CITY ATTORNEY JOSEPH SCOTT CALLED THE MEETING TO ORDER AT 7 : 30 P.M. THE SECRETARY CALLED THE ROLL. MEMBERS PRESENT WERE: DONALD D. ARABIAN DONALD H. GRAINGER LINDA HARRIS ROBERT E. HOOG JEFF KIDD VINCENT JAMES JOHNSON C. MURPHY, JR. OTHERS PRESENT WERE: FRED NUTT CITY MANAGER JOSEPH SCOTT CITY ATTORNEY ARTIS GUNN BUILDING OFFICIAL NEW BUSINESS ITEM 1 . ELECTION OF CHAIRMAN AND VICE-CHAIRMAN MRS. HARRIS MOVED TO NOMINATE MR. ARABIAN AS CHAIRMAN. MR. KIDD SECONDED MOTION. MR. HOOG MOVED TO NOMINATE MR. MURPHY AS CHAIRMAN. MR. MURPHY RESPECTFULLY DECLINED THE NOMINATION AND MOVED TO CLOSE THE NOMINATIONS . MR. HOOG SECONDED MOTION. MR. ARABIAN WAS ELECTED CHAIRMAN BY UNANIMOUS VOTE. MR. GRAINGER MOVED TO NOMINATE MRS . HARRIS AS VICE CHAIRMAN. MR. MURPHY SECONDED MOTION. MR. GRAINGER MOVED TO CLOSE NOMINATIONS. MR. MURPHY SECONDED MOTION. MRS . HARRIS WAS ELECTED VICE-CHAIRMAN BY UNANIMOUS VOTE. ITEM 2 . REVIEW OF PROPOSED RULES OF PROCEDURES CITY ATTORNEY SCOTT BRIEFLY EXPLAINED THE SCOPE OF THE BOARD' S AUTHORITY. MR. GUNN, THE BUILDING OFFICIAL, WILL INVESTIGATE CODE VIOLATIONS IN THE CITY. AT CODE ENFORCEMENT MEETINGS , MR. SCOTT WILL PRESENT THE CITY ' S CASE. MR. SCOTT REMINDED THE BOARD THAT IT IS QUASI-JUDICIAL AND IS ANSWERABLE ONLY TO CIRCUIT COURT, THUS DUE PROCESS MUST BE ASSURED. GUNN EXPLAINED THE METHOD BY WHICH THE CODE ENFORCEMENT OFFICER IS OPERATING. MR. ECKLEY HAS BEGUN WITH OCCUPATIONAL LICENSES AND IS MAKING SURE THAT EVERY BUSINESS IN THE CITY IS LICENSED. HE HAS ALSO BEEN CITING VIOLATIONS FOR THE IMPROPER PARKING OF VEHICLES. MR. GUNN EXPLAINED THAT A SYSTEMATIC APPROACH WAS BEING TAKEN TO INSURE THAT THE CODE ENFORCEMENT OFFICER WAS ACTING FAIRLY AND NOT IN A SELECTIVE MANNER. ONCE A PARTICULAR TOPIC IS COVERED, THEN MR. ECKLEY WILL MOVE TO A DIFFERENT TOPIC. PUBLIC HEARINGS ITEM 1 . CASE NO. CE 84-1 LAKE HARNEY DEVELOPMENT COMPANY (7980 N. ATLANTIC AVENUE) RE: CHAPTER 721 , CITY OCCUPATIONAL LICENSE THIS ITEM WAS STRICKEN AS LAKE HARNEY OBTAINED AN OCCUPATIONAL LICENSE PRIOR TO THE HEARING. ITEM 2 . CASE NO. . CE - 84-2 T.S. MILLIKEN (307 MADISON AVE. ) RE: CHAPTER 721 , RE: OCCUPATIONAL LICENSE MR. GUNN EXPLAINED THAT MR. MILLIKEN WAS ENGAGING IN A HOME OCCUPATION (BEEKEEPING AND THE EXTRACTION OF HONEY) WITHOUT AN OCCUPATIONAL LICENSE. MILLIKEN APPLIED FOR A LICENSE, IT WOULD HAVE BEEN DISAPPROVED BECAUSE THE BUILDING OFFICIAL FELT THAT ' THE OCCUPATION INVOLVED MANUFACTURING. MANUFACTURING IS NOT ALLOW- 73 O ED IN A RESIDENTIAL ZONE. ALSO, THE CODE PROVIDES THAT NO EXTERNAL EVIDENCE OF THE HOME OCCUPATION BE PERMITTED (639 . 09 PARA. G) . MR. GUNN EXPLAINED THAT THE BEES ARE KEPT IN HIVES OUTSIDE THE HOUSE. MR. MILLIKEN READ A PREPARED STATEMENT WHICH EXPLAINED HIS YA t9 ((41 BEEKEEPING ACTIVITES AND THE BENEFITS OF BEES. HE EXPLAINED THAT OD CM HE FELT HIS ACTIVITY WAS FARMING NOT MANUFACTURING, AND THAT HE HAD HAD NO COMPLAINTS FROM HIS NEIGHBORS. CHAIRMAN DONALD ARABIAN POLLED THE BOARD TO FIND OUT IF EACH MEMBER FELT THE CODE HAD BEEN VIOLATED. ALL MEMBERS AGREED THAT MR. MILLIKEN WAS IN VIOLATION OF THE ORDINANCE. MR. KIDD MOVED TO FIND MR. MILLIKEN IN VIOLATION OF THE ORDINANCE CONCERNING OCCUPATIONAL LICENSING (SECTION 721) . AFTER A PERIOD OF 30 DAYS, IF THE BEEKEEPING HAS NOT DESISTED, A FINE OF $25 . 00 PER DAY WILL BE LEVIED. MS. HARRIS SECONDED MOTION. THE FOLLOWING WERE THE BOARD'S FINDINGS OF FACTS: 1 . THAT MR. MILLIKEN WAS IN VIOLATION OF SECTION 639 . 09 (PARAGRAPHS A, B, E, F, I) - HOME OCCUPATIONS. 2 . THAT MR. MILLIKEN WAS IN VIOLATION OF SECTION 721 - OCCUPATIONAL LICENSES. 3 . THAT MR. MILLIKEN WAS IN VIOLATION OF SECTION 639 .23 - ACCESSORY STRUCTURES. CITY ATTORNEY JOSEPH SCOTT ASKED THAT THE BOARD POSTPONE THIS ITEM UNTIL THE NEXT MEETING SO THAT HE CAN RESEARCH WHETHER BEE- KEEPING AND THE PROCESSING OF HONEY IS GENERALLY CLASSIFIED AS FARMING OR MANUFACTURING. THE STATE HAD NO OPINION ON THE MATTER, AND MR. SCOTT FOUND NO CASES SUPPORTING EITHER CODE ENFORCEMENT BOARD REGULAR MEETING PAGE 1 OF 5 MICROFILMED 9-15-85 STANCE. MR. SCOTT SUPPORTED THE BUILDING OFFICIAL IN HIS JUDGMENT THAT MR. MILLIKEN' S PROPERTY WAS NOT ZONED FOR THE PROCESSING OF HONEY. MR. MILLIKEN PRESENTED PICTURES OF THE RESIDENCE WHICH HE CLAIMED SHOWED NO EXTERNAL EVIDENCE OF THE BEEKEEPING ACTIVITY. THE BUILDING OFFICIAL STATED THAT THE PROPERTY DID NOT HAVE THIS APPEARANCE ON HIS INSPECTIONS . MR. MILLIKEN ALSO ARGUED THAT HE WAS HARVESTING HONEY, MUCH AS A FARMER HARVESTS WHEAT. AFTER A DISCUSSION, THE BOARD AGREED THAT HONEY PROCESSING WAS LIGHT MANUFACTURING. MR. KIDD MOVED TO FIND MR. MILLIKEN IN VIOLATION OF SECTION 639 . 07 AND 639 . 23 (PARAGRAPHS A,B,E,F, I) . HE FURTHER MOVED TO GIVE MR. MILLIKEN 30 DAYS TO COME INTO COMPLIANCE. AFTER THE 30 DAY PERIOD, MR. MILLIKEN WOULD INCUR A $20 PER DAY FINE IF NOT IN COMPLIANCE. MOTION DIED FOR LACK OF A SECOND. MR. THE CITY ATTORNEY SWORE IN MR. COPE AND MR. ECKLEY. MR. ECKLEY REMINDED THE BOARD THAT IT HAD PREVIOUSLY RULED THAT MR. COPE WAS ENGAGED IN LIGHT MANUFACTURING WHICH IS NOT ALLOWED IN A C-1. ZONE. MR. COPE HAD UNTIL 5 : 00 P.M. ON DECEMBER 20 , 1984 TO EITHER MOVE HIS BUSINESS TO AN M-1 ZONE, SEEK A SPECIAL EXCEPTION OR CEASE AND DESIST. MR. COPE INDICATED THAT HE WISHED TO MOVE HIS BUSINESS OUT OF CAPE CANAVERAL AS SOON AS HE FINDS A SUITABLE LOCATION. HE ALSO POINTED OUT THAT HE CLOSED HIS BUSINESS AT 5 : 00 P.M.
