Hi Todd;
I hope all is well.
Laila forwarded the email below to me for my review. As you know we
have been working with the Port to approve our development and allow us
to obtain drainage, utility and access easements through the Port
property. The agreement with the Port will entail preliminary locations
of water and sewer infrastructure, and intersection/traffic light
improvements. The Port has requested letters from both the City of
Cocoa for the water line improvements along Columbia Road and from the
City of Cape Canaveral for the sewer line alignment indicating that the
proposed preliminary alignments are acceptable to each agency. Sketches
of the water and sewer alignments were sent to the City of Cocoa and
City of Cape Canaveral respectively. The City of Cocoa has responded
that the proposed water line, while preliminary, is acceptable which
satisfied this part of the request.
Todd, we have been coordinating the sewer alignment with the City since
we started this project. At our pre-app meeting last year, you have
invited the FDOT personnel to discuss the alignment and basically the
City was in agreement to have the force main as a public main as this
was the only way DOT would allow installation of the main within their
right-of-way. You have requested that a maintenance agreement needs to
be executed between the City and Daniel Corporation for the force main
maintenance which is also reflected in your enclosed email to Laila on
February 15, 2017. In addition, we have been coordinating with David
Dickey on the PD application. As you can see from the enclosed email
from David dated February 2, 2017, he requested that we get the utility
easement (Sewer in this case) with the Port finalized before we submit
to the Community Appearance Board (CAB). This made sense since the
City wanted to ensure we are getting the Port to agree to grant us the
utility easement as this will affect our project before we are placed
before the CAB and Planning and Zoning boards.
So we have pursued the route requested by the City and we are towards
the tail end with the Port as we agreed to the Port requested
improvements within their property limits. The only outstanding item is
the letter from the City agreeing to the force main alignment.
Todd, we are not requesting that the City advocates our project. We are
only asking for a letter that the city is an agreement with the force
main alignment consisting with our previous discussions. You can add
language if you choose to that final approval is contingent upon review
and approval of the construction plans by both the City and by FDOT so
this provides the City with a say on the final alignment or connection
point.
Todd, we are very close to the get the Port to approve our project
which was the first step requested by the City prior to processing any
of our applications and we have been working diligently with the Port on
these issues. We are only in need of this letter from the City so that
we can finalize our Development Order with the Port. We would greatly
appreciate your help on this matter as we are not asking for an approval
letter since the fore main is not designed only that the City finds the
alignment acceptable, given that we do not have too many alignment
options, so we can move forward with the Port approval.

Dear Laila,
I am in receipt of your email from earlier today regarding acceptance
of the sewer line for the proposed Holiday Inn off Columbia Road.
After discussions with Staff, it is our position that the City will not
advocate or act on your behalf regarding this matter, to include
accepting or authorizing easements located in any public right-of-way.
Further, until you are able to determine the number of units that the
proposed hotel will include, your application for the Community
Appearance Board will not move forward. This is due to the fact that a
critical component of the CAB’s review of the project is what the
building will look like (i.e. building elevations, site plan). The
size/footprint/configuration/exterior may change if you cannot get
approval by the City Council of the 125 rooms and must build the
required 150.
