Weekly Update Week Ending October 21, 2016 Cape Canaveral VISION Statement Administrative Services Action Tracking Community Engagement Community Development Economic Development Culture & Leisure Services Public Works Services Brevard County Sheriff’s Office Canaveral Fire Rescue 5-17-2016 Cape Canaveral Vision Statement We envision: A bikeable and walkable Cape Canaveral that retains and enhances its residential feel, characterized by low-rise buildings. This residential and business friendly atmosphere is a liveable, attractive, safe, inclusive and sustainable coastal community that embraces the seaside and riverside as the main amenities, and supports local culture, commerce and education. We envision: A1A as a “complete street” with a native-landscaped and tree-lined median with traffic calming elements and dark-sky street lighting. “Complete street” amenities include bicycle facilities, covered transit stops, and safe pedestrian crossings that invite pedestrians and bicyclists to access the beach, river, local neighborhoods and adjacent communities. Our improved “complete streets” will allow us to travel calmly to intimate waterfront destinations and a walk- able uptown core. Multi-use paths lined with shade trees should be wide enough for bikes and pedestrians and lighted so anyone can walk or bicycle safely anywhere in town, day or night. We envision: Welcoming community entrance features that create a sense of arrival and unique community identity. The “uptown” and other areas will contain an architecturally rich and unique mix of uses, with wide tree shaded sidewalks and umbrella covered café tables at restaurants and bistros where friends gather, interact, and enjoy drinks and dinner. We envision: A community that; removes or transforms blighted and unfinished buildings into attractive structures, offers city-wide green spaces, provides a pet-friendly park with ample shade, and actively recruits and supports businesses that enhance economic viability and serve our residents and visitors. We envision: Open shorelines and rivers accessible to the public including amenities that take advantage of the water, such as limited and quaint water-view establishments and intimate public gathering and entertainment places that may include pavilions, gazebos, or a performance stage. Administrative Services Update for Week Ending October 21, 2016 The City Manager’s Office is responsible for the day to day administration of all City departments in accordance with City Council’s established policies/direction, local ordinances, resolutions and State/Federal laws/rules and regulations. Telephone conferences, meetings with citizens, documents prepared/reviewed/approved and meetings/conferences held are numerous and may not be included in the Weekly Updates. Highlights: Met with Department Directors regarding various projects/issues/initiatives. Met with City Attorney, Independent Advisory Hearing Officer, City Engineer, CD Director, Building Official and City Clerk regarding Variance Request No. 16-02 Appeal Hearing on October 24. Met individually with Mayor Pro Tem Walsh and Council Member McMillin regarding City Council Agenda Items/miscellaneous issues. Held telcon with Council Member Bond regarding miscellaneous issues. Attended Regular City Council Meeting. Facilitated monthly Staff Meeting. EA attended monthly Staff Meeting. EA updated Action Tracking. EA attended Open Enrollment Workshop at PWS Training Room. EA provided assistance to City Council Members and select Department Directors. City Clerk’s Office Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public/Staff and provided assistance to City Council. Highlights: Council Meetings – attended 10-18-2016 Regular Meeting; continued preparing for 11-15-2016 Regular Meeting. Public Hearing – continued preparing for Public Hearing regarding Variance Request No. 16-02 – APPEAL, Monday, October 24, 2016 at 4:30pm, Cape Canaveral Public Library, 201 Polk Avenue. City Government Week – along with Mayor Hoog, Economic Development and Community Engagement Directors, held a Mock City Council Meeting for third graders from Cape View Elementary; “Dogs on the Beach” was the topic of discussion; the “City Council” voted against the idea in a 3-2 vote; the “Public Participants” voted in the majority for allowing dogs on the beach; participated in tour of Public Works Services with fifth graders from Cape View Elementary. Proclamation – “World Pancreatic Cancer Day” November 17, 2016. (see attached) Attended Brevard County City Clerks Association meeting in Palm Bay. Attended Benefits presentation organized by Human Resources Director. Attended Staff Meeting. Met with City Manager and select Department Directors regarding various items/issues. Election – as of 10-20-2016, received 3 Campaign Treasurer Reports, Report Code G5; Early Voting for the 2016 General Election is Monday, October 24 – Saturday, November 5, 2016; please see the attached flyer for locations/times or go to www.votebrevard.com; Election Day is Tuesday, November 8, 2016. Financial Services Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public. Highlights: Attended monthly City Council Meeting. Attended monthly Staff Meeting. Met with Human Resources Director regarding staffing levels. Met with Consultant regarding ongoing effort to update City’s Purchasing Policy. Human Resources/Risk Management Staff performed day to day duties/responsibilities. Highlights: EEOC Is Targeting Employer Prescription Drug Testing Policies On September 14, 2016 the EEOC filed suit against M.G. Oil Company (doing business as Happy Jack’s Casino) in the U.S. District Court for the District of South Dakota, challenging Happy Jack’s drug testing policy. Happy Jack’s withdrew its offer of employment to Kim Mullaney after she failed a pre-employment drug test due to her use of lawfully prescribed hydrocodone for neck and back pain. The EEOC took issue with Happy Jack’s failure to allow Mullaney to present evidence of her prescription drug use and failure to allow her to present evidence of her underlying impairment. The EEOC also took issue with Happy Jack’s policy that required all employees (safety-sensitive and non-safety-sensitive) to disclose all prescription and non-prescription drug use. The EEOC sued Happy Jack’s under the Americans with Disabilities Act (ADA) for actual and perceived disability bias. The EEOC also claimed that Happy Jack’s maintained a discriminatory qualification standard and engaged in unlawful disability-related inquiries. The commission is seeking injunctive relief and actual and punitive damages. On September 28, 2016 the EEOC sued Apollo MD and Georgia Hospitalists Group in the U.S. District Court for the Northern District of Georgia after the defendants fired Dr. Alunda Hunt for his use of narcotic pain medication to treat chronic pain. According to the EEOC’s suit, the defendants regarded Dr. Hunt as disabled while there was no indication that the prescription medication impacted Dr. Hunt’s ability to do the job or maintain his medical license. The suit also appears to allege that the defendants seek additional clarification from Dr. Hunt regarding the nature of his condition and/or the impact of his prescription drug use before terminating his employment. As in the Happy Jack’s case, the EEOC is seeking damages and injunctive relief and actual punitive damages. While the EEOC did not challenge all employment drug testing or invalidate limited medication disclosures for safety-sensitive jobs, both cases highlight the risk of a one-size-fits-all approach to drug testing. Employer must be sensitive to ADA and Family and Medical Leave Act issues that may underlie prescription drug use and be prepared to engage in an interactive dialogue with employees to address job requirements, the employee’s prescription drug use and the employee’s capabilities with and without reasonable accommodation. Blanket policies that mandate discharge for prescription drug use (especially for non-safety-sensitive jobs) are particularly risky given the EEOC’s recent actions. Human Resources is currently seeking qualified candidates for the vacancies of Code Enforcement Officer, Accountant and Wastewater Plant Operator. Interviews were conducted for the Code Enforcement and Accountant vacancies. October 20, 2016 - October 31, 2016 Open Enrollment Employees participated in Open Enrollment workshops in preparation for the selection of employee benefits effective December 1, 2016. HR provided the Brevard Emergency Operations Committee Public and Private property damage assessment data following Hurricane Matthew. Representatives from FEMA are currently in the City providing assessment damages. HR continues to work with Florida League of Cities insurance adjustors and inspectors. The City received a 97% settlement for City property damages incurred during a two car collision on July 8, 2016 for a total of $1,473.00. Due to the disruption in daily activities caused by Hurricane Matthew, the United Way Pledge Drive has been extended through October 31, 2016. It is well underway with Pledges arriving daily. Progress toward our goal is at $1,498.00. ZIKA Update The Florida Department of Health announced Monday there are seven new cases of Zika across the state. Three of the cases are travel related, with one of those cases in Miami-Dade County. Two of the travel related cases involve pregnant women. There are four new non-travel related cases in Miami-Dade. One is linked to the Miami Beach investigation, two are linked to the new area of local transmission in Miami-Dade and the fourth case is being investigated to determine where the exposure occurred Hurricane Matthew Could Make Florida's Zika Problem Worse Heavy rainfall means more standing water. Florida remains the only state in the U.S. where Zika has been transmitted locally, spread by mosquito populations on the ground rather than imported by people who got sick from the virus elsewhere. Hurricane Matthew could further complicate efforts to stop the spread of the disease, which can cause grave outcomes. Residents are reminded to clear their property of standing water, focusing specifically on the breeding habitat favored by the ZIKA carrying mosquito, small containers of standing water near homes and gardens. ©fficial ~rotlamation €iQ? ©f €ape €anaberal, .1loriba WHEREAS, in 2016 an estimated 53,070 people in the United States will be diagnosed with pancreatic cancer, one of the deadliest cancers, and 41, 780 will die from the disease; and WHEREAS, pancreatic cancer surpassed breast cancer this year to become the third leading cause of cancer death in the United States, and it is projected to become the second leading cause by 2020; and WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate in the single digits at just eight percent; and WHEREAS, when symptoms of pancreatic cancer present themselves, it is generally in later stages, and 71 percent of pancreatic cancer patients die within the first year of their diagnosis; and WHEREAS, approximately 3,080 deaths will occur in Florida in 2016; and WHEREAS, pancreatic cancer is the seventh most common cause of cancer-related death in men and women across the world; and WHEREAS, there will be an estimated 418,451 new pancreatic cancer cases diagnosed worldwide in 2020; and WHEREAS, the good health and well-being of the residents of Cape Canaveral are enhanced as a direct result of increased awareness about pancreatic cancer and research into early detection, causes and effective treatments; NOW THEREFORE, I, Robert Hoog, Mayor of the City of Cape Canaveral, Brevard County, Florida, hereby proclaim November 17, 2016 as WORLD PANCREATIC CANCER DAY in the City of Cape Canaveral and urge all citizens to join me in this special observance. Staff used City Social Media platforms to broadcast Cape Canaveral’s participation. The City’s first free to the public EV charger was recently visited by a Tesla Model S. The Tesla owner was from out of town and in desperate need of an EV charger. With help from the dealership, she located the Canaveral Public Library station, and was able to get the electric fuel she needed to return to South Florida safely. While in Cape Canaveral, she visited the beach/Library. This was her first time in Cape Canaveral, and she was glad the charger gave her a reason to stop and explore. Staff is looking for several interested volunteers to assemble and decorate bat boxes/houses. Bat boxes are small wooden ‘houses’ that provide a safe home for bats to live, rest and raise pups. Port of Call/Project Zeus update: o The medical services and management company is considering relocation of its corporate offices from Reston, Virginia to an existing 63,000+ SF building at 8600 Astronaut Blvd. The Company currently employs approximately 300 people in the City and plans to create 150 new jobs over 3 years with an average wage of $66,000 and invest $4,500,000 in new capital expenditures. The Company has applied for the State of Florida’s Qualified Target Industry (QTI) Tax Refund Incentive Program. The Program is available for companies that create high wage jobs in targeted high value-added industries. This incentive includes refunds on corporate income, sales, ad valorem, intangible personal property, insurance premium and certain other taxes. Pre-approved applicants who create jobs in Florida receive tax refunds of $3,000 per net new Florida full-time equivalent job created. For businesses paying 150 percent of the average annual wage, add $1,000 per job. The selected local community contributes 20 percent of the total tax refund. No more than 25 percent of the total refund approved may be taken in any single fiscal year. New or expanding businesses in selected targeted industries or corporate headquarters are eligible. The 20% contribution is comprised of Brevard County’s Ad Valorem Tax (AVT) abatement plus the City of Cape Canaveral’s AVT abatement. o Three items were presented to City Council on October 18th with results as follows: Resolution No. 2016-24 supporting Project Zeus as QTI eligible (approved), Resolution No. 2016-23 requesting the Brevard County Property Appraiser (BCPA) prepare a report regarding the tax impact to the City if the Abatement is approved (approved) and Ordinance No. 05-2016 approving the Project Zeus AVT Abatement, 1st Reading (approved). o City Council will have the opportunity to adopt Ordinance No. 05-2016 at 2nd Reading on November 15th. Along with Community Development and Community Engagement Directors, met with a Brevard County resident who wishes to establish a Pedal Pub business operation. The route would primarily focus on Port Canaveral eating/drinking establishments as well as our local Brewery and Craft Distillery (coming soon). The operation would allow up to 10-15 adults to pedal-power a vehicle that would travel between select establishments for a 2-hour tour with a company employee at the steering wheel and will include an informational tour of the area. This would serve as an excursion for cruise-ship patrons, and a fun opportunity for anyone to safely see more of Cape Canaveral. Also: o No alcohol will be allowed or served on the vehicle, whether open or closed. o The driver has the ability to engage a low horsepower motor if necessary. o Tours would be limited to two hours, primarily in the afternoon. No tours after dark. o Routes to be determined. o Applicant will also seek approval of Canaveral Port Authority. A new Thursday night intermediate tennis league will begin on October 27 giving players one more week to register. Fast Feed Tennis Clinics- Fast feed tennis clinics are designed to provide a fun aerobic tennis workout. Participants run through doubles and/or singles “live-ball” drills simulating actual match play situations. Clinics are open to players of all skill levels, ages 18 and up. Cost is $5 per player, per session. Pre-registration is not required. Youth Tennis Group Lessons – Ever thought about your child playing tennis, but realized lessons would be too expensive? Monster Mash / Trunk or Treat - Fall is in the air and Halloween is swiftly approaching. This year, the City is hosting its first annual Trunk or Treat event, to be held in conjunction with its ever popular Monster Mash Halloween Dance Party. Geared towards families with children 12 & under, this community outreach event is open to all Cape Canaveral residents, businesses, HOA’s, municipal services, City boards and non-profit groups. As door to door trick or treating is either difficult or discouraged in many Cape Canaveral condominium communities, this event gives those who are interested in participating in this time honored holiday tradition a chance to do so without infringing on association rules or their neighbors’ peace and quiet. It also gives City officials, businesses and non-profit organizations an opportunity to reach out to the local families they serve. This is a free, non-commercial, family friendly activity and there is no charge to participate. The event will be held on Friday, October 28th from 6:30-8:30 pm on Taylor Avenue in front of the Nancy Hanson Recreation Complex. Trunk or Treat participants may decorate a vehicle or set up a spooky booth space to distribute candy or treats. City Government Week at Culture & Leisure Services – On Monday, October 17th, 45 fourth graders from Cape View Elementary visited the Nancy Hanson Recreation Complex. After a short presentation on the department’s role in the City’s government, students were separated into three groups that rotated through a circuit of high-energy physical activities. During their one hour visit, each student got to learn the fundamentals of Wallyball, enjoy a quick round of dodgeball and take part in a Zumba class. From the smiles on their faces and sweat on their foreheads, you could tell they had a wonderful time. Public Works Services Update for Week Ending October 21, 2016 Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the public. Wastewater Treatment Plant (WWTP)/Sanitary Sewer System Oxidation Ditch Rehabilitation Project. Pre-construction meeting performed on October 20; construction activities to be initiated on November 1. This is one of the projects funded through the City’s State Revolving Fund (SRF) Loan. Infrastructure Maintenance (IM) North Atlantic Avenue Streetscape Project. No major damage observed from Hurricane Matthew; contractor implemented Emergency Preparedness Plan prior to the storm. Contractor currently installing landscaping and performing several corrective actions. The original landscaping plan was completely revised due to the presence of numerous unmarked underground utilities. Maintenance of traffic (MOT) includes closure of one lane on North Atlantic Avenue during working hours; flagmen are utilized to direct traffic. All roads will be open after working hours. Estimated project completion – November 2016. NOTE: All businesses in the North Atlantic Avenue corridor will remain open during construction activities. Installation of landscaping along eastern side of North Atlantic Avenue – looking northeast. Stormwater Canaveral City Park Ex-filtration Project. No major damage observed from Hurricane Matthew; contractor implemented Emergency Preparedness Plan prior to the storm. Construction for this Project was initiated on August 3. Both the softball and Little League fields will be closed until Project completion in late-2016 or early-2017; work is also being performed in the adjacent City streets. Sandpiper Park (playground), Youth Center and basketball courts will remain open. Contractor is currently performing excavations in the softball field area. Improvements to the sanitary sewer system beneath the property to be completed week of October 24. Project is being funded with two grants from (1) Florida Department of Environmental Protection (FDEP) and (2) State Legislature funds as well as funds from the City. The City also received an additional $50,380 in grant funds from FDEP for this Project. Installation of stormwater chambers and gravel backfill – looking east. Hurricane Matthew Recovery Operations. Staff continues to clean debris from the City’s stormwater system. Inlets are being cleaned of debris and an additional street sweeping event was performed along streets cleared of debris. The Coalition plans a sign waving event at the intersection of SR 520 and SR A1A in Cocoa Beach on October 24. The major purpose of the Coalition is to educate voters concerning the November ballot initiative for a ½ cent sales tax to support IRL restoration efforts.
