This residential and business friendly atmosphere is a liveable, attractive, safe, inclusive and sustainable coastal community that embraces the seaside and riverside as the main amenities, and supports local culture, commerce and education. We envision: A1A as a “complete street” with a native-landscaped and tree-lined median with traffic calming elements and dark-sky street lighting. “Complete street” amenities include bicycle facilities, covered transit stops, and safe pedestrian crossings that invite pedestrians and bicyclists to access the beach, river, local neighborhoods and adjacent communities. Our improved “complete streets” will allow us to travel calmly to intimate waterfront destinations and a walk-able uptown core. Multi-use paths lined with shade trees should be wide enough for bikes and pedestrians and lighted so anyone can walk or bicycle safely anywhere in town, day or night. We envision: Welcoming community entrance features that create a sense of arrival and unique community identity. The “uptown” and other areas will contain an architecturally rich and unique mix of uses, with wide tree shaded sidewalks and umbrella covered café tables at restaurants and bistros where friends gather, interact, and enjoy drinks and dinner. We envision: A community that; removes or transforms blighted and unfinished buildings into attractive structures, offers city-wide green spaces, provides a pet-friendly park with ample shade, and actively recruits and supports businesses that enhance economic viability and serve our residents and visitors. We envision: Open shorelines and rivers accessible to the public including amenities that take advantage of the water, such as limited and quaint water-view establishments and intimate public gathering and entertainment places that may include pavilions, gazebos, or a performance stage. Administrative Services Update for Week Ending September 16, 2016 The City Manager’s Office is responsible for the day to day administration of all City departments in accordance with City Council’s established policies/direction, local ordinances, resolutions and State/Federal laws/rules and regulations. Telephone conferences, meetings with citizens, documents prepared/reviewed/approved and meetings/conferences held are numerous and may not be included in the Weekly Updates. Highlights: • Met with Department Directors regarding various projects/issues/initiatives. • EA provided assistance to City Council Members and select Department Directors. • Met with Council Member John Bond regarding various City initiatives. • Met with Council Member Brendan McMillin regarding various City initiatives. • Met with City Attorney and select Department Directors regarding Stormwater and miscellaneous items. City Clerk’s Office Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public/Staff and provided assistance to City Council. Highlights: • Records Management – 147 pages of documents scanned; 126 pages of documents verified; 1,481 pages of documents transferred from Captaris/Alchemy database to Laserfiche; continued preparing records for offsite scanning/disposition/destruction. • Council Meetings – attended 9-6-2016 Special Meeting; prepared/distributed agenda/packet for 9-20-2016 Regular Meeting; continued preparing for 10-18-2016 Regular Meeting. • Elections – Received 4 Campaign Treasurer Reports, Report Code G1. • Continued planning and confirmed the schedule for Florida City Government Week, October 16-22, 2016 (see attached). This year there will be approximately 400 students participating. • Attended Community Redevelopment Legislative Update webinar. • Attended Florida League of Cities Public Records Request training in Sanford, which included discussions of Legislative impacts, best practices, case studies and the role of the media. • Met with City Manager regarding various items/issues. Financial Services Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public. Highlights: • Attended City of Cape Canaveral Sustainability Planning Committee meeting. • Met with City Manager, City Attorney and Capital Projects Director to discuss Stormwater Utilities issues. Human Resources/Risk Management staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the public. Highlights: • Legal Update U.S. Equal Employment Opportunity Commission (EEOC) replaced its 1998 Compliance Manual section on retaliation, issuing its final Enforcement Guidance on Retaliation and Related Issues ("the Guidance"). The Guidance reflects the EEOC’s consideration of feedback received from approximately 60 organizations and individuals. 45% of EEOC charges include a claim for retaliation, more than any other basis of alleged discrimination. The EEOC generated the Guidance with the stated purpose of reducing the likelihood of retaliation. The Guidance illustrates the EEOC’s broad interpretation of the protections afforded to employees engaging in protected activity. To prove a retaliation claim, an employee must show (1) he/she was engaged in protected activity, (2) the employer took a materially adverse action against them and (3) there is causal connection between the protected activity and the materially adverse action. Employers should note the new expansive definitions of these elements in the Guidance. Employers responsible for retaliation by non-supervisory employees. In Vasquez v. Empress Ambulance Service, Inc., No. 15-3239-cv (August 29, 2016), the Second Circuit Court of Appeals set new precedent when it held that an employer may be held liable for the retaliatory intent of a nonsupervisory employee under Title VII of the Civil Rights Act of 1964. The Second Circuit held that, under Title VII, the retaliatory intent of a low-level employee may be imputed to the employer if the employer negligently relied upon information provided by that employee in making the employment decision. This decision serves as a strong reminder that employers in the Second Circuit and their trained human resources professionals should carefully and thoroughly investigate all employee discrimination and/or harassment complaints. Laws Prohibiting Discrimination in Transgender Healthcare The Department of Health and Human Services (HHS) has issued final regulations under Section 1557 of the Affordable Care Act (ACA) pertaining to transgender discrimination for plan years beginning in 2017. Section 1557 of the ACA prohibits discrimination in federally funded health programs based on race, national origin, age, disability and sex. In May 2016, HHS clarified that this prohibition included all gender-transition-related healthcare. In addition to HHS, Maryland, the District of Columbia and 16 other states, prohibit health insurers from denying or limiting health coverage for transgender individuals. While some employer-provided health plans are subject to state insurance regulation with respect to transgender healthcare, overall compliance and regulation will depend on a number of factors. It is important for employers to determine which regulations their health plans must abide by and be aware of how coverage and exclusions are currently structured in their plan design and administration. • Negotiations concluded with Florida Municipal Insurance Trust (FMIT) regarding the quote for the City’s FY2016/17 Property, General Liability, Automobile and Workers’ Compensation Risk Management insurance. While FMIT proposed a reduction of the original quote from 7% to 2.8%, efforts were successful in achieving a comprehensive premiums rate, when taking into consideration the City’s increase in insurable assets, below 2015/16 rates. At a total premium of $163,222, the City is within $347.00 of last year’s quote. • HR is currently seeking a qualified candidate for a Code Enforcement Officer position. The search for a P.T. Recreation Leader is near completion with an anticipated October 1 start date. • HR conducted two sessions of Safety Program training targeting Public Works Services employee Regularly scheduled Safety Program training represents a crucial element in accident/injury/property damage prevention. • ZIKA UPDATE: Florida Zika Count Hits 70 Local Cases Florida health officials said Tuesday they found six new locally transmitted cases of Zika virus, bringing the State's count to 70 cases. Florida Governor Rick Scott traveled to Washington D.C. Staff attended various meetings, performed day-to-day duties/responsibilities, website maintenance/improvements and performed content sourcing throughout the City for various digital/social media platforms. Other highlights include: Conversations with residents/pedestrians/business owners in regard to: • Cape Canaveral Community Garden • Beach & Kite Fest • Bat boxes • Traffic/speeding Staff met with the Orlando based bike share company Juice to discuss a similar bike share program in Cape Canaveral. The meeting covered: • Program benefits o Community engagement o Low cost transportation alternative o Bicycle safety/awareness • Program implementation/possible costs • Program sponsorship/buy in The Cape Canaveral Community Garden is nearly complete! The first City Garden will house ten (10) raised bed garden boxes of various sizes allowing fourteen (14) gardeners to creatively plant a 2 x 4 foot space, twenty (20) window style boxes along the railing, rain barrels, compost area and a work table/storage desk. The Garden plots will be determined by a lottery on Friday, September 16, 2016. This project is funded in part by City Council member Brendan McMillin and with grant funds from the National Recreation and Park Association. Community Development Update for Week Ending September 16, 2016 Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the public, including performing plan reviews, processing permits, conducting inspections, performing site visits, issuing Notices and conducting research. The Building Division conducted 68 inspections; processed 32 new building permit applications; 43 permits picked up and payments processed; processed 87 renewal Business Tax Receipts (BTR’s) fire/alarm payments; Processed 60 renewal applications; processed five (5) new BTR applications; Printed 145 BTR licenses for mail out; made 145 updates in Springbrook. • Provided inspection for New City Hall to include one (1) slab inspection of second floor. • Processed one (1) new contractor information packet (Contractor License, Liability Insurance and W/C Insurance) allowing them to pull permits in Cape Canaveral. • Provided assistance completing building permit applications as needed. • Processed one (1) payment for a lien reduction/satisfaction for property on Poinsetta Avenue. • Processed one (1) payment for Community Appearance Review Application for property on Astronaut Blvd. • Processed one (1) payment for Escrow payment for property on Oak Lane. • Processed one (1) payment for Public Records Request for 139 Oak Lane. • One (1) call to contractor regarding scheduling final inspections for building permits that are nearing expiration & permits recently expired. • Responded to 20 voicemails. • Responded to 11 emails, faxes and calls requesting permit information from realtors and home inspectors. • Compiled Month End Permit Report for August 2016, for Brevard County. • Scanned 50 pages of Certificates of Insurance. • Scanned/verified 841 pages of Building Department documents. • Mailed 25 letters and sent 47 emails to customers regarding missing information for BTR’s. • One (1) hour researching payments for fire alarms and the need for businesses to apply for a BTR. • Numerous phone calls regarding registering fictitious names as LLC or Inc. and/or registering their business names. • Training with Finance Accounting/Payroll Technician. Code Enforcement performed day-to-day duties/responsibilities, assisted with various requests from the Public and provided office coverage throughout the week. Highlights: • Received payment for $5,000.00 for a Code Enforcement lien reduction. • Issued one (1) compliance letter. • Received seven (7) new requests giving life-safety issues priority, followed closely by community appearance and property maintenance. • Conducted 12 site inspections. • Removed 18 signs from the right-of-way and telephone poles within the City. • Responded to 17 lien search requests. • Staff covered counter and assisted eight (8) citizens with building and code enforcement requests. • Responded to 33 voicemails regarding complaints and inquiries. • Resolved one (1) address assignment request; prepared correspondence notifying property owner and other required agencies of the new addresses. • Code Enforcement Officers continue to conduct daily community sweeps for visible violations throughout the City. • Completed the 2016 Annual National Flood Insurance Program (NFIP) Community Rating System recertification packet for submittal. Planning performed day-to-day duties/responsibilities, assisted with various requests from the Public and provided office coverage throughout the week. Highlights: • Records Management – 154 pages of documents scanned/verified and 314 MCCI large format plans verified in preparation for destruction. • Coordinated and attended the Planning and Zoning Board Meeting on 9/7/2016 and Development Review Committee on 9/8/2016. Board approved a site plan application for the parking lot associated with the Kelsey’s restaurant at 8699 Astronaut Boulevard. • Prepared meeting minutes for Code Enforcement Board, Planning and Zoning Board and Development Review Committee. • Prepared agenda item for the October 18, 2016, City Council meeting to present Paula Collins for appointment to the Code Enforcement Board. Ms. Collins has previous experience on the City’s Board of Adjustment. • Met with Building Department Senior Secretary regarding the consistent preparation of meeting minutes. • Participated in a conference call with Kimley-Horne regarding a proposal for design work for Polk Avenue and a park masterplan for Canaveral City Park. • Prepared Site Plan Application for distribution to review and provide comments regarding Oceanside Distillery located on E. Central Avenue. • Distributed Community Appearance Board Agenda Packet for 9/21/2016 meeting. Agenda includes two cases. One case for the redesign of the building at 8600 Astronaut Boulevard and a case dealing with the painting of a commercial building at 111 E. Economic Development Update for Week Ending September 16, 2016 Performed day to day duties/responsibilities, conducted various meetings with business stakeholders, potential investors, citizens, realtors and Staff. Performed site visits and conducted research as necessary. • City Hall status: o Workers have completed the welding of the second floor decking and bridging. o Required deck/weld inspection was approved by Contractor’s Consultant Engineer. o Weather permitting, 4 inches of concrete will be poured on top of the steel decking early next week to complete the structural elevated floor system. o Attended monthly construction meeting with Contractor, Architect, Building Official and City Engineer. • Port of Call Project: o With City Attorney, continued review and response for submitted revised Development Agreement. The developer has proposed revisions to incorporate additional properties immediately across the street at the Radisson property where the hotel component of the Agreement will be developed as part of the proposed revisions. o The purpose of the revision is to repurpose the original property (8600 Astronaut) as a new home for a company to locate their corporate headquarters to the City of Cape Canaveral. o The company, code-named Project Zeus, is seeking certain Ad valorem Tax (AVT) abatement incentives through the EDC/Brevard County and the City’s AVT program. Staff is coordinating these efforts and expects to have a supporting Ordinance on the October 18th City Council Agenda. • Attended SCTPO meeting. Director has been appointed to the Technical Advisory Committee. • Wayfinding Signage program: o Provided conceptual graphics to FDOT for A1A signs: o Coordinating FDOT review with District 5 Traffic Operations Engineer. o Our goal is to create place-making and wayfinding signage that contributes to a sense of place and conveys our branded message, theme and colors. We are working creatively toward something more unique than the typical signage approved by FDOT. Harvey Senior Director of Communications & Community Affairs 321-783-7831 ext. 242 or 321-394-3281(after hours) rharvey@portcanaveral.com MEDIA ADVISORY Port Canaveral Partners with Carnival Cruise Lines, Sea World & Keep Brevard Beautiful for International Coastal Cleanup At Jetty Park This Saturday WHAT: The Canaveral Port Authority Environmental Department is teaming up with Carnival Cruise Line crew members, volunteers from Sea World, and regional coordinator Keep Brevard Beautiful (KBB) for the International Coastal Cleanup on Saturday, September 17, from 8 a.m. until noon at Jetty Park. The event is expected to attract 100 volunteers from Sea World and crew from the Carnival Magic. The cleanup will concentrate on the shoreline areas of the boat ramp, park and beach. Date: Saturday, September 17, 2016 Time: 8:00 a.m. Coastal Cleanup Location: Jetty Park, Pavilions 17-19 (The pedestrian gate between Jetty Park and the adjacent Port boat ramp will be opened for volunteers to park in that area and enter/exit.) Director Meetings • City Manager • Human Resources Director • Administrative/Financial Services Director • Banana River Park Parking Lot Contractor • BCSO Sheriff’s Breakfast • Sustainability Team Meeting • Cocoa Beach High School Student – Take Stock in Children Mentorship Program Space Coast Beach & Kite Festival - Kites filled the sky for the Space Coast Beach and Kite Festival at Cherie Down Park on September 10th. This year, the City partnered with Kite World, a vendor and kite fly event sponsor from Indialantic, Florida. Throughout the day, more than 200 children colored and decorated their own kites, free of charge. Some took part in a coloring contest for a chance to win a large kite, donated by Kite World. This festival also served as a regional event for the Brevard County Sheriff’s Office P.A.L. program bringing youth volunteers from Cape Canaveral, Satellite Beach and Cocoa to sell concessions and assist with numerous facets of the event. Guests were invited to participate in a short round of Frisbee golf using equipment purchased through a National Recreation and Parks grant designed to encourage healthy activities for kids and families. Volunteers from Keep Brevard Beautiful set up an outreach booth to share information on beach conservation and enlist participants for their local beach clean-up events. Representatives from the Central Florida Kite Club were on site with several large, unique kites and the relaxed beach atmosphere was enhanced by the acoustic jams of General Eyes. Canaveral City Park Dugout – Concrete pad and electrical stubs were installed. Wall construction will begin next week. BCSO PAL – The annual Breakfast with the Sheriff was held raising money for the organization. Two Cape Canaveral youths spoke at the event reiterating the impact PAL has had on them; one is a student at UCF and the other a senior in high school who will be joining the Air Force after graduation. Local residents Rick and Melanie Evans donated $50,000 to the organization with strict covenants that the money be used for the City’s BCSO Youth Development Council PAL program. This money will allow local children who belong to BCSO YDC PAL, and volunteer the needed number of hours in the community, the chance to go on field trips, leadership conferences, acquire uniforms and take part in experiences that will make them better citizens and most importantly keep them out of trouble. Thank you Rick and Melanie! Frisbee Golf Fridays – Have you ever tried Frisbee Golf? Whether you’re new to the game or a seasoned veteran, everyone is welcome to join us at Manatee Sanctuary Park the third Friday of every month starting on September 16th from 6 p.m. to 8 p.m. Each month, a nine hole course will be set up throughout the Park for players at all skill levels. Participants are encouraged to bring their own discs, but a limited number of disc sets are available for public use. This free, healthy, outdoor activity is sure to get the whole family up and moving. Banana River Park Phase – Final walkthrough took place on north parking lot. This completes Phase II of the project. Phase III has a shade shelter and a shade structure over the playground still left to be completed prior to finalizing all construction at the park. Farmers Market – The Farmer’s Market will make a return to the City Saturday, September 24th at Xeriscape Park. The contractor stated that their intention was to recruit more artisanal products that reflected the true spirit of a farmers market as we approach the busy fall / winter season. Public Works Services Update for Week Ending September 16, 2016 Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the public. Wastewater Treatment Plant (WWTP)/Sanitary Sewer System • Oxidation Ditch Rehabilitation Project. Pre-construction meeting scheduled for October 6; notice-to-proceed project date of November 1. This is one of the projects funded through the City’s State Revolving Fund (SRF) Loan. Stormwater • Canaveral City Park Ex-filtration Project. Construction for the Project was initiated on August 3. Both the softball and Little League fields will be closed until Project completion in early-2017; work is also being performed in the adjacent City streets. Sandpiper Park (playground), Youth Center and basketball courts will remain open. Contractor is currently performing excavations in outfield area of softball field and connecting stormwater lines in surrounding streets. The following scope changes will be required due to the following items identified during construction: o A buried manhole near the home plate area of the softball field will require repairs; o A “dip” in the sanitary sewer line beneath the softball field will require repair; and o The contractor will repair the electrical service to the scoreboard. Project is being funded with two grants from (1) FDEP and (2) State Legislature funds as well as funds from the City. The City has also received an additional $50,380 in grant funds from Florida Department of Environmental Protection (FDEP) for this Project. Infrastructure Maintenance (IM) • North Atlantic Avenue Streetscape Project. Contractor currently finishing installation of irrigation system; heavy rainfall limited work for the week. Maintenance of traffic (MOT) includes closure of one lane on North Atlantic Avenue during working hours; flagmen are utilized to direct traffic. All roads will be open after working hours. Estimated project completion – late-October 2016. NOTE: All businesses in the North Atlantic Avenue corridor will remain open during construction activities. Safety/Training • First Annual Spotter Games. Staff designed a three-part spotter/vehicle obstacle course to test communication skills between drivers and spotters. The goal of the exercise/ competition was to build on recent classroom spotter training. Trophies were awarded for the best spotter, driver and team. Miscellaneous • Sustainability Committee. The Committee met to further define specific topics to be included in the Sustainability Plan. The next meeting is scheduled for late-September. • Potential Grant Opportunities. Staff is currently investigating three grants to fund potential City projects: o Safe Routes to School Projects; o Coastal Partnership Grant; o FDEP TMDL Water Quality Restoration Grant. • Department of Economic Opportunity (DEO) Grant. Review comments to the draft Work Plan were received from DEO; Staff is currently preparing a final Work Plan. This grant will fund the following City planning projects: o Master Plan for Canaveral City Park; and o Mobility Plan for the entire City. A complete Grant Status Report is attached. • Brevard IRL Coalition.
