Cape Canaveral Vision Statement
We envision: A bikeable and walkable Cape Canaveral that retains and enhances its residential
feel, characterized by low-rise buildings. This residential and business friendly atmosphere is a
liveable, attractive, safe, inclusive and sustainable coastal community that embraces the seaside and riverside as the main amenities, and supports local culture, commerce and education.
We envision: A1A as a “complete street” with a native-landscaped and tree-lined median with
traffic calming elements and dark-sky street lighting. “Complete street” amenities include bicycle facilities, covered transit stops, and safe pedestrian crossings that invite pedestrians and bicyclists to access the beach, river, local neighborhoods and adjacent communities. Our improved
“complete streets” will allow us to travel calmly to intimate waterfront destinations and a walk-
able uptown core. Multi-use paths lined with shade trees should be wide enough for bikes and
pedestrians and lighted so anyone can walk or bicycle safely anywhere in town, day or night.
We envision: Welcoming community entrance features that create a sense of arrival and unique
community identity. The “uptown” and other areas will contain an architecturally rich and unique
mix of uses, with wide tree shaded sidewalks and umbrella covered café tables at restaurants and
bistros where friends gather, interact, and enjoy drinks and dinner. We envision: A community that; removes or transforms blighted and unfinished buildings into
attractive structures, offers city-wide green spaces, provides a pet-friendly park with ample shade,
and actively recruits and supports businesses that enhance economic viability and serve our
residents and visitors.
We envision: Open shorelines and rivers accessible to the public including amenities that take
advantage of the water, such as limited and quaint water-view establishments and intimate public
gathering and entertainment places that may include pavilions, gazebos, or a performance stage.
Administrative Services Update for Week Ending September 30, 2016
The City Manager’s Office is responsible for the day to day administration of all City departments
in accordance with City Council’s established policies/direction, local ordinances, resolutions and State/Federal laws/rules and regulations. Telephone conferences, meetings with citizens, documents prepared/reviewed/approved and meetings/conferences held are numerous and may not
be included in the Weekly Updates. Highlights:
• Met with Department Directors regarding various projects/issues/initiatives.
City Clerk’s Office Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public/Staff and provided assistance to City Council.
Highlights:
• Records Management – 30 pages of documents scanned; 40 pages of documents verified;
7.5 cubic feet (5 boxes) of records prepared for disposition/destruction; continued preparing records for offsite scanning/disposition/destruction.
• Council Meetings – continued preparing for 10-18-2016 Regular Meeting.
• Election – City Council Candidates next Campaign Treasurer Reports G3 for the period covering 09/17/2016 – 09/30/2016 are due Friday, October 7th by close of business.
• Public Hearing – assisted in coordinating/scheduling Independent Advisory Hearing
regarding Variance Request No. 16-02 – APPEAL set for 4:30pm, Monday, October 24,
2016 at the Cape Canaveral Library Meeting Room, 201 Polk Avenue.
• Proclamation – prepared/processed Proclamation declaring October as Dysautonomia Awareness Month (see attached).
• Continued planning for Florida City Government Week, October 16-22, 2016.
• Met with Interim Public Works Services Director and new Public Works Services Director regarding the City Clerk’s Office functions.
• Met with City Manager regarding various items/issues.
Financial Services Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public. Highlights:
• Met with new Public Works Services Director to discuss Accounting, Budget, and
Software Programs utilized by the City.
• Met with the City Manager, Capital Projects Director and Public Works Director to discuss the status of the North Atlantic Streetscape Project and timeline for the upcoming phases.
Human Resources/Risk Management Staff performed day to day duties/responsibilities.
Highlights:
EEOC Releases New Online Resource Center for Small Businesses The U.S. Equal Employment Opportunity Commission (EEOC) released a new online resource center designed to help small business owners comply with the laws enforced by EEOC. The Small
Business Resource Center (SBRC), located on EEOC's public website at www.eeoc.gov, provides
a user-friendly one-stop source for information on federal employment anti-discrimination laws.
The Resource Center was designed for the small business owner who needs information quickly
and easy to understand. The site also provides answers to frequently asked questions, guidance in making employment decisions and tips for small businesses on a variety of potential workplace
discrimination issues.
EEOC is launching the first in a series of short videos for small business owners on frequently
asked compliance questions. The videos feature EEOC employees from across the country
addressing topics, such as responding to an EEOC discrimination charge and helpful strategies for
small businesses to follow when they start the hiring process.
When to Say When? Fifth Circuit Rules on When an Accommodation Isn’t Working
In Dillard v. City of Austin, Texas, Dillard filed suit against his employer, City of Austin Texas,
claiming ADA discrimination following his termination from employment. Dillard, a public works
maintenance employee injured on the job, was offered an administrative position as an accommodation to his inability to perform his previous job. Dillard was offered training in order
to obtain the skills needed for the position. Dillard failed to sign up for the training and admitted
to coming to work late, leaving early, spending the majority of his work hours “surfing the net”
and conducting personal business on the City’s time. He further informed his employer that he was
unhappy in the position. Fifth Circuit has held that an employee’s poor performance in a light-duty position can relieve the employer from any further obligation to find a reasonable accommodation under the Americans with Disabilities Act (ADA). This opinion emphasizes that both the employer
and the employee must put forth a good faith effort to make an accommodation work.
Immigration-Related Hiring Discrimination Claims Settled with Department of Justice and Heads Up! A New Form I-9 is coming by mid-November
In the past three months, there have been four settlements with three staffing agencies and one
private company reported by the Department of Justice. The three settlements with staffing agencies resolved allegations that the staffing agencies discriminated against non-US citizens in
violation of the Immigration and Nationality Act (INA). The Civil Rights Division’s Office of
Special Counsel for Immigration-Related Unfair Employment Practices is responsible for
enforcing anti-discrimination provisions of the INA.
The Office of Special Counsel found a pattern and practice at all three staffing agencies of
requesting specific immigration documents for Form I-9 and E-Verify purposes for noncitizens, but allowing US citizens to show what they wanted from the list of acceptable documents. The
settlement fines were $175,000, $153,000, $1,400 and $1,200 respectively and all four companies
will now be monitored by the Department of Justice and undergo a periodic review of their hiring
processes.
On 8/25/16, the Office of Management and Budget approved a revised Form I-9 to be published by 11/22/16. Employers may continue using the current version of Form I-9 with a revision date
of 03/08/2013, but after 01/21/2017, all previous versions of Form I-9 will be invalid. It is
therefore critically important not to print out a stack of I-9s for future use.
• HR and the Community Development Director and Building Official are in the process of
interviewing candidates for the Code Enforcement Officer vacancy.
• HR has reached tentative agreement with its current healthcare insurance provider, United
Healthcare, pending formal written approval of the renewal contract offer of a 6% premium
increase. Having budgeting a 10% increase and originally offered a 12% renewal rate driven
by skyrocketing pharmacy costs, the City is satisfied to have avoided resorting to high
deductible and maximum out of pocket plans while coming in under budget by 4% for 2016/17
Group Health coverage.

• ZIKA UPDATE: The Florida Department of Health announced four new non-travel-related cases of the Zika virus on Tuesday. All of the cases are in Miami-Dade County, although it is unclear where within the
county the exposures occurred. According to health officials, one of the newly infected people is
not a Florida resident.
The Florida Department of Health also announced five new travel-related cases in the state. Two
of those cases are in Miami-Dade County, one is in Osceola County, one is in Clay County and
the last case involves a pregnant woman.
There are a total of 904 total infections in the state, 91 of which involves women who are pregnant. Health officials said the ongoing transmission is only taking place in Miami-Dade County within the identified "Zika zone" in Miami Beach.
In response to the ZIKA threat, Brevard County is conducting aerial spraying.

WHEREAS, Dysautonomia is a group of medical conditions that result in a
malfunction of the autonomic nervous system, which is responsible for essential
bodily functions such as respiration, heart rate, blood pressure, digestion,
temperature control and more; and
WHEREAS, many forms of Dysautonomia are considered rare or orphan
di seases, such as Multiple System Atrophy and Pure Autonomic Failure, while other
forms are quite common such as Diabetic Autonomic Neuropathy,
Neurocardiogenic Syncope and Postural Orthostatic Tachycardia Syndrome. There
is a lack of awareness about these conditions amongst the medical community and
the general public; and
WHEREAS, Dysautonomia can impact people of all ages, races and
backgrounds, including individuals living in Cape Canavera l; and
WHEREAS, some forms of Dysautonomia can be very disabling and this
disability can result in physical pain, social isolation, stress on the families of those
impacted, and financial hardship; and
WHEREAS, increased awareness about Dysautonomia can help patients get
diagnosed earlier, and can help foster support for individuals and families coping
with Dysautonornia; and
WHEREAS, we seek to recognize the contributions of the professional
medical community, patients and family members who are working to educate our
citizenry about Dysautonomia in Cape Canaveral; and
NOW THEREFORE, I, Bob Hoog, Mayor of the City of Cape Canaveral,
Brevard County, Florida, do hereby proclaim October 2016 as
DYSAUTONOMIA AWARENESS MONTH
Community Engagement Update for Week Ending September 30, 2016
Community Engagement is primarily responsible for implementation/evaluation of public programs, community meetings, public gatherings and more. Staff attended various meetings,
performed day-to-day duties/responsibilities, website maintenance/improvements and performed
content sourcing throughout the City for various digital/social media platforms.

Seven (7) residents/visitors attended the Tech Talk: How to Use Modern Technology class on
Monday, September 26, 2016. Attendees brought their own devices (laptops and cell phones).
These events are held to assist attendees of all skill levels, and anyone with technology questions is encouraged to attend.

The next Tech Talk will be on Monday, January 16, 2017 from 5:00 - 7:00 pm at the Cape
Canaveral Public Library, 201 Polk Ave.
Staff attended the first Beach Yoga event on Saturday, September 24, 2016 and found inner peace
with 3 other residents! The event is held on the 2nd / 4th Saturday on the beach located off
Washington Ave. The event is donation based and you are required to bring your own mat, water
and towel.
It’s no shock how excited the residents and visitors are about the new Canaveral Public Library
EV chargers! These two (2) destination chargers are the City’s first free to the public charging
stations! The electric vehicle chargers are part of a larger sustainability initiative in line with the Cape Canaveral Vision Statement and last year’s City Council/Staff Retreat. Public Works
Services (PWS) staff, to include Utilities and Infrastructure Maintenance teams along with the
inmate crew, worked together to prepare the site and install the units.
The chargers work with a variety of cars to include:

• Tesla model Roadster, S and X
• Toyota Prius
• BMW ActiveE and i3
• Nissan Leaf models

The Cape Canaveral Community Garden has opened to registered participants and is already
growing strong! The first Community Garden houses ten (10) raised bed garden boxes of various
sizes allowing fourteen (14) lottery picked gardeners to creatively plant a 2 x 4 foot space, in addition there are twenty (20) window style boxes along the railing being planted, there are rain barrels for watering, a compost area, upcycled greenhouse and lockable work table/storage desk.
Only a few railing boxes are still available for planting on a first come first served basis. To register
to participate at the Community Garden and/or reserve a railing box please contact the Community
Garden Liaison / Community Engagement Director, Joshua Surprenant, at
j.surprenant@cityofcapecanaveral.org. This project is funded in part by City Council member Brendan McMillin and with grant funds from the National Recreation and Park Association. ACE
Hardware Cape Canaveral and Sunseed Co-op donated a variety of seeds and plants towards the
success of this project. The project will require both green thumbs (gardeners) and purple thumbs

Volunteers and staff began the process of painting two (2) water barrels for the Cape Canaveral Community Garden on Saturday, September 24, 2016 at Manatee Sanctuary Park. Staff would like
to thank residents Melissa and Tim Bass for volunteering their time and creative skills to the

Community Development Update for Week Ending September 30, 2016
Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests
from the public, including performing plan reviews, processing permits, conducting inspections, performing site visits, issuing Notices and conducting research.
The Building Division conducted 34 inspections; processed 22 new building permit applications;
24 permits picked up and payments processed; processed 103 renewal Business Tax Receipts
(BTR’s) fire/alarm payments; Entered 10 new BTR applications; Renewed 50 BTR requests;
Processed late notice letters and late notice fee sheets.
• Provided inspection for New City Hall to include one (1) block cell fill of second floor/2nd
lift.
• Processed one (1) new contractor information packet (Contractor License, Liability Insurance and W/C Insurance) allowing them to pull permits in Cape Canaveral.
• Provided assistance completing building permit applications as needed.
• Processed one (1) payment for expired permit.
• Processed one (1) payment for Site Plan permit and one (1) payment for commercial building permit for Astronaut Blvd.
• Contacted one (1) contractor regarding scheduling final inspections for building permits
that are nearing expiration & permits recently expired.
• Responded to two (2) voicemails.
• Scanned four (4) pages of Certificates of Insurance.
Code Enforcement performed day-to-day duties/responsibilities, assisted with various requests
from the Public and provided office coverage throughout the week. Highlights:
• Received 10 new requests giving life-safety issues priority, followed closely by community
appearance and property maintenance.
• Conducted eight (8) site inspections.
• Removed 10 signs from the right-of-way and telephone poles within the City.
• Responded to six (6) lien search requests.
• Staff covered counter and assisted eight (8) citizens with building and code enforcement requests.
• Responded to 41 voicemails regarding complaints and inquiries.
• Code Enforcement Officers continue to conduct daily community sweeps for visible
violations throughout the City.
• Obtained compliance in the field for two (2) Code violations.
• Issued eight (8) door tags for visible violations to be corrected.
Planning performed day-to-day duties/responsibilities, assisted with various requests from the
Public and provided office coverage throughout the week. Highlights:
• Records Management – 807 pages of documents scanned/verified.
• The City has engaged Attorney D. Andrew Smith, III, with the Shepard, Smith and Cassady
law firm to serve as an Independent Advisory Hearing Officer for purposes of the appeal to
Variance No. 16-02. Attorney Smith will conduct the hearing regarding the variance and
prepare a Recommended Order, which shall include findings of fact and conclusions of law, which will be considered by the City Council at its December 20, 2016 meeting for action.
The City has also engaged Attorney Jim Beadle to represent Staff during this process. This
is required as the City Attorney’s Office will be representing the Council and cannot do so
for Staff during the proceedings.
• As requested by the Council at its September 20th meeting, City Staff has evaluated the potential for relocating the Oak trees slated for removal at 307 Madison Avenue. IM Staff
is indicating that the majority of the Oaks have been topped repeatedly which has resulted
in structural/aesthetic deficiencies. The remaining Oak is too large to relocate.
• Participated in interviews to fill the current Code Enforcement Officer vacancy.
• Participated in a phone conference with the City Attorney to discuss the Development
Agreement for property at 8600 Astronaut Boulevard. The property owner is exploring the
possibility of fulfilling certain development obligations on property not currently
contemplated in the DA.
Economic Development Update for Week Ending September 30, 2016
Performed day to day duties/responsibilities, conducted various meetings with business stakeholders, potential investors, citizens, realtors and Staff. Performed site visits and
conducted research as necessary.
• Issued the following Business Tax Receipts: o Extreme Sport Fishing, LLC o TransMontaigne Operating Company, LP
• City Hall status:
o Construction of 2nd floor exterior concrete block walls continues. These walls are pumped with concrete at specified/engineered reinforcing points and at 5 ft. high intervals (lifts).
o On the 1st floor, above-ceiling air conditioning ductwork is being installed. This
work is followed closely by interior office wall partition framing and electrical
conduits.
• With Community Development Department Director, met with Cape Canaveral
Business and Economic Development Board Chair to discuss the potential future of the
Board and roles of its Members. Subsequently contacted each Board member to
schedule individual discussions and share ideas in the coming days.
• Port of Call/Project Zeus update:
o Attended EDC Ad Valorem Tax (AVT) Abatement Council meeting where
Project Zeus, a potential 150-job generator in Cape Canaveral, was
recommended for approval for a 100% abatement for 10 years. The abatement would apply only to the increased amount of taxes after the Brevard County
Property Appraiser assesses the effect of their $4.5M investment in the facility
at 8600 Astronaut Blvd. The company is weighing a potential relocation to Cape
Canaveral or Virginia. These types of incentives are commonplace as county &
local governments vie for highly sought after job generating companies. As a
medical management company, Project Zeus would offer a degree of economic
insulation by helping to diversify our once aerospace-dominated economy.
o The company is also seeking an AVT abatement incentive from the City. Staff
is coordinating these efforts and expects to have a supporting Ordinance on the October 18th City Council Agenda.
o Owner/developer and Staff have agreed to terms to recommend the City
Council approve a Modification to the Developers Agreement:
Authorize an optional “Office Use” at the Port of Call. This allows
Project Zeus to occupy the facility at 8600 Astronaut Blvd. This provision additionally safeguards the owner/developer’s ability to
utilize the Commercial Parking component of the agreement, should the
need arise.
Authorize the relocation of Phase 3 (new hotel) to properties
immediately across the street at the Radisson/Fairvilla properties.
• Completed evaluation and negotiations with a Nixle, an Emergency Notification
Service Provider company which offers competitive pricing, additional outreach
mechanisms, including social media, emergency and/or non-emergency user opt-ins as
well as an opt-in portal targeted to visitors who do not live here, but are interested in only receiving news related to specified topics. Staff has reviewed several companies and has opted to contract with Nixle. This change saves the City approximately $5,000
annually and increases productivity & effectiveness.
• Staff has been contacted by Brevard County investors interested in establishing a “Pedal Pub” business in the Port/City area. The business would take 10-15 people on a short tour of the Port and out to Jetty Park, stopping along the way at a few choice
bars/restaurants, and possibility a route down Ridgewood Ave. to the Pier and local
bars. (Graham’s, Jump’s, etc.) There would be no alcohol served on the pedal pub; it
would strictly serve as transportation and as an informational tour of the area. For an example visit: http://www.visitstpeteclearwater.com/attractions/pedal-pub/1548). These operations have had success in other areas, and this may be a great addition to
the Port/City as a fun opportunity to safely see more of Cape Canaveral. Staff will assist
and coordinate efforts with Port Officials and Brevard County Sheriff’s Office.

Highlighting The Area’s Rich History - This week, the Brevard County Historical Commission
published the Fall/Winter installment of the 2016 Indian River Journal. This season’s publication
features the first article in a four part series called, “Who, Why and How the War for Independence
came to Cape Canaveral”, written by Molly Thomas, the City’s Cultural Programs Manager and
Staff Historian. This series will highlight some of the lesser known topics associated with Cape Canaveral’s brief appearance in America’s War for Independence. Copies of this publication are
free and available locally at City Hall, the Cape Canaveral Public Library and at the Nancy Hanson
Recreation Complex. Digital versions of this and previous issues can be accessed at

Athletic Leagues - This week seemed to be plagued by injuries for league participants. The
Advanced Monday night tennis championship game was canceled due to one of the players pulling
a muscle in his leg. Wednesday night intermediate tennis saw two players advance to the
championship without a racquet being picked up; both playoff matches were forfeited due to players injuring themselves. Wednesday night advanced racquetball finished up their make-up
matches and are eager to begin playoffs next week.
Farmers Market – The Farmer’s Market had a great return on its first Saturday back. Everyone is invited to enjoy the fresh produce, baked goods and artisanal products offered at the market. See you Saturday from 9 a.m. to 3 p.m. at Xeriscape Park on Taylor Avenue across the street from the
Nancy Hanson Recreation Complex.
Canaveral City Park Dugout – Work continues on the dugout at Canaveral City Park. Although
the project has faced some rain delays, the contractor is making steady progress.
Friday Fest – The best family friendly food and music event on the Space Coast is just a week
away. Mark your calendars for October 7th from 6 p.m. to 10 p.m. and stop by Taylor Street to say
hello to your neighbors and friends.
Street Eats On Taylor Avenue – If you don’t get enough awesome food at Friday Fest, not to
worry! An amazing array of food trucks from one of Florida’s biggest Food Truck Event
Organizers will take over Taylor Street Saturday, October 8th from 5 p.m. to 8 p.m. Don’t miss it.
Space Coast Art Festival 2017 – The City received a letter from the Board of Directors of the
Space Coast Art Festival requesting Manatee Sanctuary Park as the permanent home of the
prestigious 52 year old show. The Board is interested in entering into a long term agreement with
the City further solidifying the relationship. Staff will work with their president and Board on the Outdoor Entertainment Event Permit application to ensure all necessary requirements and logistics
are worked out for a successful event. Although Manatee can easily accommodate the number of
artists the show usually attracts, the Board is aware that parking and shuttling to and from the Park
will be one of the biggest items to address in order to have a positive experience.
Public Works Services Update for Week Ending September 30, 2016

Wastewater Treatment Plant (WWTP)/Sanitary Sewer System
• Oxidation Ditch Rehabilitation Project. Pre-construction meeting scheduled for October 6; notice-to-proceed project date of November 1. This is one of the projects funded through
the City’s State Revolving Fund (SRF) Loan.
Equalization Basin to be converted to temporary Oxidation Ditch – looking southwest. Infrastructure Maintenance (IM)
• North Atlantic Avenue Streetscape Project. Contractor currently finishing installation of irrigation system; Staff and consultant revising Landscape Plan due to presence of
numerous unmarked buried utilities. Landscaping activities to be initiated week of October
3. Maintenance of traffic (MOT) includes closure of one lane on North Atlantic Avenue
during working hours; flagmen are utilized to direct traffic. All roads will be open after working hours. Estimated project completion – early-November 2016. NOTE: All businesses in the North Atlantic Avenue corridor will remain open during construction activities.
• SR A1A Traffic Signs/Poles. IM Staff has initiated the installation of decorative traffic signs/poles along SR A1A.
• Ridgewood Avenue Improvements. IM Staff continues to replace mulch in plant beds
with decorative stone.

Stormwater
• Live Blue Stormwater Education and Outreach Program. The City will again support
this stormwater education program in FY16/17 by contributing $3,024. The Live Blue
Program is designed to inform individuals about practices that damage the Indian River Lagoon (IRL), to promote pollutant load reduction and to provide more environmentally safe choices to reduce our footprint, improving water quality for all. This Brevard County
Program is supported by all municipalities in the County.
• Florida Stormwater Association (FSA). The City will again support this statewide stormwater association in FY16/17 by contributing $500. The major purpose of the FSA is
to enhance the capacity of stormwater management practices through research,
dissemination of information, active participation in the legislative decision process and
education.
• Canaveral City Park Ex-filtration Project. Construction for this Project was initiated on
August 3. Both the softball and Little League fields will be closed until Project completion
in late-2016 or early-2017; work is also being performed in the adjacent City streets.
Sandpiper Park (playground), Youth Center and basketball courts will remain open. Contractor is currently performing excavations in outfield area of softball field and
connecting stormwater lines in surrounding streets. Project is being funded with two grants
from (1) FDEP and (2) State Legislature funds as well as funds from the City. The City
also received an additional $50,380 in grant funds from Florida Department of
Environmental Protection (FDEP) for this Project.

• EPA 319 Shoreline Protection Grant. The grant contract for this Project was finalized/ signed by the City and FDEP. The grant provides $98,400 for shoreline restoration at
Manatee Sanctuary Park and Banana River Park; the City will contribute $65,600 in
matching funds. Engineering design and preparation of bid specifications to be initiated
first week of October.
