A Meeting of the City of Cape Canaveral Board of Adjustment was held on February 12
2007 at the City Hall Annex 111 Polk Avenue Cape Canaveral Florida Connie
McKone Vice Chairperson called the meeting to order at 7 30 P M The Secretarycalledtheroll

1 Motion to Approve the Meetinq Minutes of January 29 2007
Motion by Paula Collins seconded by Jack Childs to approve the meeting minutes of
January 29 2007 with the correction that Jack Childs is changed from an alternate to a
regular member Vote on the motion carried unanimously
2 Motion Re Special Exception Request No 07 03 to Allow a Vehicle Rental

Kabboord Petitioner
David Kabboord Petitioner testified that the property address was changed at the
request of the fire department to 201 Polk Avenue because there is no access on N
Atlantic Avenue He gave an overview of the property history and noted that he
purchased the property in 1995 Mr Kabboord explained that the property was granted
a special exception for vehicle rentals in 1998 and the property vvas granted another
special exception for an animal clinic in 2005

Mr Kabboord advised that he was requesting a new special exception for vehicle rentals
because the animal clinic was moving to a new location He explained that he
redesigned the parking to accommodate the required number of parking spaces He
noted that no major changes would be made to the building He advised that the hours
of operation would be 7 00 a m 7 00 p m there will be a key drop box for vehicles
returned after 7 00 p m there would be no auto sales no repairs and only washing of
the vehicles all water and soap would remain on the property Discussion followed
regarding washing of the vehicles and water runoff
Connie McKone Vice Chairperson noted that the property consisted of more than one
lot Todd Peetz City Planner advised that the property owner must obtain a Unity of
Title for the entire property included with this special exception
Connie McKone Vice Chairperson read letters received from residents Mr Kabboord
contended that the proposed vehicle rental facility would not increase traffic more than
the present use Discussion followed
Craig Stewart citizen commented that the proposed business would not create a traffic
problem and the vehicle rental facility would be a good business for the City
Discussion was held regarding tree limb trimming Mr Kabboord agreed to maintain the
tree limbs to a minimum of 13 ft as requested by the fiie department Discussion
followed regarding vehicle washing and runoff
Motion by Jack Childs seconded by Paula Collins to grant Special Exception Request
No 07 03 with the following conditions
1 Vehicle repairs are prohibited
2 Vehicle sales are prohibited
3 There shall be no excessive amounts of debris or trash
A Vehicle parking shall be limited to 34 vehicles including employeeT
parking
5 Vehicle washing and water runoff shall be contained on site
6 Trees limbs shall be cut and maintained at a minimum of 13 ft 6 in of
vertical clearance
7 The property owner shall obtain a recorded Unity of Title prior to the
occupational license being issued to the business

Stewart Petitioners
Craig Stewart Petitioner explained that he has not been able to proceed with
construction of the proposed single family homes He respectfully requested that the
Board grant him an extension so he can move forward with the project
Connie McKone Vice Chairperson advised that the special exception granted in 2006
was for ten duplexes Mr Stewart responded that he prefers to build his own home
there because there are no real estate sales going on now and it would be unrealistic to
build 10 duplexes with the market the way it is
Discussion was held regarding plans for paving Oak Lane Mr Stewart advised that the
City planned to pave the road when several other roads are paved to be cost effective
Motion by Paula Collins seconded by Jack Childs to approve the time extension
request for granted Special Exception Request No 05 14 Vote on the motion carried
unanimously
There being no further business the meeting was adjourned at 8 20 p m

Sec 110 28 Due process special notice requirements

2 Planning and zoning board
3 Any person aggrieved or affected by any decision ofthe building official in the il1terpretation ofany portjon oflfoischapter
b Appeals shall be taken within 30 days after such adminisLrative decision is made by filing a ritten notice ofappealwiththebuildingofficialandtheboardofadjustmentstatingthenameofthedecisionmakerdateofthedecisionapplicablecodeprovisionsandthespecificgroundsforappealUponreceiptofthenoticeofappealthebuildingofficialshallscheduletheappealbeforetheboardofadjustmentandtransmitalldocumentsplanspapersorothermaterialsconstitutingtherecorduponwhichtheactionappealedfromwastaken
c The board ofadjustment shall be required to review all administrative appeals and prepare written findings constitutingitsfinaldecisionontheadministrativeappealbasedonthecriteriasetforthinthissection7tEdReviewofadministrativedecisionsshallbebasedonthefollowingcriteria

LLC COASTAL This is an appeal of an interpretation by the Building Official for the City of
Cape Canaveral pursuant to City Code 11040 In reply TODD MORLEY states as follows
I STATEMENT OF RELEVANT FACTS
On August 29 2006 COASTAL submitted a request for a special exception pursuant to
City Code 110 354 c 6 for the storage ofliquefied petroleum products specifically liquid
petroleum See EXHIBIT A
On February 1 2007 MORLEY Cape Canaveral Building Official provided an
interpretation to COASTAL s request for a special exception to add additional liquid petroleum
storage tanks on COASTAL s property and stated that the term liquefied petroleum products
does not include liquid petroleum products MORLEY interpreted the above referenced Code
section to only apply to liquefied petroleum and not to liquid petroleum See EXHIBIT B
On November 17 1964 the City adopted Ordinance Number 81 64 See EXHIBIT C
At that time the only reference to the storage of gasoline oil and petroleum was referenced in
Section 8 M 2 Industrial District That particular Section provided that the premises used by
gasoline oil and petroleum storage tanks had to comply with special requirements See Section
8 Special Requirements sub paragraph 3 There was also a clear distinction made in that
Section 8 ofOrdinance 87 64 between gasoline oil and petroleum storage tanks and liquefied
petroleum storage In sub paragraph 4 ofthe special requirements it specifically stated that
The foregoing paragraph requiring an unpierced firewall or dykeshallnotapplytostoragetankscontainingliquefiedpetroleum
commonly known as bottled gas such tanks may be erected without
said wall and dyke
Clearly in 1964 the City Council knew the difference between liquefied petroleum and
gasoline oil and petroleum storage tanks when it adopted Ordinance Number 81 64 Obviously
the City Council recognized this difference because it made a specific distinction between the
storage requirements for each See EXHIBIT C As ofNovember 17 1964 the COASTAL
property was zoned M2 and fell within the conditional use requirements for gasoline oil and
petroleum storage tanks
On July 5 1967 the City Council adopted Ordinance 8l 64 L and created the M3
Petroleum Storage Industrial District That Ordinance alloVved as a permitted use storage of
petroleum products Interestingly enough the special requirements for gasoline oil petroleum
storage and liquefied petroleum as appeared in Ordinance 81 64 remained the same without
change This clearly showed that the City Council again knew the distinction betveen petroleum
products such as gasoline and oil and liquefied petroleum which is commonly known as bottled

thereby fell within the parameters ofOrdinance 81 64 L
On August 3 1971 the City Council adopted Ordinance 12 71 See EXHIBIT E In
that Ordinance there was created the M3 General Industrial District which provided as one ofits
principal uses the storage ofliquefied petroleum products providing that all such uses comply
with the standard set out in the National Fire Prevention Association s pamphlet 58
Furthermore the M3 General Industrial District provided prohibited uses and structures to be the
same as in the M2 zoning district except that above ground storage ofliquefied petroleum
products is a permitted principal use in the M3 district Interestingly enough no provisions were
made for the storage of gasoline oil and other liquid petroleum
Approximately February 15 1983 the City Council adopted Ordinance 2 83 which
provided in part for the M 1 Light Industrial and Research and Development District That
Ordinance specifically Section 638 07 H provided that the storage ofliquefied petroleum
products would be a special exception permissible by the Board of Adjustment See EXHIBIT
F No provisions were made for liquid petroleum products such as gasoline and oil
The present matter involves an interpretation by MORLEY Cape Canaveral Building
Official ofthe words liquefied petroleum products as used in City Code Section 110
354 c 6 COASTAL argues that because the City has allowed the storage ofliquid petroleum
i e gas oil etc the City has established a definition of liquefied petroleum MORLEY has
interpreted that term liquefied petroleum as used in the current City Code to have a specific
meaning hich does not include liquid petroleUlTI such as gasoline oil etc

COASTAL has filed this administrative appeal pursuant to Section 110 40 a 3 This is
an appeal by a person aggrieved or affected by the decision ofthe Building Official in the
interpretation of any portion ofthe Land Development Code Review ofadministrative decisions
shall be based on the following criteria
1 Whether the applicant was properly afforded procedural due process
2 Whether the decision under review is supported by competent substantial
evidence
3 Whether the decision under review complied with applicable law including a
proper interpretation ofany provision under this Chapter See Section 110
40 d I 3
COASTAL has not argued that it was denied procedural due process Therefore this
appeal implicates Sub Sections d 2 and d 3 ofSection 11 0 40
III LEGAL ARGUMENT
COASTAL argues that the City has established a definition of liquefied petroleum
products over the years to include liquid petroleum i e gasoline oil etc It is Morley s
position that past interpretations by prior Building Officials were wrong and that the wrongful
interpretation should not be allowed to perpetuate
Clearly the City distinguished between liquid petroleum and liquefied petroleum as early
as 1964 The Code back then concerning the M2 Industrial District provided for different
criteria for the storage ofgasoline oil and petroleum and liquefied petroleum See Exhibit C
This clearly shows an intention on the part ofthe City Council to differentiate between liquid
petroleum and liquefied petroleum

The same can be said with respect to Ordinance 81 64 L adopted on July 5 1967 See
Exhibit D That Ordinance in Section 8A allowed as a principal use the storage ofpetroleum
products However the special requirements section again differentiated between gasoline oil
and petroleum and liquefied petroleum The City clearly maintained its intent to distinguish
between the two and not to include the term liquefied petroleum in any definition of liquid
petroleum or vise versa
With the adoption ofOrdinance 12 71 See Exhibit E the City for the first time
eliminated all references to gasoline oil and petroleum and allowed as a principal use in the M3
zoning district the storage ofliquefied petroleum products that comply with the standards set out
in the National Fire Prevention Association s pamphlet 58 The same is true when the City
adopted Ordinance Number 2 83 on February 15 1983 See Exhibit F The removal of
references to gasoline and oil and the continued use ofthe term liquefied petroleum clearly
shows an intention on the part ofthe City Council to authorize only that which is defined as
liquefied petroleum and not liquid petroleum If the City Council as the legislative body
intended to include the term liquefied petroleum to be the same as liquid petroleum or vise
versa it could have done so Thus since the City Council did not provide for such a definition
one cannot assume that it must have intended the two to be similar or synonymous See J II
Investments Inc v Leon County 908 So2d 1140 Fla 1 DCA 2005 Furthermore the previous
interpretations by the Building Official were completely erroneous incorrect and not binding on
the City
As previously stated gasoline and oil were permitted to be stored up until the 1971
adoption ofOrdinance 12 71 Up to that point there was a specific distinction between gasoline
oil and liquefied petroleum Clearly when the City Council adopted Ordinance Number 12 71

it was well aware ofthis distinction and chose to eliminate the allowance of storing ofoil
gasoline and other petroleum and only permitted the storage of liquefied petroleum
The product known as liquefied petroleum was not something new to the City Councilor
to the nation in 1971 In fact liquefied petroleum dates as far back as 1887 and it is believed that
May 17 1912 is the date the LP Gas Industry marks its birth See The First Fifty Years ofLP
Gas an Industry Chronology LPGA Times 1962 See EXHIBIT G Not only were the prior
interpretations by the Building Official wrong current Florida law supports MORLEY s
interpretation ofthe term liquefied petroleum Therefore the Board ofAdjustment would not
be bound by the previous interpretation ofthe Building Official as these prior interpretations
were clearly erroneous See Florida Wildlife Federation v Collier Countv 819 So2d 200 Fla1

For instance Florida Statute 376 301 33 defines petroleum product to mean any liquid
fuel excluding liquefied petroleum gas See EXHIBIT H See also 62 762 201 58 Florida
Administrative Code defining petroleum product and providing for a specific exemption of
liquefied petroleum from that definition See EXHIBIT I See also Section 62 761 200
Florida Administrative Code See EXHIBIT J
The Florida Legislature also established Chapter 527 concerning the sale ofliquefied
petroleum gas Florida Statute 527 01 defines liquefied petroleum gas to mean any material
which is composed predominately ofany ofthe following hydrocarbons or mixtures ofthe
same propane propylene butanes normal butane and isobutene and butylenes See
EXHIBIT K Interestingly enough gasoline oil kerosene or other petroleum products are not

extremely helpful in distinguishing between liquefied petroleum and other petroleum products
and clearly shows that there is a legal distinction between the two l
COASTAL s position is that the City s actions since 1971 clearly evidence that the
phrase liquefied petroleum was used in a generic sense and was intended to allow the
continued expansion ofCOASTAL s existing uses This interpretation is clearly incorrect First
as previously shown the earlier versions ofthe Code clearly distinguished between liquefied
petroleum and other types ofpetroleum i e gas and oil That distinction was no longer carried
over after the 1971 change to the Code If the City Council wanted to continue this distinction it
could have done so but chose not to do it It was clearly the intention ofthe City Council to
authorize only liquefied petroleum as that term is defined under the law and not to use that term
in the generic sense to include all types ofpetroleum storage The Board of Adjustment
should not allow the continued improper interpretation of the Code by past actions Such
interpretation was clearly erroneous on the pari ofthe previous Building Officials and the Board
ofAdjustment is now in the position to apply a proper definition of liquefied petroleum
consistent with Florida law Insomuch as the prior interpretations were clearly erroneous the
Board of Adjustment is not bound by those interpretations See Florida Wildlife Federation v

liquefied petroleum in Florida Statute 527 01 1981 Additionally the Florida Legislature did
not include liquefied petroleum as a pollutant in Florida Statute 376 021 7 defining pollutants as
oil of any kind and in any form gasoline pesticides ammonia chlorine and derivatives thereof
That being the case the City Council is presumed to be aware ofthe distinction in Florida law
and that liquefied petroleum had a specific definition and therefore that definition ofliquefied
petroleum in Chapter 527 is incorporated into the Ordinance2 83 Therefore upon enactment of
Ordinance 283 the term liquefied petroleum had a specific meaning under Florida law and
the City could not provide for a different meaning Any interpretation by Building Officials
which used liquid petroleum and liquefied petroleum as synonymous or to include liquid
petroleum in a definition ofliquefied petroleum is clearly erroneous and can be ignored See J

1971 Standing for the proposition that a municipal ordinance may not contravene state law
The Petitioner s argument is one that raises the principles ofestoppel against the City
However the principles ofestoppel will not apply to a municipality where the initial grant by the
City was ultra vires and void As previously shown liquefied petroleum under the law has a
different meaning than liquid petroleum The interpretations ofthe prior Building Officials and
grants by the City were clearly contrary to applicable Ordinances and there was no specific
authority to allow the expansion ofthe storage ofliquid petroleum on COASTAL s site As
such these grants were void and the City would not be estopped from requiring only the storage
ofliquefied petroleum as defined herein on COASTAL s site See Town ofLauderdale bv the
Sea v A eretskJ 773 So 2d 1245 Fla 4 DCA 2000 The current interpretation by MORLEY is
the correct interpretation and the Board ofAdjustment should support this interpretation and only
permit the storage of liquefied petroleum as defined herein on COASTAL s site
