III & IV, Ch. 34, Arts. II, IV & VI, Ch. 82 Arts. III, XV & XVI, Ch. 94, Art. III. PURPOSE: To clarify the roles and responsibility of staff members in performing duties related to the recordation and payment of code enforcement liens. SCOPE: This policy applies to all City of Cape Canaveral code enforcement liens. This policy does not apply to utility fee and solid waste collections. DEFINITIONS: See City code chapters 2, 34, 82 and 94. POLICY: Per Sec. 82-56(b)(2). The city clerk shall file such lien in the public records of Brevard County Florida, showing the nature of the lien, the amount thereof, a legal description of the property and the owner thereof. Such liens shall bear interest from the date of filing at the highest rate allowed by law. Per Sec. 34-126(c) Upon payment of lien, the clerk of the circuit court shall, by appropriate means, evidence the satisfaction and cancellation of such lien upon the record thereof and notify the tax collector of such satisfaction. Notice of such lien may be filed in the office of the clerk of the circuit court and recorded among the public records of the county. The city treasurer is required to keep records relating to the amount payable on certain liens (so that they can be included in tax statements for ad valorem taxes thereafter submitted to the owners of lands subject to liens - see section 34-127)
