testified that the property is in Compliance. Motion by Mr. Hale second by Mr. Hartley, Vote on the motion carried unanimously. 2. Case No. 2018-212 - Violation of Section 110-555. - Paving of vehicular use areas, of the City of Cape Canaveral Code of Ordinances. (8501 Astronaut Blvd.) Elpidasmar Management, LLC, Pantelis Markogiannakis, Property Owner. Code Enforcement Officer Brian Palmer provided an overview of the Case history. Officer Palmer testified that the property was in Violation from 5/13/18 to 2/15/19. And is now in Compliance. Motion by Mr. Cloney, second by Mr. Hartley, Vote on the motion carried unanimously. PUBLIC HEARINGS: 1. Case No. 2018-191 - Violation of Section 34-38, Owner's maintenance of premises; 34-96, (a), (b), (d) Standards established; Section 34-97, (a), (1), (2), (3), (7), (b), (2), (3) Duties and responsibilities for maintenance; Section 34-98, (2), (3), (4), (5), (6) Building appearance and maintenance; Section 37-99, (1), (2), (3), (4), (5), Landscape appearance and maintenance;34-122, (a) Public nuisance prohibited, of the City of Cape Canaveral Code Ordinances. (211 Caroline Ave) Palms East of Cape Canaveral LLC/ Jeffery Wells Property Owner. Code Enforcement Officer Chris Robinson gave testimony, evidence and a presentation relating to alleged code enforcement violations. Section 34-38, Owner's Maintenance of Premises, Code of Ordinances of the City of Cape Canaveral ("City Code"); Section 34-96 (a), (b), (d), Standards Established, City Code; Section 34-97 (a), (1), (2), (3), (7), (b), (2) & (3), Duties and Responsibilities for Maintenance, City Code; Section 34-98 (2), (3), (4), (5) & (6) Building appearance and maintenance, City Code; Section 34-99 (1), (2), (3), (4) & (5) Landscape appearance and maintenance, City Code; Section 34-122 (a), Public nuisances prohibited, City Code. The Building Official, Michael German, and Community Development Director, David Dickey, also spoke on the case. Respondent, (along with his Attorney Luis Carreja,) was present and provided sworn testimony. City of Cape Canaveral Code Enforcement Board Meeting Minutes February 21, 2019 Code Enforcement Board, having reviewed the entire file as provided and being otherwise fully advised in the premises, voted to continue until the next Code Meeting March 21, 2019, with the understanding the city and the respondent meet and attempt to come up with a plan to address the violations listed. Respondents made no objection to continuing the hearing to a future date. Motion by Mr. Cloney, second by Ms. Collins, Vote on the motion carried unanimously. 2. Case No. 2018-277 — Violation of Section 34-96, (a), (b), (d) Standards established; section 34-98, (4), (6) Building appearance and maintenance, of the City of Cape Canaveral Code of Ordinances, (516 Jefferson Ave) Donna Mc Allister Poots, Property Owner. Code Enforcement Officer Chris Robinson testified that the property is in Compliance. OLD BUSINESS: None ADJOURNMENT: Meeting adjourned at 7:43 p.m. Aproved on this 'i5S day of PVpt": 1 , 2019.
