ROLL CALL:
PUBLIC PARTICIPATION: The public may address items that do not appear on the agenda and
any agenda item that is listed on the agenda for final official action by the Community Appearance
Board excluding public hearing items which are heard at the public hearing portion of the meeting,
ministerial items (e.g. approval of agenda, minutes, informational items), and quasi-judicial or
emergency items. Citizens will limit their comments to three (3) minutes. The Community
Appearance Board will not take any action under the "Public Participation" section of the agenda.
The Community Appearance Board may schedule items not on the agenda as regular items and act
upon them in the future.

MEETING MINUTES
April 18, 2018
A Meeting of the Community Appearance Board was held on April 18,2018, at City Hall Council
Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Chairperson Randy Wasserman called the
meeting to order at 6:00 p.m. The Secretary called the roll.

NEW BUSINESS:
1. Approval of Meeting Minutes—February 7, 2018
Motion by Mr.Nienstadt, seconded by Mrs. Lanham to approve the Meeting Minutes of February
7. 2018. The motion carried unanimously.
2. Golf-n-Gator Amusement Center— Mike Allen, PE, Applicant/Golf-N-Gator, LLC, Owner
—Parcel#24-37-26-00-287—6355 N. Atlantic Avenue. A Level 1 Application consistent with
Chapter 22,Article III of Cape Canaveral Code of Ordinances.
Mr. Dickey presented Staff's report/photos. Staff explained the proposed project is located in Cl
zone,which allows"outdoor commercial recreation." Staff recommended approval of the Level 1
application.

Meeting Minutes
April 18, 2018
Mike Allen, Applicant's representative, explained there would be a concrete structure for
spectators, underground retention; hours of operation to remain the same as the current use and
LED lighting will be used.
Discussion ensued to clarify some of the concerns regarding signage, retention, landscaping and
colors of building/roof,height of race track and safety.
Lila Gilbert,resident, asked the following: hours of operation(10a-10p), number of go-carts(15)
on track at one time; speed(20 mph) and the sound level be kept to a minimum. These questions
were addressed by Mr.Kabboord,Applicant. Grace Cavanaugh,resident,had noise level concerns
regarding sounds traveling.
Motion by Mr.Wasserman,seconded by Mr.Nienstadt to recommend approval as presented. Vote
on the motion carried unanimously.
3. Per Section 2-171 of the Code of Ordinances,the Community Appearance Board shall elect
a Chairperson and Vice-Chairperson,by majority vote,at the first meeting held in January,
unless there is no January meeting,then the next meeting held.
Motion by Mrs. Lanham, seconded by Mrs. Sweet to recommend Mr.Wasserman as Chairperson,
who accepted. Vote on the motion carried unanimously.
Motion by Mrs. Lanham, seconded by Mrs. Sweet to recommend Mr. Nienstadt as Vice
Chairperson,who accepted. Vote on the motion carried unanimously.
REPORTS AND OPEN DISCUSSION:
Discussion regarding building colors within the City, Code requirements, application process and
violations. Mr. Dickey explained that Code Enforcement is the point of contact for these types of
concerns.
ADJOURNMENT:
Motion by Mr. Wasserman. seconded by Mrs. Sweet to adjourn the meeting at 7:02p.m. Vote on
the motion carried unanimously.

Subject: Level 2 review for the use of a Wall Mural at 7814-7822 N. Atlantic Avenue (Parcel
ID#24-37-23-CG-25-1).

Summary: This item consists of an application for a Level 2 approval for the use of a Wall
Mural at the structure located at 7814-7822 N. Atlantic Avenue (Attachment 1). The property
includes two structures,one facing N. Atlantic Avenue,with a smaller building to the east facing
Monroe Avenue (Attachment 2). The primary structure, facing N. Atlantic Avenue, includes a
bar(Kennedy's Lamp Post)and the Cape Laundromat(Building 1). The smaller building,which
faces Monroe, appears to be vacant(Building 2).
In October of 2018,City Staff notified the owner of the subject property that the recently painted
wall mural (Attachment 3) on Building 1 was not allowed without prior approval of the City
Community Appearance Board (CAB) (Sec. 94-6 (g)). A Wall Mural is defined as a painting or
artistic work composed of an arrangement of color and that displays a commercial or
noncommercial message, relies solely on the side of a building for rigid structural support and
is painted on the building. The term excludes a painting or work placed on a structure that is
erected for the primary purpose of signage.
As indicated above,a Wall Mural may be allowed if approved by the CAB under the community
appearance review standards set forth in Section 22-36 of the City Code. Note that these criteria
were established to evaluate both Level 1 and Level 2 applications; so not all may apply to the
subject request. Criteria include:
1. The plans and specifications of the proposed project indicate that the setting,
landscaping, ground cover, proportions, materials, colors, texture, scale, unity, balance,
rhythm, contrast and simplicity are coordinated in a harmonious manner relevant to the
particular proposal. surrounding area and cultural character of the community.
2. The plans for the proposed building or structure are in harmony with any future
development which has been formally approved by the city within the surrounding area.
3. The plans for the proposed building or structure are not excessively similar or dissimilar
to any other building or structure which is either fully constructed, permitted but not
fully constructed, or included on the same permit application, and facing upon the same
or intersecting street within 500 feet of the proposed site,with respect to one or more of
the following features of exterior design and appearance:
a. Front or side elevations;
b. Size and arrangement of elevation facing the street, including reverse arrangement;
or
c. Other significant features of design such as, but not limited to: materials, roof line
and height or design elements.
4. The plans for the proposed building or structure are in harmony with the established
character of other buildings or structures in the surrounding area with respect to

architectural specifications and design features deemed significant based upon
commonly accepted architectural principles of the local community.
5. The proposed development of the building or structure is consistent and compatible with
the intent and purpose of this article, the Comprehensive Plan for Cape Canaveral, and
other applicable federal, state or local laws.
6. Within the C-1, C-2, and M-1 zoning districts, any exterior building or roof color used
shall be well designed and integrated with the architectural style of the building and
surrounding landscaping in order to create a subtle and harmonious effect and promote
aesthetic uniformity within the district. Bright or brilliant colors shall not be permitted
except for use as an accent color within the C-1, C-2, or M-1 zoning district.
The Wall Mural is proposed to be located on the west and north walls of Building 1, which
fronts N. Atlantic Avenue and Monroe Avenue. As indicated in Attachment 4, the mural
includes faux bricks, a depiction of a man and woman standing next to a lamppost along with
other associated images. Also, the request includes wording that the applicant wishes to place
on Building 2, that states "We Support our Police, First Responders, Military Flag."
Over the past several years, the CAB has approved a number of wall murals. Several have been
associated with fraternal organizations to include the VFW and the American Legion. Because
they were fraternal organizations, Staff supported the requests. However, in February of this
year, the CAB approved a request for a wall mural for the Core Surf store on N. Atlantic. The
proposed mural included a surfing scene, which is related to the applicant's business. For this
reason Staff did not support the request.
Wall murals can create an opportunity for additional signage above that allowed by City Code.
The existing businesses in Building 1 have signage (wall) as indicated in Attachment 2. As the
Wall Mural includes images related to the goods/services being offered at the businesses
(specifically the bar),it is recommended that only the lettering,faux bricks&vines be approved.
Also, these images are consistent with established criteria in Sec. 22-36 of the Code. Lettering
sizes and mural colors are indicated on Attachment 4.

The CD Staff recommends that the Community Appearance Board take the following
actions:
1. Approve the use of a Wall Mural on Building 1,which is limited to the following images:
faux bricks, vines and lettering as shown on Attachment 4, and
2. Approve the statement "We Support our Police, First Responders, Military Flag" on
Building 2 as shown on Attachment 4.
