I spoke with my Client and we were taken back by your proposal below as this is the first time we hear that the City will only allow us to connect via a gravity sewer system. we have been coordinating the sewer alignment with the City since we started this project. Even at our pre-app meeting , the City invited FDOT personnel to discuss the force main alignment and basically the City was in agreement to have the force main as a public main as this was the only way DOT would allow installation of the main within their right-of-way. If the City had no intention to allow us to connect to either the RaceTrac gravity system or to Lift Station 6 through a force main we should have been told that when we met at the pre-app before my client spent over a million dollars so far. A gravity line, as you are requiring at this point, only works if we can tie-in to the LBA property as shown in the enclosed “Sewer Exhibit” file. The other alignment to consider would be to build a gravity line along A1A as shown in the enclosed “ForceMain – Aerial Exhibit” file. There is a ditch along the west side of our property near AIA and the bottom of the ditch is around elevation 5. So our invert will be around elevation 1 at our property line. In order to connect to Lift Station 6, the gravity main would be approximately 2,400 feet long at 0.4% slope with approximately 8 manholes the depth of the gravity pipe at the lift station would be around elevation – 10 ( about 18 feet deep at the lift station). The existing lift station invert into the lift station is at elevation -3.6 based on the information provided by the City of the existing lift station as shown on the enclosed “C-102 LS NO 6” exhibit. Therefore it is not a feasible alternative. David, since the City, as the utility provider, is requiring my client to ONLY connect through a gravity connection to the City sewer system, then the City as the utility provider should require LBA to provide a PUBLIC SEWER easement to extend the sewer main along their property since a gravity system along A1A is not workable as shown above. Basically, the gravity connection requirement without the public easement makes our project undevelopable. LBA three year stabilization condition to grant the easement should not even be a consideration for the City since the public benefit should be above any private economical benefit. The second suggestion to work with the Port for a temporary sewer service is a non-starter. We are in the City of Cape Canaveral Jurisdiction and we are within your utility service area. Our dealing should be with the City and not with a third party to obtain sewer services. David, If the City requires a gravity connection, at this stage, then the City should require a public sewer easement on the LBA property as this would be the only way for my client to connect to your system and have a viable project. In short, the City is able to support: * The installation of a gravity line (non-pressurized only) from the Holiday Inn to lift station #6; or * A temporary provision of sanitary service from the Port until a permanent solution from the south is available. As you know, the City has requested an easement from LBA north from Lift Station 6, and the developer has verbally agreed, but only after 3 years have passed after market stabilization. As I have previously indicated, the City is willing to discuss the granting of sewer impact fee credits to help offset the cost of required line extensions. If you have any questions related to these options, or have any others, we would be happy to discuss them with your team.
