Staff would like some guidance on an inspection warrant for 305 Surf
Dr. The owner was sent a Notice of Violation for property maintenance in
March 2015 however the owner refused us access to his backyard so he was
found in compliance once the front of the property was cleaned. We
received another complaint regarding the condition of the rear of the
property, staff was able to gain access to the neighbor’s property and
could observe the fence was falling down and what appeared to be a hole
in the roof. The pool has popped out of the ground and staff was unable
to see into the pool to verify if contains stagnate water. Staff sent a
Notice of Violation to the property owner for the dilapidated fence and
the hole in the roof. Staff contacted the owner and asked if we could
have access to the rear of the property which the owner refused.
The property is homesteaded and there are no life safety issues at this
time. The City Manager would like to know if there was any way we could
get an inspection warrant for the property.
