Traditionally,the Qualifying Period is the time when all qualifying paperwork is submitted to the Qualifying Officer (me); it is also the time when the Qualifying Officer provides the Candidate with the Candidate and Campaign Treasurer Handbook and necessary forms. However, individuals interested in announcing their candidacy prior to the Qualifying Period may do so provided they file the Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates (DS-DE9) with the City Clerk's Office prior to opening a campaign account, receiving campaign contributions or making campaign expenditures. Once the Campaign Treasurer is designated, Campaign Financing Reports must be submitted. The Campaign Treasurer or Deputy Campaign Treasurer must be a registered voter in Florida. A Candidate may appoint him/herself as Campaign Treasurer or Deputy Campaign Treasurer. Each Candidate must file a Statement of Candidate (DS-DE 84) with the City Clerk's Office within 10 days after filing the Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates stating that the Candidate has read and understands the requirements of Chapter 106, Florida Statutes. Willful failure to file the Statement of Candidate Form is a violation of ss. 106.19(1)(c) and 106.25(3), Florida Statutes. A Candidate may also have to resign-to-run as applicable in Section 99.012 F.S. Each Candidate is responsible for complying with all applicable election laws. Office Open — Two (2) City Council Seats, currently held by John Bond and Mike Brown. The names of the candidates are listed on the ballot in alphabetical order of their surnames. The two candidates receiving the highest number of votes shall be declared the winners upon certification of the Election by the Brevard County Supervisor of Elections/Canvassing Board. Term of Office—Council Member- Three years, through November 2019. On that date, you also filed several election documents with my office including Announced Candidate Packet acknowledgement, DS-DE 9 Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates, Announcement of Intention to become a Candidate for Office, and the DS-DE 84 Statement of Candidate. As the City Clerk for the City of Cape Canaveral, I serve as the City's Elections Qualifying Officer and filing officer for receiving campaign finance reports from candidates running for City Council. Recently I informed you that I may have inadvertently provided to you the wrong starting date for you to commence filing campaign treasurer's reports related to the upcoming City Council election. I have since given you the correct date, but I believe it is appropriate for me to memorialize the correct starting date in writing. Further, I want to advise you again about several other filing requirements due to the fact that recently you erroneously filed a campaign treasurer's report with the Brevard County Supervisor of Elections. First, please be advised that all campaign treasurer's reports for the upcoming City Council election must be filed in my office by the reporting due dates stated in the schedule which I have attached to this letter. This schedule was previously provided to you when we met in my office to discuss the City's election package. This reporting schedule is established by the State pursuant to Section 106.07, Florida Statutes. However, during our meeting, I told you that you did not need to start filing your campaign treasurer's report until such time that you opened your campaign account with your designated campaign depository (bank). That information was incorrect and I apologize for providing it to you because it may have resulted in you filing your first report late. For the record, I realized that I may have provided you with the wrong information on Friday, July 1, 2016, the due date of your first report for the Period of 6/01/16 —06/24/16. However, after the holiday, I was able to reach both agencies on July 5th. Each agency confirmed that a candidate must start filing campaign treasurer's reports as soon as Form DS-DE 9 is filed with the Qualifying Officer. Because you filed your DS-DE 9 in my office on June 23rd, your first report was due to be filed in my office on July 1St On July 5th I contacted you to share the results of my conversation with the Division of Elections and Brevard Supervisor of Elections. I also followed up with an email that day. During our conversation, you stated that you had not opened your campaign account yet. Therefore, you had no campaign expenditures or contributions to report. As a result, I advised that you are required to file a Waiver Report Form DS-DE 87 because you are still required to notify my office in writing on the due date that no campaign report is being filed on that date because you did not receive any campaign contributions or expended any campaign funds during the reporting period. This written notice, in the Form of DS-DE 87 is required by Section 106.07(7),Florida Statutes. You filed that report in my office on July 5, 2016. Subsequently, in order to avoid any confusion regarding your next filing deadline, I emailed you on Tuesday, July 12, 2016, to remind you that your next campaign treasurer's report was due on Friday, July 15, 2016. Further, on Friday, July 15, 2016, I also called you in the afternoon to remind you that your report was due. You informed me that you were out of town and requested that I email a Waiver of Report Form DS-DE 87 to you because you again had no contributions or expenditures to report for the reporting period. I also proceeded to provide you with a link to Florida Statute 106.07 and advised that the statute stated, "...reports shall be filed no later than 5 p.m. of the day designated. A report postmarked by the U.S. Postal Service no later than midnight of the day designated is deemed timely filed. A report received by the filing officer within 5 days after the designated due date that was delivered by the U.S. Postal Service is deemed timely filed unless it has a postmark indicating the report was mailed after the designated due date." On Monday, July 18, 2016, I received an email from Michele Nemschick at the Brevard County Supervisor of Election's office. She advised me that their office received a Financial Report Code P2 from you for the Period of 6/25/16—7/8/16 that day and it was postmarked 7/16/2016. I called Ms. Nemschick and she informed me that she would send the report to me via US Mail and I have since received the report. After speaking with Ms. Nemschick, I called you shortly thereafter and informed you that your report was late and should not have been mailed to the Supervisor of Election's office because I am the filing/qualifying officer for this City. Please be advised that candidates running for the City Council are required by law to file campaign reports with my office by the due date on the attached schedule. If my office determines that a report is late, my office is required by law to impose a statutorily prescribed fine for each day that the report is late per Section 107.06(7)(b), Florida Statutes. The fines imposed are generally between $50 to $500 per day for each late day covered by the late report. Florida law requires that you are required to pay fines out of personal funds. In other words, fines cannot be paid from City of Cape Canaveral City Clerk's Office July 22, 2016 Page 3 of 3 campaign funds. Further,my office is required to notify the Florida Elections Commission of the repeated late filing by a candidate and the failure of a candidate to file a report after notice or failure to pay a fine. Because of this situation, I have consulted with the City Attorney regarding whether my office is required to impose a fine on the two late "waiver" reports. I have been advised that because you did not receive any campaign contributions or made campaign expenditures during the two reporting periods at issue, my office is not required to impose a fine based on Florida case law. However,although a fine is not being imposed under these very narrow and limited circumstances, you are still required to notify my office in writing on the due date that no campaign report is being filed on that date because you did not receive any campaign contributions or expended any campaign funds during the reporting period. This written notice, in the Form of DS-DE 87 is required by Section 106.07(7),Florida Statutes. Further,"willful"violations of all of the campaign reporting requirements, including the notice required by DS-DE 87, could subject a candidate to a legal action being brought by the Florida Elections Commission pursuant to Section 106.25, Florida Statutes and subject a candidate to sanctions including fines per Section 106.265, Florida Statutes. Finally, I have attached several documents supporting the statements in this letter for your files. Please understand that I take full responsibility for my error and trust that the both of us will learn from our missteps in this election process. This letter is intended to not only document my previous error, but to assist you with complying with the campaign reporting requirements. It is my hope that you will timely file the remaining campaign reports which will be due this City Council election cycle and my office will not have to address any additional late filings of campaign treasurer's reports. As the Qualifying/Filing Officer for this City, I will not be able accept a copy of the form. I spoke with the Brevard County Supervisor of Elections Candidate Coordinator Michelle Nemschick who informed me that I will need to fine you $50.00 per day for each late day, not to exceed 25 percent of the total receipts or expenditures, whichever is greater for the period covered by the late report. All fines must be paid from the candidate's personal funds—not campaign funds. (Section 106.07(2) and(8), F.S.).
