HomeMy WebLinkAboutVacation_Rental_ProcedureCitv of Caine Canaveral Procedure for Establishing a Vacation Rental in an Existing Residential Structure April 27, 2012 This document is intended to provide a simple, straightforward set of instructions toward lawfully establishing a Vacation Rental property. It is comprised of the following eight steps: 1. Submit an application for a permit to change the Occupancy Classification to RI Transient. 2. When it's ready, pick up your permit for a Change of Occupancy Classification to R1 Transient 3. Initial Inspections 4. Contractor applies for a permit to correct deficiencies (if any) 5. Contractor to pick up the permit for the correction of deficiencies (if any) 6. Obtain the new Certificate of Occupancy 7. Obtain the State License 8. Obtain a Local Business Tax Receipt The following pages go into greater detail and provide helpful links and other helpful information. If you have any questions about this process, please contact the Building Department at (321) 868-1222. Submit an application for a permit to change the Occupancy Classification (R-1 Transient). Any owner or authorized agent (jointly referred to herein as "Applicant") must complete a Building Permit application, requesting a Change of Occupancy Classification (FBC Sec. 105.1). Occupancy Classification codes from the FL Building Code Sec. 310: Classification Code What the classification means: R1 Transient Residential Occupancy (Vacation Rental) R2 Permanent Residential Occupancy for Multi -family, more than 3 units (such as a condo) R3 Permanent Residential Occupancy for Single -Family For example, if you wish to convert your Single -Family home into a Vacation Rental home, you will need to write "Current R3; Requested R1" on the application. It's important to note that this application is only for a permit to change the occupancy classification. It will not authorize any construction or improvements to the property. When it's ready, pick up your permit for a Change of Occupancy Classification (R-1 Transient). The Building Department Staff will prepare the "Change of Occupancy" Permit and call the Applicant when it is ready to be picked up. The Applicant must be the one who signs for the permit. Upon payment of the applicable permit fee ($49), a Change of Occupancy Classification Permit will be issued; it will include an inspection card. This permit expires in six months. This permit, in itself, is not an approval of a request for a Change of Occupancy Classification. It is the method by which the City can conduct the necessary inspections in order to determine what, if any, deficiencies exist in order to ensure compliance with the new Occupancy Classification. We will use a standardized checklist. This checklist is available to you at any time, upon request. Note: This is not an all-inclusive list - only a collection of common compliance items. No Structural, Mechanical, Electrical and/or Plumbing work is authorized by this permit (FBC Sec. 105.4.1). 3. Initial inspections. Building and Fire Department inspections are required (FBC Sec. 110.1). When ready, the Applicant need only contact the Building Department at (321) 868-1222. We will schedule the necessary Building and Fire Department inspections with you. The purpose of the inspections is to identify any deficiencies related to the new Occupancy Classification. Inspection approval is required (FBC Sec. 110.6). The inspections will either pass or fail. If the inspection passes, please go to step #6. If the inspection fails: a. The deficiencies will be provided to you in written form. A re -inspection fee will need to be paid prior to any re -inspection ($45). b. The Inspector shall notify the Applicant if any deficiencies will require an additional permit. If there are deficiencies that require a permit, the owner will be required to hire a Contractor to make the required corrective measures. Prior to doing any work, your contractor will need to submit a separate permit application for the work. 4. Contractor applies for a permit to correct deficiencies (if any). A permit for any Structural, Mechanical, Electrical and/or Plumbing work will only be issued to an appropriately licensed Contractor (FS 489.105). Note: The permit cannot be issued to an Owner/Builder. This is because the property will be for lease {FL Statutes 489.103(7)(a)}. 5. Contractor to pick up the permit for the correction of deficiencies. After paying for and picking up the permit, the Contractor may perform the work. The permit fee varies — it is based on the value of the work to be done, see fee table below. The permit will include an inspection card. This permit expires in six months. Once your Contractor has finished the work described in the permit, he or she must request an inspection. The inspection will either pass or fail. If the inspection passes, please go to step #6. If the inspection fails, a listing of deficiencies will be provided to the Contractor in written form. A re- inspection fee will need to be paid prior to any re -inspection ($45). This step repeats until all items have been corrected and the final inspection passes. Then proceed to step #6. 6. Obtain the new Certificate of Occupancy. When the inspection passes, the Inspector(s) will sign the on-site permit hard card(s). The Applicant must then apply for a new Certificate of Occupancy (FBC Sec. 111.1). The Certificate of Occupancy application is available on our city website at www.cityofeapecanaveral.org. Or click on this link: http://www.cityofcapeeanaveral.org/index.asp?Type=B BASIC&SEC={3DA07D47- C8E 1-4160-B77E-057C548F63901 Upon payment of the applicable Certificate of Occupancy fee ($50), the City shall issue the new Certificate for the new use (R1). Proceed to Step #7. 7. Obtain the State License. The Applicant shall obtain a "Vacation Rental" license from the FL DBPR Div. of Hotels and Restaurants (F.S. Sec. 509.241). The application is available online. The State will mail you a notice when it is time for renewal. Upon obtaining the State License, proceed to Step #8. 8. Obtain a Local Business Tax Receipt (LBTR). The Applicant shall apply for and obtain the LBTR from the City of Cape Canaveral (City Code Sec. 70-69). The LBTR application is available on our city website at www.cityofcapecanaveral.org. It will only be issued when it is accompanied by a current FL Vacation Rental License. The LBTR must be renewed annually (City Code Sec. 70-74). We will mail you a reminder every year. The Vacation Rental LBTR costs $27.50 each year. A current (renewed) State License will be required each year as a pre -requisite for annual renewal. Informational Notes: Annual Inspections. The Vacation Rental unit shall remain subject to annual Fire Safety Inspections and the annual Fire Safety Inspection fee ($25) {City Code Sec. 38-2(d)(I)I. Permit Fees (A) Building Permit fees. On all buildings, structures or alterations requiring a building permit, a fee set forth below shall be paid at the time the permit is issued: Permit fees by total valuation: Valuation Fee $500.00 or less: $45.00 $501.00 to and including $1,000.00 $60.00 $1,001.00 to and including $2,000.00 $75.00 $2,001.00 to and including $20,000.00 $75.00 for the first $2,000.00 and $5.00 for each additional $1,000 or fraction thereof to and including $20,000.00 $20,001.00 to $100,000.00 $165.00 for the first $20,000.00 and $5.00 for each additional $1,000 or fraction thereof to and including $100,000.00 $100,001.00 to $500,000.00 $565.00 for the first $100,000.00 and $4.00 for each additional $1,000 or fraction thereof to and including $500,000 $500,001.00 and up $2165.00 for the first $500,000.00 and $3.00 for each additional $1,000 or fraction thereof The total valuation for assessment of permit fees for new structures shall be based on the latest valuation data published by the International Code Council (I.C.C.) For construction work not addressed in the latest valuation data published by the I.C.C., such valuation shall be based upon the actual construction contract price, with satisfactory evidence of same being submitted to the building official, or a construction cost estimate made by the building official, except as otherwise provided in this section. (B) Plan checking fee. In addition to any fee or fees charged in subsection (a) above: When the valuation of the proposed construction exceeds $1,000.00 and plans and/or specifications are required to be submitted, a plan checking fee shall be paid at the time the permit is issued. The plan checking fee shall be equal to one-half the building permit fee. Such plan checking fee shall be in addition to the building permit fee. When the valuation of the proposed construction exceeds $500,001.00, a nonrefundable plan review deposit shall be paid at the time of permit application submittal. Such deposit may not exceed the anticipated plan review fee. When a dispute exists in the review of the plans and specifications for construction, the applicant may request a hearing before the construction board of adjustment. (C) In addition to any fee or fees charged in subsections (A) and (B), a fee set forth below shall be paid at the time the permit is issued. Note: Reroofing, remodeling, alterations, additions and repairs permit fees shall be paid in accordance with subsections (A) and (B) only. Minimum half-hour charge $25.00 per half hour Reinspection fee—When extra inspection trips are necessary due to partial inspections, wrong $45.00 address, second call on rejected or condemned work, additional work done after inspection has been made, or work not ready for inspection when called, a charge of $45.00 shall be paid in advance for each additional inspection or at the discretion of the building official on large projects prior to issuance of a certificate of occupancy or completion Certificate of Occupancy $50.00 Failure to Obtain an approved Final Inspection $100.00 Work started prior to issuance of permit (ref. building code adopted by chapter 82 of this Double Permit Fee Code) Special Inspection (after-hours, weekend, holiday, arranged two days in advance). Minimum $50.00 per hour four-hour charge for weekends and holidays Final Inspection. Fine for failure to obtain a final approved inspection for a permit before it $100.00 expires. No further permits may be issued to any contractor or permit applicant with an outstanding fine or to any contractor with an expired permit due to failure to obtain a final inspection.
