Subject: 305 Surf - Memo regarding authority to enter property
Hi all,
Please find attached a short memorandum describing the City’s legal
authority to enter the property at 305 Surf Drive to abate the nuisance
of the swimming pool and screen enclosure. I have also included the
relevant Attorney General Opinion and the NOV for your convenience.
This memo and attachments may be presented to the Sheriff’s Office if
they are called to the scene by the property owner in the event he
challenges the City’s authority to enter.
