Joshua:
I want to thank you and Council Member Morrison for following up on
this. I’m sure your agenda is full with many city projects.
With all the improvements the city has made and continue to do, this
small section of Ridgewood Avenue is an eyesore to the area. I invite
you to visit this path and see first hand for yourself. Regardless of
the outcome, I’m sure any action taken is better than no action at all.

My name is Joshua Surprenant, I am the Community Engagement
Director and Public Works Services Deputy Director for the City of Cape
Canaveral. I was copied on your communications with Council Member Wes
Morrison regarding the path that leads to the beach between Ocean Oaks
and Ocean Woods. I have received multiple emails and phone calls
regarding this area in the last two weeks from several interested
parties. I am currently working to research this beach path to determine
the ownership and maintenance responsibility.
From conversations with multiple City departments and some
independent research I’ve found that
· According to the City arborist, it was approximately
five years ago when he was last in the Ridgewood Ave City roadway
easement planting new tress and removing Brazilian Pepper Trees. (in
faded purple area below)
o This tree work was required by Ocean Oaks as part of a tree
mitigation agreement in 2011
· NO work was authorized on Ocean Woods property (in red
below) – including the beach path (blue line below)
· According to the Brevard County Property Appraisers
website, sent to you by Council Member Morrison, the beach path crosses
Ocean Woods property (in red), a City roadway easement (circled in
yellow) and ends in Ocean Oaks property (circled in blue).

My next steps are to work with the City Attorney to explore
titles, and have the easements/lines surveyed. As a longtime resident of
Brevard County and Cape Canaveral (who learned to surf at this beach
access), I was never under the impression that this access was
maintained by the City. City beach access/crossover areas are well
maintained, landscaped, signed, have WastePro cans/trash service, etc.
This beach path is not on the Public Works Services beach area/crossover
maintenance schedule, and it has not been included in the Capital
Improvement Plan.
Any documents you (or your HOA) can supply me regarding land
use, easements, etc would be of great help to me. It may be determined
that the responsibility and maintenance of this beach path does not fall
on the City, at which time I envision a meeting between Ocean Woods and
Ocean Oaks HOA presidents and myself taking place.
****On a side note I have received multiple reports of golf cart
use on this beach path, and on the beach immediately exiting this path.
Motorized vehicles are prohibited on the dunes and ocean beach unless
such vehicle is propelled by nonmotorized power

result I have contacted the Brevard County Sheriff’s Office to monitor
