HomeMy WebLinkAboutcocc_dottys_bar_crobinson_report_201901 On March 17, 2017 staff received a complaint of people living in a room next to Dottys' Bar. On March 20, 2017 1 conducted a site visit, but was unable to confirm anyone living in this room. I did speak with the Thrift Store owner and he stated there are two girls that live in the room next to the bar. On March 31, 2017 1 conducted another site visit but no one would answer the door. I was informed by a neighboring tenant that there are two girls living there with a few friends from time to time. On April 5, 2017 staff received another anonymous complaint about a girl living next door to Dotty's Bar. Staff was advised that the property owner, Shane Reynolds has his niece living in the store attached west of Dotty's Bar.The complainant continued that there is a constant flow of people coming and going from the store and has witnessed drug use and they get confrontational with bartenders and patrons of the bar. I advised that we have an open case on the matter and are aware of the possible violations. On April 6, 2017 staff along with the Fire Inspector conducted a site visit.The owner of Dotty's Bar allowed us entry to inspect the premises. Upon entry we found many damaged ceiling tiles from water, holes in the ceiling,water damaged window frames and walls, outdated fuse panel, damaged electrical wiring, exposed electrical outlets, damaged drain pipes and exit sign wiring not in a conduit.The exterior had damaged eves, rotted water damaged doors, dilapidated fence,feces in the back yard area, decomposing vegetation,trash piled up, an inoperable lawn tractor, no visible address posted and unpaved and unclearly marked parking area with too few parking spaces. We attempted contact with the resident allegedly living in the empty store, but no one would answer. I did hear someone inside and the car belonging to the person believed to be living there (Nicole)was parked to the side of the building. We then made contact with George,the father of the property owner. He advised his son is in the area and he will tell him we were here. George also stated Nicole is here but does not know where she is right now, but confirmed her car was here. The Fire Inspector left a card with George to have his son call so the empty store can be inspected. On April 10, 2017 1 was contacted by the Fire Inspector advising that has an appointment to inspect the empty store if I would like to meet him. I met him at fpm and were allowed in by George Reynolds. We observed clear signs of people living in this building.There were two beds, a couch with a television in front of it hooked up to power, dressers full of clothing, shoes on the ground, clocks with current times, shampoo and soap in the bathroom, microwave and refrigerator. Even after all that they maintain no one is living in the building. On April 26, 2017 1 conducted a site visit and observed a back fence had been installed and no permit was applied for. Mr. Reynolds was not home, but I spoke with "Cowboy', a tenant of the thrift store, who informed me he had spoken with Mr. Reynolds about the Notice of Violation I sent him. I told "Cowboy"that I have not heard from Mr. Reynolds and it would be in his best interest to contact me so we can go over the violations and come up with a plan to come into compliance. On May 3, 2017 1 met with Shane Reynolds at his property and walked through all the violations that need to be addressed. I started with all the quicker and least expensive fixes up to the more involved. He said he would get started right away but it would be as finances allow. On May 18, 2017 a site visit revealed the fence that was being installed without a permit has been removed and the empty store where people were living has been cleaned out. On May 23, 2017 the owner of Dotty's Bar came in and said a new person is now living in the store. She also advised the property owner is demanding that they fix the issues I pointed out to him in the bar because it is their responsibility. I advised her that it is not their responsibility but his to fix the issues pointed out. He told them they have to relocate the sink, but they said it will cost about$120.00 and he needs to do it. She said he told them he will just rip it out and they will have no sink. I explained that I have sent a notice of violation and there is no further action I can take at this time. We need to allow the process to unfold so I can take him to Code Board and have him found in violation. On June 22 Phone contact was made with Shane Reynolds for an update on his progress of addressing the violations. He said he is working on the electrical right now trying to get the funds to complete that. Once he has completed that he will move to the parking lot. On July 18 a site visit revealed the inside roof panels and water damage were repaired. No visible electrical done and no outside repairs done. On September 5 staff was notified by the fire inspector that the sink under the electrical panel has been removed. On September 19 staff was informed that people are again living in the empty store and causing problems for patrons at Dottys' Bar. On February 1, 2018 a new asphalt paved surface was observed on the east side of the building with no permit. I contacted owner and informed him of the violation and the need for a permit. I told him the asphalt will need to be removed. On May 1, 2018 the asphalt has not been removed. On May 17, 2018 a tiki bar was being constructed in the back area without a permit. The structure is too close to the building and the property line, it exceeds the maximum height and Dotty's Bar does not have the proper licensing to serve alcohol outside. A stop work order was posted and the owner was informed of the violations and told to remove the bar. June 7, 2018 the bar has not been removed. August 13, 2018 no chang, the bar remains and no permit applications have been applied for building the bar or anything from Dotty's Bar to allow alcohol to be served outside. August 24, 2018 Shane Reynolds came into City Hall demanding to know why he is getting picked on. I explained to him I have not spoken with him since May when the unpermitted structure was found being built and I posted a stop work order. I informed him all he needs to do is have a contractor pull a permit and submit plans for the structure and we will see if it meets code and if not what needs to be done so it does. Shane became extremely confrontational and belligerent to the point he was told to leave the property.The Sheriff's Office was contacted and Shane was trespassed from City Hall August 29, 2018 a woman identifying herself as Shane's fiance came in and inquired about the notice of violation. She said we obviously sent it in retaliation to Shane's behavior the week prior. I explained that the majority of the violations are from the previous notice and a new one was sent to address the parking lot being paved and the bar being built without permits. We were working with Shane but he now will not listen to what we have to say so it left us no choice but to send a new notice. I also informed her that after the five days is up we are sending an order to appear and taking the case before code board. We are seeking to find the property in violation and asking that liens be assessed. If they wish to have more time to come into compliance it will have to be granted by code board, I'm not interested in giving more time at this point. On September 20, 2018 staff presented this case to Code Board. They heard the case and gave the property owner until the next hearing to have permits pulled for the tiki bar and serving but and a plan to complete the remaining violations on the property. On October 11, 2018 staff was informed there would not be enough code board members to have a quorum,therefore, the hearing for October 18 was cancelled and won't be re-scheduled until after the new year begins. On November 20 and the 26th Shane submitted permits for the paving of the parking lot and the building of the tiki bar. On January 9, 2019 it was discussed bringing this case back to Code Board, but since Shane has been correcting the violations staff is giving more time in hopes of being found in compliance when the matter is taken back to code board.
