M . the following 4 proceedings were had : ) 5 THE MAYOR : I ' d like to call this 6 meeting of the City Council of Cape 7 Canaveral in session , please . At this time 8 we ' ll go into a closed session as per 9 Florida Statute with our attorney on a 10 pending law case . 11 Attending this are the City Attorney , 12 John Kancilia ; the City Manager , Bennett 13 Boucher ; Councilman Rocky Randels , 14 Councilman John Porter , Councilwoman Joan 15 Calvert , Tom Kleving who is -- 16 MR . KANCILIA : The defendant in this 17 suit . 18 THE MAYOR : -- a defendant in the 19 suit -- 20 Thank you . 21 -- Cynthia Angell who is recording for 22 us and myself , Joy Salamone , Mayor . 23 Mr . Kancilia . 24 And we expect this meeting to last 25 between ten and fifteen minutes . KANCILIA : The purpose of this 2 meeting is to have the Council consider the 3 settlement offer conveyed by the counsel 4 for the plaintiff , Robert Abbott , to settle 5 Mr . Abbott ' s suit against the City . 6 Before you you have a letter from the 7 City ' s insurance defense counsel , Michael 8 Roper , dated July 19th , 1993 . Mr . Roper 9 with his letter transmitted the plaintiff ' s 10 counsel ' s letter of July 16th , 1993 . The 11 latter letter conveys the plaintiff ' s offer 12 of settlement . Mr . Roper ' s letter .,.. 13 summarizes and critiques the settlement 14 proposal provided by plaintiff ' s counsel . 15 Have all Council members had the 16 opportunity to read the letter? 17 MR . RANDELS : Am I the last person 18 here? 19 Are you speaking of this letter? 20 MR . KANCILIA : July 16th -- excuse 21 me -- July 19th from Michael Roper . Yes , 22 that ' s it . 23 MR . RANDELS : Go ahead . I ' ll read 24 it . 25 MR . KANCILIA : Let me summarize . The KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7-22 -93 5 1 offer of settlement is that Mr . Abbott will 2 apply for a building permit for the 3 satellite dish , and a state certified 4 building inspector will review the building 5 permit . Mr . Abbott requests that that 6 person be Mr . Artis Gunn , a former building 7 official for the City of Cape Canaveral . 8 Mr . Abbott would be permitted to 9 install his satellite dish at a height 10 which allows him to receive all North 11 American satellites . That height would 12 appear to be eleven feet calculated from 13 the established grade to the center of his 14 satellite dish . A separate fence would not 15 be installed around his satellite dish . 16 His satellite dish would not be installed 17 on the roof of the house or on the side of 18 his house . 19 The City would agree to amend its 20 Earth Station Antenna Regulations to 21 provide that ground-mounted earth station 22 antennas shall be erected at a minimum 23 height which would allow satellite 24 reception for North American satellites . 25 The City will commit to an overall KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7 -22 -93 6 1 review of the Earth Station Antenna 2 Regulations so that we are in compliance 3 with federal regulations and case law 4 construing those regulations . 5 Mr . Abbott would agree to forego his 6 claim for compensatory and punitive 7 damages . 8 The City shall pay Mr . Abbott ' s 9 attorney ' s fees and costs in this matter to 10 which I will speak separately in a moment . 11 The parties will execute a Mutual 12 Release , and both sides will execute a 13 dismissal of the lawsuit with prejudice . 14 As to the attorney ' s fees , 15 Mr . Abbott ' s attorneys have incurred or 16 claim to have incurred attorney ' s fees so 17 far in the amount of $49 , 546 . 50 and costs 18 in the amount of $3 , 743 . 31 . The 19 plaintiff ' s offer includes a stipulation 20 that the attorney ' s fee amount would be 21 adjusted to cover all matters through the 22 conclusion of the settlement which would be 23 an amount over and above what I just 24 stated . 25 THE MAYOR : As he outlined in his KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7-22 -93 7 1 letter to us , the transmittal letter , you 2 know , the one that was before this , we have 3 already agreed to everything except the 4 last problem . I still have a problem 5 paying the attorney ' s fees . 6 MR . KANCILIA : The amount of the 7 attorney ' s fees even shocked Mr . Roper . I 8 spoke with him this afternoon . 9 THE MAYOR : I mean this is $50 , 000 . 10 This is ridiculous . 11 MR . KANCILIA : He expected the 12 attorney ' s fees to be in the twenty , 13 $25 , 000 range as opposed to a little over 14 fifty . 15 MR . PORTER : Fifty to sixty . 16 THE MAYOR : I mean it ' s beyond what we 17 could conceivably pay . That is far beyond 18 what I thought it might be at this 19 juncture , too . 20 MR . KANCILIA : I think everyone was 21 surprised . 22 Mr . Roper spoke with Mr . Roger Hagood 23 of the League of Cities which would pay 24 attorney ' s fees in this case if we were to 25 settle it or would pay attorney ' s fees up KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7-22 -93 8 1 to $ 100 , 000 in a event the City had a 2 judgment against it . Mr . Hagood said that 3 he would defer to the judgment of Council 4 in terms of whether they wanted to settle 5 the suit or not in terms of satellite dish 6 issues . As to the fees Mr . Hagood ' s 7 inclination at this time would be that the 8 League of Cities would be willing to offer 9 fifty percent of the amount claimed as a 10 settlement , roughly twenty- five or whatever 11 that is . 12 THE MAYOR : I was going to say costs . 13 He pays the attorney ' s fees , and we ' ll pay 14 the costs he ' s incurred . 15 MR . KANCILIA : We could certainly make 16 that offer if Council were so inclined , but 17 the League of Cities would not have 18 difficulty if we were to offer half of the 19 entire $53 , 000 amount at this point . 20 THE MAYOR : Would Council be willing 21 to do that? 22 MS . CALVERT : Mayor . 23 THE MAYOR : Yes , ma ' am . 24 MS . CALVERT : In this agreement with 25 the minimum of eleven feet for the KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7 -22 -93 9 1 placement and the height and the statement 2 there , placement of the dish anywhere it 3 would be required in order to get all the 4 northeastern satellite dishes , is a very 5 loose statement that someone could place 6 this in their front yard if that ' s how they 7 desire to put it , and I think we ' re 8 jeopardizing everything here according to 9 this , to this request . 10 THE MAYOR : I hear what you ' re saying . 11 MS . CALVERT : Okay? 12 THE MAYOR : Okay . 13 MR . PORTER : I mean I know one case 14 where a gentleman has trees surrounding his 15 house and he would love to just run a pole 16 all the way up to the roof . In a way you 17 don ' t blame him . He wants to use a 18 satellite dish . On the other hand , 19 according to this as amended as to per 20 Mr . Abbott he would be in his full rights 21 to do so , and , you know , I think our 22 priority has been in what the Planning and 23 Zoning Board originally had come up with 24 which was to protect the health , safety and 25 welfare of the citizens . The aesthetics is very 3 important to us . 4 MS . CALVERT : The aesthetics . 5 And according to this you could put it 6 anywhere you want to . 7 THE MAYOR : In this town we have proof 8 of that . We have proof that aesthetics is 9 important in this town . 10 MS . CALVERT : Exactly . 11 THE MAYOR : We tax ourselves with 12 beautification separate and totally 13 different from what we tax everything 14 else . So I think that ' s a good case . 15 As we said all along , we would support 16 this ordinance no matter what but that 17 Mr . Roper seemed ready to go to 18 settlement . I don ' t see we ' re close enough 19 to do that . 20 MS . CALVERT : I agree . 21 MR . KLEVING : Could I make a statement 22 here? 23 THE MAYOR : Mr . Kancilia , can he? 24 MR . Kleving . 2 MR . KLEVING : Okay . I just have a 3 couple questions . Number one , when he 4 requests all satellites , North American 5 satellites , was that over what he was 6 receiving before? 7 Number two , if he was indeed receiving 8 all these , it ' s my understanding that he 9 would have to subscribe to all of these 10 satellites , and did he in reality subscribe 11 to all of them? Has he proven that , or was 12 he possibly pirating them? 13 MR . KANCILIA : I don ' t know the answer 14 to the question . I think the issue -- 15 THE MAYOR : Did you ask Mr . Roper? 16 MR . KANCILIA : Yes . 17 MR . BOUCHER : I think those are some 18 of the questions he refused to answer in 19 his interrogatories . 20 THE MAYOR : I know . 21 MR . KLEVING : If I can continue with 22 one more . 23 THE MAYOR : Go ahead . 24 MR . KLEVING : Number three , what he ' s 25 requesting is only four feet over what our KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7 -22 -93 12 1 regulations are now -- 2 MS . CALVERT : Yeah . Yeah . 3 MR . KLEVING : -- which is really 4 pretty ludicrous , I think , given the fact 5 that , with the expert that I was out there 6 to Mr . Abbott ' s house with Mr . Roper , he 7 could pick up all but maybe two of the 8 satellites , and of those two he wasn ' t 9 sure . There would be nothing to say he 10 wouldn ' t be picking up everything at eight 11 feet . I ' m sure that had he gone before 12 Code Enforcement that he probably would 13 have got the eight feet had it been 14 requested . 15 MS . CALVERT : It ' s this Paragraph 3 16 that I have the real problem with , 17 "The City will amend its Earth 18 Station Antenna Regulations to provide that 19 ground-mounted earth station antennas shall 20 be erected at the minimum height which 21 allows satellite reception as certified by 22 a satellite vendor or one qualified to 23 conduct a site survey in connection with 24 reception of satellites on the property . " 25 THE MAYOR : Okay . We have a problem KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7 -22 -93 13 1 with No . 3 definitely . 2 MS . CALVERT : Absolutely . 3 MR . RANDELS : And No . 6 . 4 THE MAYOR : And No . 6 . 5 I need to ask something on No . 6 that 6 I forgot to say . 7 It says that we shall pay his 8 attorney ' s fees and costs with an 9 additional amount estimated to conclude the 10 settlement . What does that mean? 11 MR . KANCILIA : Drafting the settlement 12 documents . 13 THE MAYOR : Any costs incurred? 14 MR . KANCILIA : Well , primarily 15 attorney ' s fees to draft settlement 16 documents and appear in court to dismiss 17 the case . 18 THE MAYOR : That wouldn ' t be part of 19 the fees and costs talked about in the 20 first part of that sentence? 21 MR . PORTER : It ' s a closing cost . 22 THE MAYOR : Obviously , it ' s going to 23 be a hundred thousand dollars by that time . 24 MR . PORTER : Probably another two to 25 three based on what we know right now . KANCILIA : I would say two to 2 three is a reasonable estimate . 3 THE MAYOR : No . I would say two times 4 this amount . 5 MR . KANCILIA : To conclude this 6 settlement? 7 THE MAYOR : If we don ' t settle 8 tonight , based on the fees we ' ve seen so 9 far if we go to trial , I bet you . 10 MR . KANCILIA : Well , if we go to 11 trial , right . 12 In answer to Councilman Porter ' s 13 question I would say normally two to three 14 thousand would be a reasonable amount to 15 conclude this . The size of Mr . Lee ' s fees 16 are shocking . So two to three thousand 17 might be sufficient . 18 THE MAYOR : They thought ten to 19 fifteen was sufficient before . 20 MR . KANCILIA : I know . We were all 21 surprised . 22 MS . CALVERT : I have a question for 23 Mr . Kancilia . 24 MR . KANCILIA : Yes , ma ' am . 25 THE MAYOR : Yes . CALVERT : Is this normal procedure 2 for the plaintiff to insist that he have a 3 personally selected building official 4 handle this? 5 MR . KANCILIA : No . No . It ' s not , and 6 that ' s obviously -- 7 MS . CALVERT : Then I have another 8 problem . 9 MR . KANCILIA : -- that ' s a personal 10 concern he has . I mean there were 11 allegations in the complaint against 12 Mr . Morgan , and I think that ' s why this 13 stipulation was put in the settlement 14 agreement . It ' s a personal matter with 15 Mr . Abbott and Mr . Morgan , Mr . Abbott 16 primarily . 17 MS . CALVERT : I understand this , but 18 if the City were willing to determine 19 another building official , I think it would 20 be up to the City to determine other than 21 if we chose , not Mr . Morgan , but someone 22 else . 23 MR . KANCILIA : That ' s certainly a 24 matter of negotiation . Nothing in here 25 is -- to KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7-22 -93 16 1 MS . CALVERT : I think it ' s ludicrous 2 to go out and pick your own building 3 official . 4 MR . KANCILIA : You know , this is a 5 framework for negotiation , and I don ' t 6 think we should consider any of the points 7 in the settlement offer to be 8 nonnegotiable . 9 THE MAYOR : Well , No . 4 is good . 10 Point four is good and fair . 11 MR . KANCILIA : Five . 12 THE MAYOR : Five is very good . I like 13 five a lot . 14 MR . KANCILIA : By the way , in your 15 packet -- 16 THE MAYOR : Seven is all right . 17 MR . KANCILIA : I don ' t know if you 18 received it in your packet , but the City ' s 19 motion to dismiss was denied -- 20 MS . CALVERT : Yes . 21 MR . KANCILIA : -- except as to 22 Mr . Abbott ' s claim for punitive damages 23 which was dismissed . 24 THE MAYOR : It ' s already been 25 dismissed . KANCILIA : The case law is fairly 2 clear that municipalities and states don ' t 3 have to pay punitive damages in cases such 4 as this . The bad news for Mr . Kleving is 5 that the punitive claim as to him was not 6 dismissed as individuals can be held liable 7 for punitive damages in cases of this 8 sort . However , Mr . Roper will be 9 submitting a motion for summary judgment by 10 the 30th , and hopefully many , if not all , 11 of the claims against Mr . Kleving will be 12 settled favorably for Tom . 13 THE MAYOR : We hope so , Tom . That 14 would be only be fair . 15 MR . KLEVING : I have a question . 16 If Mr . Abbott won ' t answer a couple 17 questions from the Attorney Roper on some 18 of these , is it possible for the attorney 19 to subpoena records from these satellite -- 20 THE MAYOR : Companies? 21 MR . KLEVING : -- these people that 22 sell these satellite programs to find out 23 if indeed Mr . Abbott was receiving all of 24 these , number one , and if he was paying for 25 it , number two? It is possible to 3 have a subpoena of records which are 4 relevant to a civil lawsuit . However , I 5 think the time for that might have passed , 6 and , you know , again certainly that 7 information is relevant but I think the 8 issue is broader than that . 9 MS . CALVERT : Since these questions 10 were only asked in deposition , doesn ' t 11 Mr . Roper still have the opportunity to ask 12 these questions? 13 MR . KANCILIA : At trial ? 14 MS . CALVERT : At trial . 15 MR . KANCILIA : Certainly . 16 MS . CALVERT : I asked that question . 17 MR . BOUCHER : Also , Mr . Roper has 18 filed a motion to compel him to answer 19 those interrogatory questions . 20 THE MAYOR : Right . There ' s still an 21 effort . 22 MR . BOUCHER : We ' re just waiting on 23 the judge to make a determination on those . 24 THE MAYOR : Let ' s go down item by item 25 to see what it is that we could possibly KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7 -22 -93 19 1 agree to . We would certainly agree to -- 2 MR . PORTER : Are you starting from 3 one? 4 THE MAYOR : I ' m starting at one . 5 I would agree to a state certified 6 building inspector reviewing any permits 7 that might have to do with the settlement 8 here . Would all of you agree to that? 9 MS . CALVERT : Yes . 10 THE MAYOR : Agreed to by the City and 11 the plaintiff or whatever . Is that how you 12 say it , that we could come to an agreement 13 on one? 14 MR . KANCILIA : Right . Mutual 15 agreement . 16 THE MAYOR : He could give us six or 17 seven names and let us choose . Does that 18 make sense? 19 MR . KANCILIA : Sure . 20 THE MAYOR : Is that agreeable to 21 Council? 22 MS . CALVERT : Yes . 23 THE MAYOR : Okay . How about allowing 24 him to install his satellite dish at a 25 height that permits him to receive all the KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7-22 -93 20 1 North American satellites? 2 MR . RANDELS : If we say yes to this 3 individual , how can we say no to his 4 neighbor? 5 THE MAYOR : That ' s how I feel . 6 MS . CALVERT : Exactly . 7 MR . KANCILIA : You probably can , and 8 the way of the procedure of implementing 9 the settlement will have to be is that we 10 will have to amend the ordinance first to 11 allow a height of greater than seven feet 12 because the Council does not have the 13 authority to tell someone you can put your 14 satellite dish at a height of eleven feet . 15 Only the Board of Adjustment can . 16 THE MAYOR : It ' s a special exception . 17 MR . KANCILIA : Yes . I don ' t think 18 Mr . Abbott is willing to go before the 19 Board of Adjustment and take his chances 20 there . We would have to amend the 21 ordinance to a height of eleven feet , and 22 when you amend the ordinance -- 23 MR . RANDELS : Everybody . 24 MR . KANCILIA : -- every other citizen 25 will have the opportunity of an eleven-foot KING REPORTING SERVICES Melbourne , FL ( 407 ) 242 -8080 CONFIDENTIAL - NOT PUBLIC RECORD CLOSED SESSION , 7 -22 -93 21 1 satellite dish . 2 MS . CALVERT : I ' ve always felt that 3 you don ' t tailor make an ordinance to suit 4 one particular case . If the next person 5 that comes along needs fourteen feet -- 6 THE MAYOR : And takes it to court . 7 MS . CALVERT : -- and takes it to 8 court , where do we stand then if somebody 9 else needs higher than eleven? I think 10 eleven is just -- I don ' t feel safe with 11 eleven because next week somebody might 12 need twelve or fourteen feet . 13 MR . KANCILIA : What the ordinance 14 would have -- 15 MS . CALVERT : I think this is being 16 tailored made here . 17 MR . KANCILIA : What the ordinance 18 would have to provide to be valid and also 19 to be usable in the future for the citizens 20 would be an internal variance procedure , if 21 you will , whereby each particular request 22 would stand on its own merits , and someone 23 would have to pass upon how high the 24 satellite dish could be installed in order 25 to receive the satellites . CALVERT : Because of safety and 5 welfare factors . 6 MR . KANCILIA : Right . 7 MS . CALVERT : As well as aesthetics . 8 MR . KANCILIA : When we get that , we 9 could cure some of the other issues that 10 are plaguing us with this . 11 MS . CALVERT : We have a six-foot 12 ordinance on fences on the rear and sides 13 of property . 14 MR . KANCILIA : Right . 15 MS . CALVERT : Well , speaking of 16 aesthetics maybe the neighbor in the 17 backyard doesn ' t want to see a huge 18 satellite dish there staring them in the 19 face from their backyard , you know . 20 THE MAYOR : Okay . So we can ' t live 21 with this . Is that what I ' m hearing? 22 MR . PORTER : I would say that we just 23 invite him to do what he should have done 24 in the first place and invite him to go to 25 the Board of Adjustment . RANDELS : I think , Mary , if indeed 2 we make and it appears that we are saying 3 we are changing or proposing to change the 4 ordinance for this one specific individual , 5 then that is somewhat admitting that indeed 6 it was not correct when we had it to begin 7 with and we ' re going back to revisit it . I 8 guess really where I ' m coming from is : 9 What has changed from the time this suit 10 was filed , and are we any more wrong now 11 than we were then? If we aren ' t , then why 12 are we knuckling down and saying , okay , 13 we ' ll change to fit your needs and don ' t go 14 no further? 15 THE MAYOR : That ' s been our bottom 16 line all along .
