Staff has determined that most of the records are electronic City emails that the City Clerk’s Office has already located/identified. Please contact me to let me know whether or not you have located/identified any paper and/or electronic records pertaining to this PRR in your possession, as well as any related records from public/private cell phone, text or social media accounts. If you need more time to complete your portion of this PRR, please try to estimate how much more time you will need. Attached is simple form to assist you. Per Section 119.07(1)(a), F.S., establishes a right of access to public records: Every person who has custody of a public record shall permit the record to be inspected and copied by any person desiring to do so, at any reasonable time, under reasonable conditions, and under supervision by the custodian of the public records. If you have not located/identified any records and are certain you have none to share, simply reply that you do not have records pertaining to this PRR. Staff is already working to analyze/identify/estimate the amount of electronic/paper records that exist in our files and on the City server. I will provide the requestor with an estimate for costs prior to completing the PRR. In order to comply with the PRR, please do the following: 1. Carefully analyze the PRR below. 2. Identify and locate any paper records you have received or created after 1-1-2015 regarding the PRR. (This includes files with correspondence, notes or other documents). 3. Identify and locate any electronic email or text messages you have received or created after 1-1-2015 on any and all PRIVATE accounts only. (CCO will identify any and all City emails). 4. Identify and locate any social media records, ex. Twitter or Facebook, after 1-1-2015 on any and all PRIVATE accounts only. (CE will identify any and all City social media). 5. Please do not create any record regarding this PRR, unless you need assistance or have questions for me or Daniel LeFever. 6. Estimate the amount of time, after 15 minutes, it takes you to identify/locate the paper/electronic records if any. 7. If any the City claims that a requested record is exempt or confidential, please identify the type and date of the record (example: April 1, 2018 email from John Smith to City Manager) and the statutory or other legal basis for the exemption or confidentiality claim. Unless otherwise specified in this request, the word “City” refers to the City of Cape Canaveral. For the purposes of this public records request, the term “documents” includes all email and other written electronic communications (including text messages and Twitter “tweets”); written correspondence; files; circulated notes; minutes; written reports; written recommendations or writings of any kind sent, received or circulated by the: a) City Manager, b) Assistant or deputy City Manager, c) elected City Officials, d) City directors, e) City department heads, f) City employees, g) City agents, if applicable, and h) contractors providing services to the City, including professional legal, planning, engineering or consulting services, if applicable. If copying is desired by the law firm, the specific documents or files will be identified by the law firm personnel assigned to inspect the documents. All documents received or created after January 1, 2015 relating to proposed sewer service to be provided by Cape Canaveral or any other governmental entity including the Canaveral Port Authority, to 2.42 acres m.o.l. of real property owned by Steve L. and Donna Cayer (hereafter referred to as the “Cayer property”) located adjacent to Astronaut Blvd. in the City of Cape Canaveral, as that real property is more particularly described as of the date of this request in the online records of the Brevard County Property Appraiser at https://www.bcpao.us/PropertySearch/#/bcpao/map/2443981 as Account:2455936 Parcel ID:24-37-15-00-34 2. All documents received or created after January 1, 2015 containing the name Tom Hermansen. 3. All documents from the Cape Canaveral development review committee or other city departments or city employees setting forth comments, reports or recommendations relating to proposed sewer service at, or to, the Cayer property by the City or by any other private or governmental body (including the Canaveral Port Authority). 4. Any capacity sewer capacity reservation certificate issued for the Cayer property. 5 5. All documents setting forth, creating or relating to any proposed or existing sewer agreement, permit, or other written permission authorizing the connection of sewer service to property now known as the Homewood Suites hotel with the current address of 9000 Astronaut Blvd., Cape Canaveral, Fl (hereafter referred to as the Homewood Suites Hotel property) which is more particularly described as of the date of this request as Account:2444424 Parcel ID:24-37-15-00-26 in the records of the Brevard County Property Appraiser as shown at https://www.bcpao.us/PropertySearch/#/bcpao/map/2443981 and now or formerly owned by Sunbelt-OCF LLC, Apple Ten Hospitality Group Inc. 6. All Cape Canaveral development review committee or departmental reports or recommendations relating to proposed or existing sewer service now provided at or to the Homewood Suites Hotel property; 7. Any documents indicating waste generated by Homewood Suites Hotel is or would be harmful to any sewer system. 8. The Homewood Suites Hotel capacity sewer capacity reservation certificate. 9. All other documents created by City of Cape Canaveral managers, department heads, employees or elected officials setting forth proposed conditions relating to the connection of sewer service to the Homewood Suites Hotel property. 10. All documents setting forth, creating, relating to or mentioning any proposed, applied for, suggested, discussed or existing sewer agreement, permit, or other permission or approval authorizing connection of sewer service to property with the current address of 9004 Astronaut Blvd. Cape Canaveral, Fl., now or formerly owned by Charles W. and Helen Chapman Pindziak which is more particularly described as of the date of this request as account:2443981, Parcel ID:24-37-15-00-23 in the records of the Brevard County Property Appraiser as shown at https://www.bcpao.us/PropertySearch/#/bcpao/map/2443981 (hereafter referred to as the Pindziak property) 11. The Pindziak property sewer capacity reservation certificate. 12. All City of Cape Canaveral written rules or regulations promulgated by the City Council, the City Manager or any other City employee, department head or official relating to sewer construction or sewer service, but only if such rules and regulations are not part of the City’s code of ordinances.
